  • In this video, I discuss the potential downsides of settling a workers compensation case. One major drawback is that you may not receive the full value of your claim. For example, if you have a permanent partial disability, you may be entitled to weekly payments over several years. However, if you opt for a lump sum settlement, you'll likely only receive a percentage of what you're owed. Another negative aspect of settling is the risk of receiving a lowball offer from the insurance company. They may try to take advantage of your desire to avoid a trial by offering less than what your claim is worth. Additionally, by settling, you give up your future right to request benefits for that accident or injury. This means that you could end up having to cover medical expenses out-of-pocket down the line.

    My Adjuster, put that I only make 1,000 a month/ instead of every 2 weeks. So my payment was super low and the second one is 15 days late smh.

    SORRY ABOUT THE CAPS MY EYES ARE BAD ANS BLURRY.
    MY LAWYER AND ARBITRATOR IS EVALUATING MY CASE IM NOT READY TO SETTLE MY LAWYER HAS ALREADY SUPOENA MY RECORDS FROM THE DOCTORS. IM NOT SETTLING AND HE IS NOT LISTENING. I WILL CALL U.

      The earlier the better. It’s better to already have a lawyer in case there is a problem, then having to scramble to find one and then wait until he gets access to your file after a problem pops up.

      @@workerscompnewyork so I work for best buy distribution center for five years. In November I hurt my lower back at work, did light duty that made it worse so the doctor tightened restrictions to where I was off for about a month while I did 6 visits of physical therapy. Therapist recommended more physical therapy but the Dr just literally said "well we'll send you back to full duty and you can always come back if you need to". Which I was still hurting and thought that was kind of messed up and I knew I'd reinjure. It took 3 weeks I think it was and I reinjured way worse than first one. I've been off since January and have been getting a check every week from Sedgwick and they've been paying for the treatment. MRI on lower back showed degenerative discs disease, annular fissure tears, bulging disc, spinal canal stenosis, compressed nerves every damn where and all kind of Dr words I dunno seems like a bunch of stuff but I dunno what's what and how bad it all is and what not. I know Internet says degenerative discs disease don't go away and will always be a problem whether big or small. I had Injection and I'm waiting to see a specialist. I like my job and I'm proud of it. I don't feel like I've been treated poorly through this even though it has caused a ton of hardship including my family being reduced to a motel room and in survival mode and hungry. Checks aren't my full check and first two months worth were all late as can be. There's probably more I could explain but this is a long enough comment as it is. I'm new to this and I don't really know what I should be doing. I dont know how they will treat me when I'm back to work if they allow me. I just don't know what I don't know. I'm in Ardmore Oklahoma. One question I would definitely have is how long will they pay me weekly

    Can a employer deny you workmans comp if you have been on the job for 3 days?

      That is an easy question that I’m going to make a little more difficult just to provide some explanation. The short answer is absolutely not. You are entitled to benefits the first minute of your first day on your first job provided. It is a covered employment. If you were working and you got hurt, and your employment is one that is covered by the New York State Worker’s Compensation law, then you are entitled to file for benefits. The longer answer hast to do with your use of the word “deny.”
      An employer or an insurance company can try to deny whatever they want. That’s why you should have a good attorney on your side to help you with your claim. We see denials on claims all the time. It doesn’t mean the person will not get benefits.
      Your employer does not have a final word on whether a claim is valid or not. That is a legal determination for a judge. If you have questions, seek out a good attorney to help you with your claim.

    Im working with a lawyer im not happy witv he continues to make decisions on his own not mine. Wanna change lawyers. My accident happened last yr. Tripped and fell last November.Broke lensez in my L eye My right eye severe cataracrs. in my R eye. Was blind for 6months . Sorry still jave problems after having surgery a few months ago.
    My lawyer im not happy with He makes decisions on gis own doesn't discuss anything with me and always wants me to EXPLAIN when asked a question. LThen repeats him self again and again. Makes me feel stupid.

      I changed lawyers early about three months went with a more reputable private firm than the other franchise firm 🎉

      It's hard to change lawyers. If you do, he can probably still get a portion of your settlement, then you will be left with owing 2 lawyers instead of one. He/she will probably charge you for however many hrs he worked on your case at best this would probably be your best case scenario. Oh and because of this, a lot of lawyers won't take your case if you already have a lawyer. Good Luck. Call and ask though.
