    My, my. This woman in the Records department, acted like a petulant child!! “I won’t help you, unless you stop recording”!!! Then she starts cursing like a sailor. Totally disgusting. Then the cop clown 🤡 comes in asking for 🆔. No crimes were being committed. These good ole boys thought they would intimidate this citizen. Keep on pressing sir.

    Just one comment. Turner V Driver is the 5th Circuit, and FL is the 11th Circuit. What you have there is Smith v Cumming which states, "The First Amendment protects the right to gather information about what public officials do on public property."
    Presumably, if she is the town hall clerk, she's a keeper of public records and that makes her a public official.

      @@khdeaconfan Punta Gorda is in the middle district of FL so it's not binding on the northern district where Apalachicola is located.
      Sheets circumstances were also a little different not only because of ordinances, but because of where he was located inside the building where he was.
      Mind you, I don't fully agree with the outcome but he chose not to appeal it, so who knows where it could have gone if he had?

    Yeah this don't have anything to do with this 😢 Mesa Police Department pulled my friend over for not stopping all the way at a stop sign the cop got his information and gave him his ticket handed back all his information and then the cop said I want to search your vehicle and he said no the cop said I smell marijuana but my friend doesn't do marijuana so he told the cop the stop is over with start it up his car and started driving he was pulled out of his car at gunpoint by this cop and now the cop is in real big trouble he is suing for as much as he can get because the cop violated is right what's the traffic stop was over he had a right to drive away but not according to this police officer he's been fired and facing charges of assault with a deadly weapon false arrest just thought I'd let you know😂

    What happens when illegal photos are found on private phones? I am not sure what illegal photos are defined as. Sending them to someone is probably the crime.Just don’t know.

    Police have an obligation to collect evidence. No bodycam should bring their testimony into doubt.
    I'm waiting for the gourt case where a jury believes someone's testimony over a cops purely on this legal argument.

    I am somewhat familiar with public safety equipment (2-way radio), but I believe most of these units are equipped with their own ‘FirstNet’ (AT&T) SIM card, and they automatically upload to the ‘cloud’. I like body cameras, I like dash cameras, they keep everyone honest (or they should), they also make for great entertainment when someone acts the fool on one.

    If you go to Brett‘s page, not only does this woman publicly comment regularly on his post. She brings his personal life into context which has no reason to be brought into context. Her vehicle has a thin blue line flag on it and says that she’s the black Jeep of the family because she drives a black Jeep lol how original. I must say I have tried very hard to not get involved in Brett’s auditing but if anyone out there can point him in the right direction or legal assistance in the state of Florida for first amendment and apparently also fourth amendment violations, he would greatly appreciate it.

    Brett should FOIA the audit log for Officer Smith's body camera for the entire day then examine the time period of the incident for recordings or delete events. Also FOIA all Police reports from that day and possibly the next to see if there is a gap in report numbers.

    Body cam footage should automatically be uploaded to a third party. As it is recording. That's just another set of checks and balances. In which there doesn't seem to be much of for law enforcement.

    Employee in records department at Apalachicola Town Hall has worked to make it so people DON'T want to visit the town or even spend a penny there. Looks like a corrupt town for sure and the fact that the police didn't educate the employee that he has a right to video in public and ALL PUBLIC SERVANTS. She must think she is special and only made herself look like a total fool and unprofessional and rude. This video (sound) part should be played at a town meeting for the Mayor and other officials to see what she did and hold her accountable. And the body cam.... well pretty obvious that the cop deleted it and I would still put in a public records request for his body cam for the 2 hrs before and 2 hours after the incident.

      Creek Indians from Georgia and Alabama began settling along the river in the early 1700s. Apalachicola is an Indian word for “the people on the other side.” Today, the river today separates Eastern and Central time zones.

    I used to live in the Florida panhandle and I would take a greyhound from a little shit down called Defuniak Springs Florida to go to Tallahassee Florida. Apalachicola was on the route and we would always stop there to pick up patient leaving the mental hospital. I wonder if Karen was ever a resident of the mental hospital?

    The supreme court hears about 100-150 cases a year and refuses to hear 7000 - 8000 a year.
    Of the 10’s of thousands of cases a year, the myth is that any one case can be determined by, or has been decided by the supreme court and that is the only place you will find precedence, or deciding material to use against what is clearly an abusive officer or employee.
    The truth is that all city & state entities can be most easily defeated using their internal policies and procedures on interaction with the public and our rights.
    The 14th Amendment guarantees Equal protection under the law for us all and forces a states employees to govern impartially and to not draw distinctions between individuals solely on differences that are irrelevant to a legitimate governmental objective, like a no recording policy for citizens, but not this government employee. The employees recording the citizen while demanding the citizen stop recording is the best way to easily defeat her in a lawsuit AND change policy, or bad government employee behavior. Sure, you can use the recent supreme court cases NO ONE KNOWS ABOUT YET, but why not just use the policy EVERYONE KNOWS AND EXPECTS, common decency, professionalism, and respect while pointing out the hypocrisy and / or lie that recording is prohibited.
    With regard to the bad cop…
    A departments policy on use of government databases and even entry into said databases for an unlawful use, or without the necessary law enforcement use predicate. It is a myth that law enforcement can look up a private citizens name, address, phone number anytime they want, especially if they have no reason to even enter the database and then use it to intimidate or harass citizens and that is exactly what that officer did on camera and in front of his supervision. I would be willing to bet that the Department policy and the officers own words and actions would be enough of get at least a letter of reprimand inserted into his permanent record that would cost him vacation days, promotions and possibly result in termination of employment if its a pattern of abuse of power. When coupled with other policy violations in his record it could even rise to criminality resulting in an officers conviction without any involvement in court by the citizen.
    This best illustrates the need to report problem officers. Remember, it’s not the fact that the department can and most likely will investigate and find no wrong doing, it’s the facts and pattern that eventually emerges that really matters.
    The tide is changing!

    Come on now get your cases straight. Smith V City of Cumming is the 11th US Circuit Court of Appeals case effecting Florida, Louisianna and Mississippi.
    Turner V driver is 5th US Circuit Court of Appeals and only effects Texas, Louisiana and Mississippi.
