      Dear Jo TheSkier: What is "legal" doesn't always coincide with what is "moral". I feel that it would've been moral for this family to have hired some "muscle" just to throw her and her possessions out into the street, and then deal with the legal consequences later. Better still, they should've hired some "muscle" to make her just "disappear" forever. That would've eliminated any legal consequences for them altogether. And since she says that she's alone in this country, who would've even reported her as missing ? That's what I would do to a renter who filed for a restraining order to get me out of my own home.     Shameless woman! The landlord is also a single woman raising two kids. People like that makes a lot of potential landlords afraid to have tenants; thus adds to the housing crisis in the Bay Area.

And funny she moved out of the house 4 days before their hearing because she knew the law wasn't on her side. This lady is nuttier than a fruitcake.       @I am joebama and you ain't black it's actually not uncommon for that kind of behaviors in Mainland China. My uncle said in China it's not about who is right or wrong but who is the loudest and the biggest bully.
      He told me a story of some guy hit someone's car and got into an argument with the person who owns the car and beat the car owner and took his money and blame the actual victim for the damages. Also the famous fake car accident victims.

It said: " Unapproved Work was observed inside the attached garage with completed construction.       " All modification or change of dewellings from original approved use and classification, such as A SINGLE FAMILY COVERTED TO A DUPLEX OR GARAGE COVERTED TO A LIVING SPACE REQUIRE APPROVAL AND PERMITS."
      "YOU MUST OBTAIN ALL REQUIRED TO LEGALIZE, ALTER, OR REMOVE THE UNPERMITTED CONSTRUCTION."

    HORRIBLY SHAMEFUL TENANT. You lose your compassion when you find out that this tenant now lives in a rented two bedroom single house by herself. Also she professionally sues others for living. She definitely did try to milk money and punish the landlord through the court system. Tenants are suffering all over the country and you see a horrible person like this who exacerbates the situation for others via bad public opinion. More stories like these need to be reported

      @@nonebiz2132 I’m you can get a permit in any phase of the construction. It’s perfectly legal. It’s not a crime. At the most the city will send you a letter it is called a nuisance letter and so long as you submit your work plan with a contractor after paying the fees it is legal. People get nuisance letter if neighbors complain for replacing a fence half feet over city limit. Almost 50% of California homes may have nuisance violation codes due to owner preference building alterations. The city had given permit to the owner. It’s verified. That’s besides the reason.
      This freeloader wants to stay rent free and squeeze money out or the landlord. That’s the real issue here.

    My first tenant was this type. They’re professionals at this. Either theyve been through the eviction process or they know about it enough to extend it to the full extent the law provides. My tenant stopped paying rent, didn’t answer calls and after I won the eviction he challenged it knowing it would give him at least another couple months ... then close to the 2nd court date, he tried to negotiate with me when my lawyer contacted him, he asked to stay and slowly start making up the previous rent. At this point, I was pretty sure he knew the game so i did exactly the opposite he requested.
    From all the mistakes I made, the best decision I made was to not think about being able to recoup my previous rent and told the lawyer no negotiations. He ended up not showing up to the 2nd level court hearing and moved out shortly after.
    This persons story gave me deja vu with what she did with that family.

      @@esan3289 there isn’t really much signs other than doing homework into checking their references. Currently, my line in the sand is evictions. If a potential tenant has a eviction, regardless what his other references are, I’ve told my property manager that I’d rather keep the property empty.
      Late payments are a red flag but I take it case by case.
      I’m not going to say I’m some profession, far from it but that’s just what I’ve learned so far.

    The dubious "lawyer friend" who has been insider her unit multiple times (to inspect her plumbing, I presume) and the irresponsible politicians who created the dysfunctional rules that handicapped the courts. They are the real villains in this tragedy.

    Allegations against Ms. Jiang: (1) Filing restraining orders for harassment against all her legal housemates, including a twelve year child, then intentionally refusing to show up to present her evidence. (2) Intentionally or negligently causing tens of thousands of plumbing and structural damage to the rental. (3) Causing so much disruption, that your legal housemates have to move away so that they can function. (4) Using an excuse for refusing to pay ten months of back rent, due to damaged premises, auxillary construction, and other general health, safety, harassment claims. (5) Abandoning the rental, days before her eviction lawsuit, so the contested factual details of which, the legality of each party's claims, and ultimately, a judge's adjudication cannot be entered upon the record. Thus, Ms. Jiang has successfully avoided the possibility of a negative eviction record. (6) The gall of her sentiment, "If you don't believe me, you can take it to court." OH IF ONLY YOU WOULD SHOW UP.

    There should be updated laws in place to create more stringent parameters for establishing residency. Missing rent for more than three months should revoke residency. These types of tenant protection laws create squatters. It is a nationwide problem now.

    My grand dad always called people like this ‘faccia cattiva’. He knew just by looking at their eyes. That means ‘mean face’ in Italian. He was right. I’ve seen it at times and trusted my gut and his words of wisdom. You can’t change their inherent mean, deceitful, and angry nature because they don’t know any better.

    Candice thank you for this reporting. There are so many nightmare cases for small homeowners who become vulnerable.
    My parents had trustingly rented to a man who stopped paying and broke things because of
    His mental
    Health problems. I looked at his rental application and it was incorrectly filled out with false information. He took advantage of my immigrant parents.
    His mental health declined in two years and I called his mother and brother. I had to call police multiple times and finally filed a restraining order and hired a lawyer for evictions once I built a case. It took 2 years to remove him. My worst fear was for my family’s safety as he yelled and cursed that he was going to kill someone. I had to file evidence of this violent outbreaks and threats. I have my parents and two young siblings in the house at the time. We felt terrorized in our own home.
    Please keep reporting these incidences! My friend sold her home during pandemic because her tenants stopped paying rent too.

Not honorable.You rent a master bedroom with health and safety violation, breech the quiet hours stated in the contract, go into my room without permission or cause and sublease a property without full disclosure or the owners permission, and no mold disclosure required in San Francisco but yet i Always paid the rent.....No...you are not honorable and use your religion affiliation stating; i am a church person...No church person with a conscience would do these things..Thank heavens i made it to the end of my lease...Thats why you never ever sign a lease for more than 6 months as the skeletons come out of the closet around month 2 or 3???

    I'm a landlord and I can tell you that tenants are taking advantage of Covid for non-payment. The Landlord are the real victims in this story, and the government needs to offer adi to landlords for putting them in the no eviction situation. Landlords need help!

    For any small home owners out there, do not rent out to anyone during this pandemic. The law is not in your favor and squatters like this will screw you over. Wait until the moratorium on evictions is over. For those who think more laws to help renters is a good thing. It is not. Less people are willing to rent if landlords are powerless like this poor family.

      Ok, good. Maybe fewer landlords wouldn't be a good thing. Scummy landlords charging way more than houses are worth, and raising rent every year by outrageous amounts, is a great thing to get rid of. Fewer rentals available would mean more homeless, which would make the government do something to help people buy homes, leading to fewer people paying $1,800 a month for a place the size of a closet when they could buy a home for $750 a month if they just had some help with the down payment.

      @@tarabooartarmy3654 fewer landlords is a bad thing. This means rents would increase.
      To get a septic permit in parts of CA it can cost upwards of 72k. The reason housing is so expensive is because of government intervention, not the other way around.
      We actually currently have higher rates of home ownership in the history of the US, wirh the exception of right before 2008 crash.
      The government intervening and providing assistance for buying homes will cause a higher demand on houses and continue to increase prices. You're being fooled to think that the landlords are the problem, when in reality the problem is the government making it extremely difficult and expensive to build new housing that is driving prices sky high.

    It should be easier to evict a tenant. If you are late on rent and don’t have a plan to pay, you are in violation of the contract and should be evicted immediately

    I rented rooms out over the course of my going to school. Almost without exception the people renting would say that I could use the kitchen and TV room, and within a month they were complaining about one thing or another. Until I stayed in my room only, not having a way to make meals. Basically when people rent, they want your money, but they don't want to see or hear from you at all. They want you to be gone all day and spend the night somewhere else. My advice is if you rent a room, know that they want your money, but not you. Pay your rent and then sleep in your car. Only park your car down the street so you want to disturb them. If you must shower, don't use any water. For heaven's sake, don't use their electricity!

      @@MamaPanda76 I'm sorry I left that out! How thoughtless of me! All I used was the microwave. Because I was a student, I wasn't there very much. I went to school full time and worked. There were other people renting rooms in her house, she did the same thing to everyone.

    When she started causing water damage whether intentional or not, the homeowner could have turned off the water completely. Simple reason to mitigate the damage for insurance. Intentional damage isn’t usually covered, but vandalism might be. The homeowners need a good attorney and should sue the renter for any damage.

    I have a few tenants that are not paying the rent for several months because the California COVID-19 law says you can and the politicians are making sure that no eviction is possible. Actually they are the same problem paying tenants going back 2+ years. They are now LAWLESS. Intoxicated, smoking, taking drugs, breaking doors and windows, loud music day and late hours, having fights, jobless (maybe from fighting at the work place long ago? Not due to COVID), parking on the lawn, have additional tenants not on the lease and turn the place into a homeless camp.... just name a few. SJPD will not do anything because when they came, they saw nothing and heard nothing.

      You don't know half the story about the tenant. She is a communist party member. She is a lawyer in China. She is a lawyer's assistant here. She lives in Vallejo now in a two bedroom house. She has money to rent. She was punishing the landlord and her family for not letting her men come to her room late night. Also she does frivolous lawsuits against persons she thinks she can take advantage of or punish. This cruel tenant accosted a physically ill attorney in Santa Clara for assault and the police are catching up to her scheme. The criminal trial got dismissed. A civil trial she sued him is now investigating her lies and the court may prosecute her for perjury. Imagine the seriousness when the court is even investigating her STDs. She has Chlamydia. Her own attorney is running away from the case. What a shameless person full of lies. I bet she is a communist through and through. One thing I agree on trump policies is to keep Communist Party members out of America. This person should not be here.

    The renter sure retracted her claim of being a law student real fast...to saying she went to school in China...That Renter took total advantage of that poor women and her kids ...she was ruthless and I believe she ran the water on purpus. That renter took along time to come forward, after she got all her paper work together ...she then speaks out , oh and she pulls, "that, I dont speak english" ..cop out.

      She very likely has passive English. Meaning she understands everything in english but doesn't Express herself very well. Many interpreters also have this skill. I believe this interpreter in this video should at least have listed english as a B or passive language, certainly not as an A. In any case in an interview like this it's normal for people to want to speak in their mother tongue.

    Vandalism and defacing some other persons private-property is illegal. That's wrong for living free, not paying a verbal-agreement, and also ruining the living area is bad for credit checks. Land-property laws can ruin the credibility for future renting locations, for the person in position for fraud. The person in the wrong could suffer a bad credit-score and a realty-agent would have to be hired to find a location for people who have bad-credit. Renting again would be ghetto.

    My father owns a small studio in Fremont and the tenant is still working and has only paid him one out of eight months. He also is smoking and has a dog in the unit which were two things that broke the rental agreement. He doesn't care because Gavin Newsomes law says you cannot evict a tenant until February of next year. I'm sure he will further extend that. I know multiple renters near my apartment in San Francisco that are also not paying rent taking advantage of the situation.

      I think your father should proceed with the eviction notice and force the tenant to declare hardship. I copied part of the bill signed by Governor Newsom. "Under the legislation, no tenant can be evicted before February 1, 2021 as a result of rent owed due to a COVID-19 related hardship accrued between March 4 - August 31, 2020, if the tenant provides a declaration of hardship according to the legislation’s timelines. For a COVID-19 related hardship that accrues between September 1, 2020 - January 31, 2021, tenants must also pay at least 25 percent of the rent due to avoid eviction.".
      Your father should look up the whole bill and I am sure even if he doesnt respond the Unlawful Detainer will be in court by February next year.
