  • This is Officer Cobble of the Inkster Police Department in Inkester, Michigan! He was sued in 2019 for violating an innocent citizens Fourth Amendment rights. In today's video, he does the same thing. He opens a car door without a warrant or consent. Obviously, the first lawsuit didn't teach him a lesson. It seems the department is allowing this to continue!

      No disiplanary action taken, violates the fourth and fifth amendments rights, and threatens citizens with arrest and eviction, but is allowed to leave the department with honor. While the city is left with a potential lawsuit against the formor officer/department.
      Does the city love losing alot of money from their officers misconduct (I guess so)? And hes a danger to citizens since he cant control his anger/ego while blatantly violating their rights. This officer shouldn't be allow to work in law enforcement.

      While that is true, sadly, it is not likely to happen. First, this is a state issue and not within the purview of the federal government, so each state would have to write the laws to do this. Second, the police unions are exceptionally powerful. When legislators try to push police reform, the unions run ads that the candidate is "Soft on crime." The public hears this and since the public want to be safe, they will just assume that the cops know what they are talking about and not vote for that individual. Last, while most people on these social media pages think that Qualified Immunity is something only cops get, it actually covers ALL city, county, state, and federal employees. To specifically target one group of these employees would likely be met with civil lawsuits saying it denies them an important benefit that all other government employees enjoy. i feel confident that the state legislators could get past that if they lacked the will to do so, but see #2.

    Both of these cops have to be fired because neither of them now the law and they are not going to learn it because they have already been to court over the same thing and they are doing it again they should be fired and loose their pension so that they pay the consequences for the abuse to the public

      Colorado has criminalized the "Failure to intervene". This law is specific to excessive use of force, but if the cop sees excessive use of force and does not intervene to stop it or does not report it, that is now a state misdemeanor. (d) Any peace officer, as defined in section 24-31-901 (3), who fails to intervene to prevent the use of unlawful force as prescribed in this subsection (1.5) commits a class 1 misdemeanor This is good legislation. All states should copy it.

    Public opinion is extremely important, there afraid of great numbers becoming aware of wrongdoings, we're all brothers and sisters and got to act as such, the only power they have is the power we give them, so gather in massive numbers and revoke that power, the public need to voice there disgust at the amount spent from the public purse to make amends rights violations court cases, 🇬🇧🇬🇧🇬🇧🇬🇧🇬🇧🇬🇧🇬🇧

    What is it about people's ID's that makes it so precious to police? Seems like police are more eager to get their hands on ID's than they are about solving crimes and upholding the law.

      There is a very specific reason and that is the the second paragrap, so skip to it if the rest is boring for you. First, cops are not really trained in things like clearly established rights, and I will explain the reason for that as well. Second, almost all police departments have a written policy that tells cops they are supposed to ID everyone that they are supposed to _ask_ for ID from everyone they come into contact with and if you watch enough videos, you will see that the vast majority of times, cops start by "asking" for ID because that is what the policy says to do. Now, since they are not trained well on when the subject is compelled to lawfully ID, you get the case where a cop does it so much that they simply think the subject HAS to ID and they threaten or even actually arrest if you don't comply. To be a crime, the cop has to KNOW that a right is a clearly established right, so if the cop does not KNOW that what they are doing violates a clearly established right, the DOJ cannot prosecute them for violation of rights, so keeping them ignorant during training protects them from criminal prosecution.
      Now for the "WHY????" It is considered to be a good law enforcement practice because for the simple reason that the more IDs you run, the more people you find that have warrants, and if you have a suspect in detention, knowing if that suspect has prior arrests may help you establish reasonable articulable suspicion (RAS) that they were involved in a crime or about to commit a crime. In Stop and ID states, this is so that if you have a record and they have the RAS, they can ID you and let you go, but then if they get more detailed info to suspect you did commit a crime, they now have a name and address of the suspect for a warrant. There you go. That is why they do it. The police leadership tolerates the lawsuits because they don't come out of the department budget and they think the damage to the rights of an individual here are there are a small sacrifice for the greater good of being tough on crime. This is the best answer to your question you will get. I don't like what cops do, but now you know why they do it.
      This was a long response, but it is a very simple to ask question, and yet one that fully deserves to get a complete answer. I hope that you found this useful, and when you read comments elsewhere, I hope that you now have enough understanding to help others in their struggle to figure out why the system seems so broken.

      Qualified Immunity does not and never has extended to cover violations of clearly established rights. Cops get successfully sued every day in the USA. Now the cops never pay out of their pockets, but the taxpayer gets the satisfaction for being compensated for the violation of their rights. Cops can also be arrested for violation of clearly established rights, and this does happen from time to time, but the DOJ does not want to get in the way of the states and prefer that the states deal with the wrongdoing of law enforcement officers in their state but the DOJ will sometimes come in when the case shows that some justice is required that the states may not do. Typically, the DOJ only gets involved if the case was clear and there was an excessive use of force that resulted in serious injury of death. It is hard to win many of these cases, and again, the DOJ does not want to walk all over the states, so it rarely gets involved unless the violation was extreme.

      Taxpayers virtually always pay one way or the other. There is little prospect that this will ever change because it is a function of the state laws and not federal laws. Unless your state leaders want it to happen, it won't happen. The state leaders will only change it when it becomes a ballot issue and they will face severe criticism from the police in union purchased ads that say that the candidate running for election is "Soft on crime." The public will see this and take the word of the cops that the candidate will make them less safe because a lot of Americans still have not seen the true extent of how extreme US policing has become.

      There is no qualified immunity against being sued for unlawful arrest or violation of clearly established rights. Cops get sued all of the time. Now they can be charged with crimes on the federal level, but the DOJ does not like to poke around in business run by the state. They will if the violation is severe enough, but they don't like to do it. If a cop violates your rights, unless they physically injure you are lock you up for more than an hour or two, your remedy is a civil lawsuit. For the state to get involve, it would have to be a case where the cop willfully violated your rights, usually by use of excessive force, but if you want change, don't look to the federal government to do that. Qualifed Immunity covers ALL government employees and they are not going to make that go away.

    SCOTUS has ruled that you have to verbally invoke your 5th Amendment rights, like saying "I am invoking my 5th Amendment right to not answer any questions." Just remaining silent do not afford protection and without verbally invoking you can be considered guilty.

    I would say the ONLY exceptions to not having a search warrant or permission to enter a vehicle would be if the officer saw something illegal by way of the "plain view doctrine" or if there were exigent circumstances such as a baby in a locked car on a hot day.
    It is clear neither of those would apply in this case.
    So what was really happening in this video is the cops were driving through private housing and running plates on the vehicles parked there looking for people they could arrest on wants and warrants.

    I live out in the middle of nowhere, and I always lock my doors, car, truck, house, it doesn't matter! They're always locked. You never know who will decide to stop by to commit some nefarious act.
    We need to remind the jackals they are outnumbered, daily.

    Inkster PD surely doesn't! I live in Dearborn and have personally dealt with them as well! I have a situation going on with the Lincoln Park PD going on. My elderly friend and I were coming out of a neighborhood in a neighboring city we noticed their were LP cops sitting on the other side in Detroit borders, we pull out of the subdivision they pull us over after 2 miles with 4 cop cars forced to get out of the car (mind you the lady who was driving was 76 years old) they searched the car separated us and said " why are you coming out a Black neighborhood " I told them I don't have to tell them, needless to say they found nothing had us pulled over for about 30 mins having us in the middle of the road she was so scared ended up having an asthma attack! At the end one of those dirty undercover units left his cellphone in her car. They did all that for nothing!!! 😢🙄😡😈👹

    Unbelievable. Sgt actually says im gonna arrest you for not answering my questions!! Then what read him his Miranda rights...you have the right to remain silent...
    Then internal review, he wasn't arrested for not answering questions, so no wrong doing, sgt cleared. SOP
