Personally I think that's what they're after, and I'm not alone in that view. It's very similar to the US Presidential election in 2016 where the Democrats can't and won't accept defeat

      @@Fireglo Yes you can. Someone commits an action, society considers the act so heinous, that it then gets codified into law as a *named crime* so that the person can be punished. People were being killed by other people long before the crime of murder existed, then society realised people killing other people without consequence was a bad thing so it was made into a named crime in order to punish the offenders. Very rarely does a society predefine a crime before that act has ever been commited.

    5:29 Johnson: 'I think the court was wrong to pronounce on what is essentially a political question at a time of great national controversy.' Well, 11 out of 11 supreme court judges disagree with you and they are far more qualified and believable to know what they are doing than you are. Besides, it is very poor statesmanship to be seen openly criticising and disagreeing with the highest court in the land when they have already passed judgement even if that judgement happens to be at odds with your personal and political beliefs. A good statesman would want his citizens to accept court rulings, especially those cases the citizen lost and generally respect the judges. One has to lead by example.

      Yet the High Court took the opposite view and in this verdict there were curious undertones which suggested the 11 were well aware they were on dangerous ground - another reason why they had to make it unanimous. I believe more in Reece-Mogg who has an encyclopaedic knowledge of our Constitution but I watch even more for Dr Davi Starkey's comments when they come, I think on RUclips where he has a number of fantastic posts . Bercow an ape, Dominic Grieve a s... and even has a go at the Royals. Will be very much on the look-out for that.

      @@jamesdouglaswhittaker6645 It was proper for the Supreme Court to hear the matter. The Scottish Court of Session ruled one way, the High Court ruled another. I would take the knowledge and expertise of the 11 Justices of the Supreme Court over that of the High Court as they are generally some of the most knowledgeable of the UK Constitution.
      The Rt. Hon. Rees-Mogg is not a lawyer. Even though he is a very eloquent speaker and well educated, he has not gone through legal education. This is poignant, as the UK Constitution is uncodified (as in, it is spread over many documents instead of a single document, i.e. The US Constitution). There are several documents that provide the basis for the UK's Constitution, including the Magna Carta (1215) and the Bill of Rights (1689) straight through to the EU Withdrawal Act (2020).

      He was found to have broken the law in two courts ( the Court of Session the highest civil court in Scotland and the Supreme Court the highest court in the UK)
      Three judges in the Court of Session and eleven judges of the Supreme Court unanimously found Boris Johnson to have mislead the Queen and broken the law. Boris Johnson thinks he knows the law better than 14 of the top judges of the UK. He is mad.

      dusted.Insisting his move was legal against the opinion of a panel of judges reminds me of what's happening with his bouffant headed counterpart on the other side of the ocean. Give him an inch and he'll take a mile. And then what?
      You can't get much done in a climate of discord. Quite frankly I don't think Boris is the right man for the task in front of him.

      This poltiical court set up in 2009 on the American model should be dismantled. Does anyone know hwho is even eligible to join the little panel of judges? Who appointed them? As it is a poltical tool, why should he not disagree with its decisions?

    He’s provoked sharp anger here in Ireland by constantly referring to ‘the surrender act’, and similar hostile language. Britain’s fellow EU members are not a hostile force - an enemy - to be resisted and fought against, including us, the country with the most complex, and frequently violent history and ties with Britain. To use such language engenders a hostility towards the Eu, and her citizens, that feeds straight into toxic far-right extremism in Britain and elsewhere, and could spur on violent extremists or lunatics into attacks on ‘the other’, which would also include British politicians (not necessarily those opposing Brexit). One might expect a similar amount of silent anger across other Eu states over such intemperate language, while we, of course, continue to note the utter lack of a solution to the Northern Ireland Border Issue, despite the dishonest claims of ‘progress’ being made - our own Tanaiste (Deputy PM) this week called the proposed plans and solutions “fanciful”. Once again, it seems, the British public are not being given an honest account of the true failure to meet Brexit realities.

      It is indeed a surrender act - I see no animosity to the eu nations, only the eu. Do you not see the discontent in those eu nations toward the eu organisation? It is corrupt in that it's books have not been signed off for years and, with the new leadership being such a corrupt and incompetent lot, I expect nothing to change until it collapses altogether. There is no chance of a deal while the UK in within the eu. Common (business) sense can only prevail when money is at stake as the UK is the largest customer of the eu and their businesses will be able to drive deals properly.

      You have something very wrong here. The recent actions and language from the EU is hostile and under no considerations whatsoever can the recent attitudes of Verhofstadt - coupled with his strident language in a speech (the like of which I hoped never to hear again) announcing this vision of an 'Empire" of their dreams. At last the reality is being revealed - but only so perilously close to the full implementation of the Lisbon Treaty in 2020. So close and so permanently binding all participants to the yoke of this undemocratic, protectionist Union administered and directed from one Central Control over-riding individual Governments.
      Until the full extent of this "dream" - or nightmare as sometimes perceived - is fully studied and completely understood ( and few have done so) the end effect of it's impact on the lives of ordinary people cannot be appreciated. The highly emotional chatter over Brexit is drowning out the reality of the end game, the end impact on our lives. The slowly constricting controls will prove tighter on our children and even more binding on our children's children.
      I ask you Ver Coda to consider this: - The highly commendable original EEC plan was for an group of Countries to join into into a barrier free, tariff free , mutually profitable,purely trading Association. The expectation was that this would also promote friendships and peace throughout war torn Europe..Brilliant. So how is it that this peace promoting ideal has, in less than half a lifetime, morphed into a burgeoning 'Empire' now hell bent on building an Army prepared for war ? Why are it's member States split between well off and broken Countries (under a flawed Euro and imposed controls, both political and economic)-now pressing for a return to Nationalism and their original currency.. This has not happened by accident. Rules and currencies can be amended to suit circumstances and help friends in need -if the will is there. So the will is not there. . Is that sensible let alone friendship? Or......
      Ireland may well have special concerns. Among friends and those of good intent they are not insurmountable. Given time. Among friends reach special understandings.. Any return to violence would be deplorable but in truth it will not happen unless men of violence. wish it. There is no need for that, particularly if the future is assured through right decisions based on thorough understandings of all circumstance.

      It is not a question of the EU being an enemy. It is simply that most people in the UK do not wish to be part of the ever closer political union to which the current EU leadership is clearly committed. Having said that, the EU's strategy in the Brexit negotiations has done nothing to allay perceptions that it is determined to make the UK pay a heavy price for leaving and this has fomented much of the hostility to which you refer. As an EU without the UK will become an organisation in which three countries will have to subsidise the other 24 for the forseeable future, it would be much more sensible for the EU leaders to agree to a separation that minimises any adverse economic consequences for both sides.

Again some people for example think Bismarck was wonderful ; others hate his guts. The same could be said of any important leader. Is Al Johnson my favourite person - no. Do I think he has a less than ideal hand in trying to get a parliament overwhelmingly in favour of remain to deliver our exit - certainly. We are going to have to accept that if parliament continues to subvert a democratic excercise, the executive will need to get more and more underhanded in response.

    Please Enlighten me how I can be wrong.
    1. There was precedent made before where Parliament did indeed use Proroguing for frustrating parliament. This was presented by the lawyer defending the government. Where was the consideration for that precedent in this judgement? Why was it dulled void and not relevant to said judgement?
    2. The judges decided they have the power to subjectively decide if the length and reasons for the Proroguing are lawful. Isn't this dangerous territory for our courts to be in? Everything political should be of the decisions and influence of government only.
    3. Now that judges have decided you can't frustrate parliament by using proroguing by cherry picking certain precedents and disregarding others. Can we hold accountable previous PM's that have ''abused'' its power such as John Major. John Major was a supporter for this case, which is ironic.

Fourteen of the top judges in the UK unanimously found that Boris Johnson broke the law by closing down parliament.       Nathan Ellis Moot point. If he negotiates a deal before Oct 31st then by all means Brexit should proceed. Without a deal moving ahead would be a disaster and cause even more political turmoil as well as economic chaos. The Conservative party has had three years to negotiate a deal and has nothing to show for it. He’s promised a deal and needs to deliver. If that means another delay, that’s the price to be paid. A majority of Parliament has demanded it and now the law requires it.

    The law the supreme court states Boris broke didn't exist at the time. The supreme court created the precedent there and then, which is extremely disturbing.

That actually would solve a lot of problems considering that England does not have a border to the Republic of Ireland and Scotland neither wanted to leave the EU nor the United Kingdom.       @@Brot1984 we has a nation should go back like we were in the early 70s, we were worse off when we joined, so how could we be worse off leaving give back the uk to its people provide teaching, by our hospitals not in turmoil let our own factories provide for are own people, instead of employing cheap labour & sending our monies over sea's , go back to being England full stop, with no deal or with a deal, it will not hurt the uk.

      @@earthman6700 But your position is NOT the claim of the OP, who said he belongs in jail. As per your claim, we appear to be living in a world governed by lawyers and not law. Law draws on prior precedence, to make its decisions. The Supreme Court has not done this, as there is a) no precedence for not allowing parliament to be prorogued, and b) for un-elected lawyers to reverse and strike off a decision made by an elected parliamentarian. Was he doing the proroguing for political gain? I think yes. But did he break any law in doing so? no. Result = It is going to take a long time to put democracy back together again.
