I agree with you. Every attorney and judge are different. I had DDD on my lower back and anxiety and depression and over 50. My 1st local attorney I found from google refused to take my case said I was not sever enough. I went ahead and applied myself anyway at 51 after I exhausted my short term disability. Denied 1st time. Look for local attorney again randomly from a list I got from local SSA office. A local attorney took my case without much question. Went to hearing while this attorney more concentrated on my low back and physical issue and less on my anxiety and depression. After 6 month, got a denied letter. Appeal again. Attorney quit the law firm, another attorney in the same law firm took over my case. This attorney was more concentrated on my anxiety and depression and not much on my physical issue on this appeal. Judge approved my case without a hearing. I was 56. Overall, it took me 5 years, 3 lawyers and 2 judges. They are all very different.

Wow. Very lucky. I'm 44 and I have severe depression, schizophrenia, anxiety, PTSD, stage 4 osteoarthritis in both knees and it took me four years to get a denial from a hearing. And when I say I have depression, I don't mean the type of depression that pretty goth girls use for likes on Instagram. My depression is the type that makes me cry every day uncontrollably and sit in my room... for six years. Good times, good times.

I used to do a large volume of Social Security cases, and I loved doing them. The trouble is that the judges on the cases got worse and worse in granting benefits, and the time lag to a hearing made it hard to justify the fees on the case helping to keep the lights on. I heard there is new legislation to increase the fee cap. But, until the problem of judges who feel that they have to deny every case to avoid being overruled is solved, I am not sure what will change.

Hello. I am having zero luck getting any attorney in Nashville, TN. to even talk to me about my case ( not disability-related). I was fired after my ups truck rolled off silently into a mailbox after sitting fine for over 2 minutes. Apparently, it broke out of park. I was told later my handbrake was loose. This was my 12000th +/- delivery as a newer driver, I had never given parking a second thought, and certainly never knew my brake became loose. I realized I had never undergone any training on the job other than a sup telling me to move faster for 3 days. We did not get trained out doing deliveries. I hadn't even had a sup watch me do a pre-trip inspection or ever demonstrate any methods of parking at a stop. I contend that if they make this type of accident a terminatable offense in the contract ( cba - which we were never taught about), it should have to be documented that I was properly trained and I know for a fact that it's not documented with my signature. At the very least, there should be an alarm for a major problem such as the parking gear not engaged so I have a chance to fix the problem. Other drivers in other types of accidents many times more serious, get their jobs back. That is discrimination. This is also entrapment in an unsafe work environment where I didn't have all of the knowledge of what could become loose that was up to me to check and tighten. This could have killed me or someone else. They also owed me from a previous grievance that I won but never paid. UPS wants bodies in trucks for $20 an hour, no CDL or on the job training and they simply don't care if someone dies. There is not a shred of online training they provide for new drivers to keep learning at home. I would really just like to know if this is a sound case or not? Thank you. Ryan you need to speak to an employment lawyer but Tennessee is an "employment at will" state (www.tennesseeemploymentlawcenter.com/employment_at_will.html) so my guess is that you would have an uphill battle. An employment lawyer in TN would be the correct resource for you.
During the midst of COVID I had an initial over the phone SSDI application process. However, the SSA down played my SSDI application and against my wishes process a SSI application. I appealed.

I know this video is several years old but I'm 36 and just had my 2nd back surgery in June 2018. First one was October 2013. Both were to save me from paralysis due to herniated disc pressing the S1 nerve root. I have Congenital Lumbar Spinal Stenosis, Degenerative Disc Disease, Foraminal Stenosis, Degenerative Arthritis, and Spondylolisthesis which is chronic. That is where the spine slips. I failed the nerve conduction test in 2013. I'm currently on my 3rd try for Social Security after being denied the first 2 times. They keep saying I don't have enough work hours. Well of course not. I've not been able to work for several years. Then they said not enough medical evidence. This time I've sent paperwork in showing MRI's, doctor visits, surgeries, emergency room visits, etc. I'm not sure if it's enough. I have 2 MRI's. One from 2013 and the current one from May 31, 2018. I can't sit or stand for long periods of time and still suffer pain. Is this something you can help with or am I wasting my time? Any advice is welcome.
I was 30 when I got a lawyer from another state that kept telling me I should wait another year every time my court hearings would come close to happening. I have a medical marijuana card and he stated they won't give me benefits because I'm a drug addict.then he wouldn't pull my humongous medical records dating back to a child because it said i had marijuana use on them. I called everywhere i have ever been seen to obtain my records on my own. I youtubed how to file documents with the court and proceeded to handle my case byyself. The last time he called to reschedule my court date I told him NO 👎. I want my court date and I will speak on my behalf. I have mixed bipolar ptsd anxiety that turned into agoraphobia and alot of other miscellaneous symptoms. I won my case by simply speaking up for myself and explaining my thoughts on why I needed benefits. I won my case and recieved a hefty amount from backpay that my "lawyer" didn't get a dime for. I think it's 2022 now and with enough research you can do anything you want without the need of some expensive lawyer who just sees you as a profit or a case number and not a human being. Disability Lawyers are just overrated scammers with a college degree in my opinion. Freedom of speech baby ✌️
I have systemic lupus erythematosus and have been denied two years in a row now. Currently taking 10+ pills a day and also have a disability card for my car. It actually boggles my mind how they denied me again. Going to have to bite the bullet and hire someone I’m also 20 years of age

Thanks for the video very helpful. Question: I heard you mention age being a factor Im 33yrs old and I had accident that shattered my hip completely, fracture 5 ribs and punctured a lung. I had surgery in June, about 4 days after the incident. About a week later i filed for SSD only to be denied 3mths later. Ive had a bad back since I was 12yrs old due to jumping a snow bank and missed it completely and landed on my chest kicking myself in the back of the head. I believe I was born with a over grown bone in my right knee. Now my two questions: 1. Should I bother filing an appeal and if so; 2. Should I include the knee and back thing as well....???? Believe me Im no stranger to work I feel a wave of depression because I cant just get up and walk this off. And I am a Subscriber now, you really help alot thanks.

Hi, I have to say that I am happy that one attorney is willing to tell his client(s) why they won't take his or her case. I am facing a hearing in unemployment where my benefits are being held. I can't get into the reason on-line, but when I stated my case to two firms, the attorneys refused to take the case and did not tell me why. One of the attorneys stated that if they told me why they refused to take my case, that would be giving me legal advice. Is this true? Can you direct me to an attorney in NYC that would take my case? Beryl, I suspect that some lawyers are hesitant to tell a potential client why he/she won't take a case because of the potential for negative online reviews. I have had that happen to me. However, I think that if someone takes the time to contact me, they deserve to know what I am thinking with the understanding that my decision not to take a case is not a determination on the merits and that it should not influence that person's efforts in seeking representation. Re the unemployment issue in NYC, I don't know anyone there who does that type of work so unfortunately I can't help.

Why does lawyers not help by sending client to doctors to help with their case? For instance if a person can't afford insurance or doesn't have a doctor? How much does it help your case if you go to the emergency room?
Fair question, Eddie - and here is the truthful answer: it has to do with money. Lawyers in SSD claims are paid 25% of past due benefits with a cap of $6,000. This $6,000 cap has not been increased by SSA in over 10 years, although support staff salaries and office overhead continues to go up. Further, approval rates are down. For most lawyers, the average fee for successful cases comes in at around $4,000. And we get nothing for our two to three years' of work if the judge does not approve. Finally, if a lawyer does advance $500 to $1,000 to pay for doctor's visits, there is no way to be certain that we would be paid back. SSA sends the claimant's portion directly to the claimant (by contrast in a personal injury claim, the insurance company sends the entire lump sum to the lawyer to deposit into escrow and disburse). Lawyers cannot afford to spend $500 to $1,000 to send clients to doctors since the risk of not getting paid back is too great. This is the reality of the SSD business.
Do you take cases involving malpractices? For example' My 21 year old niece is kept too long in the hospital in Georgia against her will and they feed her meds that's doing more harm to her well-being than good. The mother of my niece is very frustrated and stressed with trying to find somebody especially an attorney/lawyer to really help resolve the situation. Also her mother is worried that my niece might die in the hospital from the meds.
I am curious why an attorney would take my case, sign a contract with me, spend hours going over my medical records, then 2 weeks before the hearing he tells me that he didn't think I had a great case so I fired him and went to the hearing alone. I am just disgusted with this. I was furious because at our first meeting he acted like I had a great case but then as the hearing got closer he said he would get my medical records but DID NOT, I tried to talk to him about all of the medical problems I have and all the places where I regularly treat and he didn't care to listen. I decided to go to the hearing alone. It's been a few months and my case is still pending but am very curious why an attorney would do this? Thank you.
Bobbi, I can't speak to your situation because I don't have the file in front of me. I can tell you that sometimes an attorney will take a case thinking that the medical record will develop a certain way, but it doesn't. Perhaps there was a big gap in medical treatment, or records suggesting that the condition was not serious. Or a closer review of the medical record includes references to drug seeking behavior or malingering. Or, as may be the case here, the lawyer did not develop the file and realized that he wasn't go win and he bailed.

It wasn't due to lack of medical records because I've been treating for a very long time and on a regular basis. I see many specialist doctors too. In any given month, I'm going to a Dr. Appt about 5 times a month. I was diagnosed with Fibromyalgia in 2011 and have gone through a clinical program for that twice. I was also diagnosed with anxiety, major depressive disorder, severe insomnia, high blood pressure, a left adrenal gland adenoma, IBS, hammertoes, plantar fasciitis, diabetes, and diabetic neuropathy. The guy misplaced my file 2 or 3 times and he was always blaming his secretary. He never bothered to get my medical records and he didn't listen to me when I tried explainining everything that I'm in treatment for. I just felt he was a terrible attorney and he was passing judgment without hearing the facts but I wanted to get your perspective. Thank you.
I'm 40 yrs old. Type 1 diabetic since I was 6 months old. Diagnosed with major depression at 14 with several psychiactric inpatient stays. Later diagnosed with bipolar and anxiety. In my late teen years I was diagnosed with peripheral neuropathy in hands and legs, prolific retinopathy, and gastroparesis. I was on SSI from childhood until age 35 when they decided I was improved enough to work even though all of my conditions worsen with time. I have an extensive medical record up until 2 years ago when I lost medicaid. I'm begging family members for insulin money now. I've reapplied for ssi but It's so discouraging! I have an 8th grade education and feel hopelessly lost in the process. I've found a free clinic but the wait time is long...What else can I do to help my case?
I would definitely pursue treatment at the free clinic despite the wait. I would also keep a daily diary about your symptoms. Finally this might be a case where unsuccessful work attempts might be good evidence to show that you would have reliability problems. Attempting to work would also show SSA that you are trying to work despite some serious medical problems.

Migraine cases are tough because your doctors can only rely on what you report. If you have strong medical support you can win but your doctor really needs to be on board.
Can a case be won for a 57 yr old divorced female with fibromyalgia. I've been a professional pet groomer for years and now find my body can't do it as there is much standing bending lifting and getting bit. I'm also divorced from a disabled person that has MS. I suffered an acute stroke in March. I filed for disability this past August. I didn't walk on my own for 3 months. I still can't lift anything over 20 pounds. Can't talk clearly and can't write. Is my case strong?
I have had a couple SI joint cases over the years. The question boils down to three things: (1) do objective studies (MRI, CT) document a severe level of dysfunction; (2) are you no longer a surgical candidate and basically left with pain management; (3) wlil a treating doctor go on record to say that your level of pain and lack of mobility would preclude 8 hours of work like activity? The diagnosis is important but the functional limitations are more important.

Medical was why random cases were denied. Only not taxes. I filed no imaginary number. Self employed my 1099 just went to lone Star legal aid. Over 25000 the year is not from adolescent it's one call. Social anxiety and depression is not denied work credits are filed with the IRS.my proof . I wrote my taxes out and sent them the same way to the ssa. Proving something isn't the quality of it. Accurate 1099 no taxes are taken out of it. Don't write payroll down.
If a person has cervical spinal stenosis 3 places and disk desiccation in 2 places causes mild to severe pain most days, but quit working , has only MRI and technical breakdown sheet and cannot afford to see a doctor, win a case ?

(I realize I'm replying to a year old comment, but this is my spiel based on my experience as an SSI recipient.) It depends, but if you were just in suspension, then you have a solid chance of going back on. Suspension means that you're not receiving the benefits for the time being due to income being above a certain level or something but you are eligible to receive them at a later time unless ruled ineligible in a redetermination. Going into suspension on SSD does make a redetermination more likely to happen faster. A redetermination is something you would be notified about and you'd have the chance to make your case.
What if you have severe visual impairments and you only have to go to the doctor once a year for the last 30 years. And that's all you can to because there is no treatment options available for the impairments?
I think you could make the argument that your condition is permanent and that on-going "treatment" is a waste of money. If the record backs this up then I would agree that multiple doctor visits per year are not essential.
I have an attorney out of Durham NC she told me she wouldn't have taken my case if she didn't think I have a winnable case. That sounded good but I'm still nervous that I am in an uphill battle for about 2 to 3 years.
I agree with your lawyer's approach. Because of the long time frames involved I would not take a case unless I felt that there was a reasonable chance of winning.
Law firm I had did have a list of criteria I had to meet before taking my case. One other thing is can be a long process but don't constantly badger your attorney because of the waiting game. He has no control over it. I know of a person that had two attorneys drop him because of constant calls

Would you decline a multilevel Cervical Spondylosis case, compression fracture C-spine, if the person was injured say on Feb 11 but was not able to get checked let's say until March?
A short delay in getting a diagnosis would not be an issue for me. The real question - how do these injuries impact you on a day to day basis and in a potential simple work environment?
@@ssdattorney My straight simple answer is I'm affected daily that I have to carefully turn my head each way and I'm afraid of even the thoughts of a chiropractor so I'm on high dose Ibuprofen. I know this one outside of specific reason from the bar when they shouldn't. it's pretty much because they know its not a easy case where they can't get their money or more back as quickly. Lol although i get if its a non winnable case or the lawyer doesn't know how to win it, or you can't recouped your costs (which doesn't make since especially if you win since the civil courts guarantee the lawyer their pay.) But i get if those are the reasons. You wouldn't want a lawyer that couldn't win your case anyway so odds are its more in your favor. However mr.lawyer i'm surprised since courts claim to be science and half the stuff used by courts have a less than 50% accuracy or reality to them in terms of science. Makes me surprised you said the courts say men don't have nor get fiber mialgia but women do? That makes no sense their's hardly any type of injury or disease that effects only one gender especially diseases of that nature. Thats also the court saying that they are more experts on the subject than the doctor's and we know that's not true unless every single doctor says thats not possible which they don't since people are diagnosed with it of both genders.

Young people can be found disabled by SSA. However, in my experience younger claimants need more and stronger evidence as the SSD system assumes that younger people can bounce back more quickly and fully from health issues. There is also the economic reality that once someone is on disability the odds of that person returning to work are very small so SSA does not want decision makers to obligate the trust fund for 20 or 30 years.
Would you be more likely to take case if say the person paid you up front for some reason? Maybe they had been saving ( especially if they knew it may come to that. They may have OTHER income have someone help them pay or whatever to where there is not concern of not getting paid.
Not really. I work on 99% of my cases under a "no fee unless you win" contract whereby I am paid 25% of past due benefits with a cap of $6,000. Given the long delays, by the way, most lump sum payments exceed $24,000, which means that my effective percentage is less than 25%. The only time I work under a flat fee would be in a benefits termination case (no past due benefits) or a case where there are no past due benefits because of a workers comp or other offset but my client wants a determination of disability for the time when WC payments run out. If I think a case is marginal with a low likelihood of success, I am going to decline representation even if the person offered to pay up front.
If a person has a neck injury and it's a proven compression fracture, by x-ray, would you decline to take the case if he or she didn't go right away but as the pain got worse the person went the month after? If declined, is it in writing that a person must go immediately to get checked?
Mr. Ginsberg, if what you allude to about Obstructive and Restrictive Asthma ( doesn't hold merit or isn't a bonafide disease for the purpose of a meritorious and favorable disposition for the claimant ) is indeed fact then one might want to commit treason against the state for abandoning them as that is fighting words to anyone reasonable with said disease.
Angela, the diagnosis is not what I look at - the question I ask is whether you have a treating doctor who would go on record to say that you do not have the capacity to perform simple, entry level work because of your medical issues.
hi, I have had 4 ankle surgeries finally resulting in a total ankle fusion. along with bipolar and being 45 but with a college education do I have a honest chance? it's been over 3 years since able to work heck haven't been able to drive. any help pointing me in the right way would be great, I've been applying and am now at the point of waiting for my hearing within 9 months. I haven't when thru a lawyer yet but am considering it.
Debbie, I don't know that the college education part is going to hurt your chances - based on what you write, you would have trouble working because of pain and limited movement. I would definitely talk to a lawyer - your chances are much better at a hearing with representation. Best of luck to you.

If I was evaluating your file, I would look at the medical records to see how specific the diagnoses are and how long your condition has lasted, and I would ask you if one or more of your doctors would help by filling out a functional capacity evaluation.
Angie, the diagnosis is not nearly as important as evidence about the impact of your medical problems on your capacity to reliably perform a simple, entry-level job.

I was just denied 🙅♂️. I'm a 55 year old woman who has worked in the hospital for 25 years was terminated in August. I had total right knee replacement surgery in which my knee is slightly Bent so I couldn't do my job I'm a unit clerk in the intensive care unit for babies we do more cleaning than computer work. I am wondering what you thought about my case if it's worth pursuing. I walk with cane because I'm unstable but my dr in his notes says I seem to be on track. My knee will be like this forever it's healed but it pops and hurts still, had MRI of lower back but degenerated low back, have sleep apnea, anxiety, renal n spleen aneurysms,lil overweight going for GB in June. No, when a lawyer takes cases under a contingency fee that lawyer will only accept cases where there is a reasonable chance at winning. If you want to pay $300 per hour, I'm sure you could find many lawyers who would spend as much time with you as you wish.

I agree with you. Every attorney and judge are different. I had DDD on my lower back and anxiety and depression and over 50. My 1st local attorney I found from google refused to take my case said I was not sever enough. I went ahead and applied myself anyway at 51 after I exhausted my short term disability. Denied 1st time. Look for local attorney again randomly from a list I got from local SSA office. A local attorney took my case without much question. Went to hearing while this attorney more concentrated on my low back and physical issue and less on my anxiety and depression. After 6 month, got a denied letter. Appeal again. Attorney quit the law firm, another attorney in the same law firm took over my case. This attorney was more concentrated on my anxiety and depression and not much on my physical issue on this appeal. Judge approved my case without a hearing. I was 56. Overall, it took me 5 years, 3 lawyers and 2 judges. They are all very different.

Wow. Very lucky. I'm 44 and I have severe depression, schizophrenia, anxiety, PTSD, stage 4 osteoarthritis in both knees and it took me four years to get a denial from a hearing. And when I say I have depression, I don't mean the type of depression that pretty goth girls use for likes on Instagram. I used to do a large volume of Social Security cases, and I loved doing them. The trouble is that the judges on the cases got worse and worse in granting benefits, and the time lag to a hearing made it hard to justify the fees on the case helping to keep the lights on. I heard there is new legislation to increase the fee cap. But, until the problem of judges who feel that they have to deny every case to avoid being overruled is solved, I am not sure what will change.
Jeff, the approval rate is slowly heading back up. It was as low as 43%; in 2020 it was 49% which is encouraging.

Hello. I am having zero luck getting any attorney in Nashville, TN. to even talk to me about my case ( not disability-related).
I was fired after my ups truck rolled off silently into a mailbox after sitting fine for over 2 minutes.
Apparently, it broke out of park. I was told later my handbrake was loose.
This was my 12000th +/- delivery as a newer driver, I had never given parking a second thought, and certainly never knew my brake became loose.
I realized I had never undergone any training on the job other than a sup telling me to move faster for 3 days. We did not get trained out doing deliveries. I hadn't even had a sup watch me do a pre-trip inspection or ever demonstrate any methods of parking at a stop.
I contend that if they make this type of accident a terminatable offense in the contract ( cba - which we were never taught about), it should have to be documented that I was properly trained and I know for a fact that it's not documented with my signature.
At the very least, there should be an alarm for a major problem such as the parking gear not engaged so I have a chance to fix the problem.
Other drivers in other types of accidents many times more serious, get their jobs back. That is discrimination.
This is also entrapment in an unsafe work environment where I didn't have all of the knowledge of what could become loose that was up to me to check and tighten. This could have killed me or someone else.
They also owed me from a previous grievance that I won but never paid.
UPS wants bodies in trucks for $20 an hour, no CDL or on the job training and they simply don't care if someone dies.
There is not a shred of online training they provide for new drivers to keep learning at home.

Ryan you need to speak to an employment lawyer but Tennessee is an "employment at will" state (www.tennesseeemploymentlawcenter.com/employment_at_will.html) so my guess is that you would have an uphill battle. An employment lawyer in TN would be the correct resource for you.

During the midst of COVID I had an initial over the phone SSDI application process. However, the SSA down played my SSDI application and against my wishes process a SSI application. I appealed.

I know this video is several years old but I'm 36 and just had my 2nd back surgery in June 2018. First one was October 2013. Both were to save me from paralysis due to herniated disc pressing the S1 nerve root. I have Congenital Lumbar Spinal Stenosis, Degenerative Disc Disease, Foraminal Stenosis, Degenerative Arthritis, and Spondylolisthesis which is chronic. That is where the spine slips. I failed the nerve conduction test in 2013. I'm currently on my 3rd try for Social Security after being denied the first 2 times. They keep saying I don't have enough work hours. Well of course not. I've not been able to work for several years. Then they said not enough medical evidence. This time I've sent paperwork in showing MRI's, doctor visits, surgeries, emergency room visits, etc. I'm not sure if it's enough. I have 2 MRI's. One from 2013 and the current one from May 31, 2018. I can't sit or stand for long periods of time and still suffer pain. Is this something you can help with or am I wasting my time? Any advice is welcome.

I was 30 when I got a lawyer from another state that kept telling me I should wait another year every time my court hearings would come close to happening. I have a medical marijuana card and he stated they won't give me benefits because I'm a drug addict.then he wouldn't pull my humongous medical records dating back to a child because it said i had marijuana use on them. I called everywhere i have ever been seen to obtain my records on my own. I youtubed how to file documents with the court and proceeded to handle my case byyself. The last time he called to reschedule my court date I told him NO 👎. I want my court date and I will speak on my behalf. I have mixed bipolar ptsd anxiety that turned into agoraphobia and alot of other miscellaneous symptoms. I won my case by simply speaking up for myself and explaining my thoughts on why I needed benefits. I won my case and recieved a hefty amount from backpay that my "lawyer" didn't get a dime for. I think it's 2022 now and with enough research you can do anything you want without the need of some expensive lawyer who just sees you as a profit or a case number and not a human being. Disability Lawyers are just overrated scammers with a college degree in my opinion. Freedom of speech baby ✌️

Thanks for the video very helpful. Question: I heard you mention age being a factor Im 33yrs old and I had accident that shattered my hip completely, fracture 5 ribs and punctured a lung. I had surgery in June, about 4 days after the incident. About a week later i filed for SSD only to be denied 3mths later. Ive had a bad back since I was 12yrs old due to jumping a snow bank and missed it completely and landed on my chest kicking myself in the back of the head. I believe I was born with a over grown bone in my right knee.
Now my two questions:

Hi, I have to say that I am happy that one attorney is willing to tell his client(s) why they won't take his or her case. I am facing a hearing in unemployment where my benefits are being held. I can't get into the reason on-line, but when I stated my case to two firms, the attorneys refused to take the case and did not tell me why. One of the attorneys stated that if they told me why they refused to take my case, that would be giving me legal advice. Is this true? Can you direct me to an attorney in NYC that would take my case? Beryl, I suspect that some lawyers are hesitant to tell a potential client why he/she won't take a case because of the potential for negative online reviews. I have had that happen to me. However, I think that if someone takes the time to contact me, they deserve to know what I am thinking with the understanding that my decision not to take a case is not a determination on the merits and that it should not influence that person's efforts in seeking representation. Re the unemployment issue in NYC, I don't know anyone there who does that type of work so unfortunately I can't help.

Why does lawyers not help by sending client to doctors to help with their case? For instance if a person can't afford insurance or doesn't have a doctor? How much does it help your case if you go to the emergency room?
Fair question, Eddie - and here is the truthful answer: it has to do with money. Lawyers in SSD claims are paid 25% of past due benefits with a cap of $6,000. This $6,000 cap has not been increased by SSA in over 10 years, although support staff salaries and office overhead continues to go up. Further, approval rates are down. For most lawyers, the average fee for successful cases comes in at around $4,000. And we get nothing for our two to three years' of work if the judge does not approve. Finally, if a lawyer does advance $500 to $1,000 to pay for doctor's visits, there is no way to be certain that we would be paid back. SSA sends the claimant's portion directly to the claimant (by contrast in a personal injury claim, the insurance company sends the entire lump sum to the lawyer to deposit into escrow and disburse). Lawyers cannot afford to spend $500 to $1,000 to send clients to doctors since the risk of not getting paid back is too great. This is the reality of the SSD business.
Do you take cases involving malpractices? For example' My 21 year old niece is kept too long in the hospital in Georgia against her will and they feed her meds that's doing more harm to her well-being than good. The mother of my niece is very frustrated and stressed with trying to find somebody especially an attorney/lawyer to really help resolve the situation. Also her mother is worried that my niece might die in the hospital from the meds.

I am curious why an attorney would take my case, sign a contract with me, spend hours going over my medical records, then 2 weeks before the hearing he tells me that he didn't think I had a great case so I fired him and went to the hearing alone. I am just disgusted with this. I was furious because at our first meeting he acted like I had a great case but then as the hearing got closer he said he would get my medical records but DID NOT, I tried to talk to him about all of the medical problems I have and all the places where I regularly treat and he didn't care to listen. I decided to go to the hearing alone. It's been a few months and my case is still pending but am very curious why an attorney would do this? Thank you.
Bobbi, I can't speak to your situation because I don't have the file in front of me. I can tell you that sometimes an attorney will take a case thinking that the medical record will develop a certain way, but it doesn't. Perhaps there was a big gap in medical treatment, or records suggesting that the condition was not serious. Or a closer review of the medical record includes references to drug seeking behavior or malingering. Or, as may be the case here, the lawyer did not develop the file and realized that he wasn't go win and he bailed.

It wasn't due to lack of medical records because I've been treating for a very long time and on a regular basis. I see many specialist doctors too. In any given month, I'm going to a Dr. Appt about 5 times a month. I was diagnosed with Fibromyalgia in 2011 and have gone through a clinical program for that twice. I was also diagnosed with anxiety, major depressive disorder, severe insomnia, high blood pressure, a left adrenal gland adenoma, IBS, hammertoes, plantar fasciitis, diabetes, and diabetic neuropathy. The guy misplaced my file 2 or 3 times and he was always blaming his secretary. He never bothered to get my medical records and he didn't listen to me when I tried explainining everything that I'm in treatment for. I just felt he was a terrible attorney and he was passing judgment without hearing the facts but I wanted to get your perspective. Thank you.
I'm 40 yrs old. Type 1 diabetic since I was 6 months old. Diagnosed with major depression at 14 with several psychiactric inpatient stays. Later diagnosed with bipolar and anxiety. In my late teen years I was diagnosed with peripheral neuropathy in hands and legs, prolific retinopathy, and gastroparesis. I was on SSI from childhood until age 35 when they decided I was improved enough to work even though all of my conditions worsen with time. I have an extensive medical record up until 2 years ago when I lost medicaid. I'm begging family members for insulin money now. I've reapplied for ssi but It's so discouraging! I have an 8th grade education and feel hopelessly lost in the process. I've found a free clinic but the wait time is long...What else can I do to help my case?
I would definitely pursue treatment at the free clinic despite the wait. I would also keep a daily diary about your symptoms. Finally this might be a case where unsuccessful work attempts might be good evidence to show that you would have reliability problems. Attempting to work would also show SSA that you are trying to work despite some serious medical problems.

Migraine cases are tough because your doctors can only rely on what you report. If you have strong medical support you can win but your doctor really needs to be on board.
Can a case be won for a 57 yr old divorced female with fibromyalgia. I've been a professional pet groomer for years and now find my body can't do it as there is much standing bending lifting and getting bit. I'm also divorced from a disabled person that has MS. I lost my hearing with schizoaffective disorder with no lawyer and had to do a new application and lost the beginning phase again my schizoaffective was never brought up every time. Its always anxiety when I wasn't diagnosed with anxiety
A lawyer might be of benefit to you. Otherwise, you need to confirm that your medical record discusses your schizoaffective disorder extensively.

I have had a couple SI joint cases over the years. The question boils down to three things: (1) do objective studies (MRI, CT) document a severe level of dysfunction; (2) are you no longer a surgical candidate and basically left with pain management; (3) wlil a treating doctor go on record to say that your level of pain and lack of mobility would preclude 8 hours of work like activity? The diagnosis is important but the functional limitations are more important.

Medical was why random cases were denied. Only not taxes. I filed no imaginary number. Self employed my 1099 just went to lone Star legal aid. Over 25000 the year is not from adolescent it's one call. Social anxiety and depression is not denied work credits are filed with the IRS.my proof . I wrote my taxes out and sent them the same way to the ssa. Proving something isn't the quality of it. Accurate 1099 no taxes are taken out of it. Don't write payroll down.

(I realize I'm replying to a year old comment, but this is my spiel based on my experience as an SSI recipient.)
It depends, but if you were just in suspension, then you have a solid chance of going back on. Suspension means that you're not receiving the benefits for the time being due to income being above a certain level or something but you are eligible to receive them at a later time unless ruled ineligible in a redetermination. Going into suspension on SSD does make a redetermination more likely to happen faster. A redetermination is something you would be notified about and you'd have the chance to make your case.
What if you have severe visual impairments and you only have to go to the doctor once a year for the last 30 years. And that's all you can to because there is no treatment options available for the impairments?
I think you could make the argument that your condition is permanent and that on-going "treatment" is a waste of money. If the record backs this up then I would agree that multiple doctor visits per year are not essential.
I have an attorney out of Durham NC she told me she wouldn't have taken my case if she didn't think I have a winnable case. That sounded good but I'm still nervous that I am in an uphill battle for about 2 to 3 years.
I agree with your lawyer's approach. Because of the long time frames involved I would not take a case unless I felt that there was a reasonable chance of winning.
Law firm I had did have a list of criteria I had to meet before taking my case. One other thing is can be a long process but don't constantly badger your attorney because of the waiting game. He has no control over it. I know of a person that had two attorneys drop him because of constant calls

I find that SSA rarely approves claimants in their 30's unless your condition is close to a life limited level.

I know this one outside of specific reason from the bar when they shouldn't. it's pretty much because they know its not a easy case where they can't get their money or more back as quickly. Or maybe never at all, yep just like i knew mostly plain old greed i'm a lawyer so i should get paid this much but only if its easy. That makes no sense their's hardly any type of injury or disease that effects only one gender especially diseases of that nature. Thats also the court saying that they are more experts on the subject than the doctor's and we know that's not true unless every single doctor says thats not possible which they don't since people are diagnosed with it of both genders.

Young people can be found disabled by SSA. However, in my experience younger claimants need more and stronger evidence as the SSD system assumes that younger people can bounce back more quickly and fully from health issues. There is also the economic reality that once someone is on disability the odds of that person returning to work are very small so SSA does not want decision makers to obligate the trust fund for 20 or 30 years.

Would you be more likely to take case if say the person paid you up front for some reason? Maybe they had been saving ( especially if they knew it may come to that. They may have OTHER income have someone help them pay or whatever to where there is not concern of not getting paid.
Not really. I work on 99% of my cases under a "no fee unless you win" contract whereby I am paid 25% of past due benefits with a cap of $6,000. Given the long delays, by the way, most lump sum payments exceed $24,000, which means that my effective percentage is less than 25%. The only time I work under a flat fee would be in a benefits termination case (no past due benefits) or a case where there are no past due benefits because of a workers comp or other offset but my client wants a determination of disability for the time when WC payments run out. If I think a case is marginal with a low likelihood of success, I am going to decline representation even if the person offered to pay up front.
If a person has a neck injury and it's a proven compression fracture, by x-ray, would you decline to take the case if he or she didn't go right away but as the pain got worse the person went the month after? If declined, is it in writing that a person must go immediately to get checked?
Mr. Ginsberg, if what you allude to about Obstructive and Restrictive Asthma ( doesn't hold merit or isn't a bonafide disease for the purpose of a meritorious and favorable disposition for the claimant ) is indeed fact then one might want to commit treason against the state for abandoning them as that is fighting words to anyone reasonable with said disease.

Angela, the diagnosis is not what I look at - the question I ask is whether you have a treating doctor who would go on record to say that you do not have the capacity to perform simple, entry level work because of your medical issues.

hi, I have had 4 ankle surgeries finally resulting in a total ankle fusion. along with bipolar and being 45 but with a college education do I have a honest chance? it's been over 3 years since able to work heck haven't been able to drive. any help pointing me in the right way would be great, I've been applying and am now at the point of waiting for my hearing within 9 months. I haven't when thru a lawyer yet but am considering it.
Debbie, I don't know that the college education part is going to hurt your chances - based on what you write, you would have trouble working because of pain and limited movement. I would definitely talk to a lawyer - your chances are much better at a hearing with representation. Best of luck to you.

If I was evaluating your file, I would look at the medical records to see how specific the diagnoses are and how long your condition has lasted, and I would ask you if one or more of your doctors would help by filling out a functional capacity evaluation.
