We were friends with another family who's home also burned down, and kids don't recover from that loss very well. The longer it takes to rebuild, the harder it is for the kids. We also don't know if any of the kids' pets were lost in the aftermath of the plane crash.... The longer the insurance company drags this out, the more cruel this is for the children. If we think it's bad for the mom, it's 10× worse for the kids.
The airfield elevation at Santa Fe is about 7200 feet so it's not so straightforward. Single engine performance in a light twin at that height isn't what it its at sea level. It's survivable but not if you compromise the climb performance by turning. Density altitude is a killer.

If you have a putt putt twin like 310, or _any_ aircraft that has radically asymmetrical thrust on one engine and you do not practice flying what would be difficult and arduous training, then you have not taught yourself the skill and there is no advantage to having a second engine whatsoever! In fact it provides a false sense of security. One turn into that dead engine and everything dies and what a way to find out, when your life depends on it.
Knew a dentist where I used to live. He killed one of his twin daughters and their family dog in a plane crash. It was foggy as hell, but he just had to get home. Dumped it in the water. After insurance paid out, he got another plane.
And again we learn the lesson that just because you have enough money to buy an airplane doesn’t necessarily mean you should become a pilot. The cemeteries are full of people who had more money than sense.
I worked with a surgeon who had crashed two planes. Those who worked with him said it's a matter of time before number three happens. They said don't fly with him. I was a short term contract tech at the hospital.

He exhibited contempt for the rules and regularly defied him. I once had to send by courier required documents when deliberately left them in the rain out the hanger at the club he was a member at. I once told him that he was going to have an accident if he continued to act irresponsibly. Pilot error is pilot error no matter how you slice it and to fly an aircraft infrequently without keeping up with emergency procedures is sad but inevitable. I have the highest regard for any professional who makes it a point not to neglect essential recurring training. The NTSB has numerous accident reports about professionals flying aircraft that exceed their ability to operate them. Yes, the guy died, but that does negate the lesson that others should learn from. I am an ATPL pilot with a certified flight instructor rating and I have seen quite a bit in my career.

He tried the “impossible turn” and went the wrong direction (towards the dead engine) and dumped it into her house. Sad stuff but fly it straight and re configure.

I glad her 2 children were not in the home. Our home was damaged 6-7 years ago by a hurricane. We contacted our insurance company that we had used for 25+ years without ever making a claim. They did the same to us, low balling on the repairs and then dropping us completely. We had to hire an attorney to file a lawsuit to get paid correctly. The thing about piston twin engine planes during engine failure you lose 50 percent of the engines but you lose 70 to 90 percent of your climb power and have added drag. All procedures need to be done to climb.

I have said it for years. The only good insurance is the insurance you never have to claim on because otherwise, they will try to screw you out of paying. I saw it growing up with my dad, a doctor, and he had to sue them to make them pay the bill the doctor bills after they would try to reduce what they paid when everything cleared. Really ends up being a claim on homeowner's insurance or business insurance (perhaps if he was claiming this was a work-related vehicle). The airplane insurance, too. I am no lawyer or business expert, but I couldn't see this having to go beyond any one or all related insurance companies rather than actual estate cash. Besides, grieving is no excuse for not making this woman whole in the first place considering their own loved one did this, and it is only involving a few hundred thousand dollars. Guaranteed, the family members received or stand to receive millions in life insurance alone. There is a lot beyond that in the estate as well.
Piloting an airplane isn't for every body. Just because you can buy one don't mean you can handle it! A dear friend of mine went out and bought a helicopter, but he had the sense to realize that he wasn't up to the challenge of flying it. So he hired a professional pilot and also out sourced the maintenance by an approved ser ice company. He flew many years like that and is still alive!
I would have flown straight out from the runway and just landed in a glide pattern with both wing tips even so neither hits the ground causing a tumble. In this case, everyone gets investigated from the flight school who trained the pilot, to the tower's flight controller. Probably the insurance company is waiting for a full FAA report, but that's cruel. Everyone just dragging their asses. This family needs a home.
It is not illegal for insurance companies to try and get out of the contractual obligations. The key term here is “try” they can try and do, in a court of law they may be ordered to pay but they will not be persecuted for “attempting” to get out of the legal obligation. I think it is so expected that it is excepted, that this is what you must do, take them to court, not all states will allow in a settlement for attorney fees and the insurance companies take advantage of that.
The pilot was at fault, in essence he committed a property crime and his family should have to pick up the pieces sorry. His lost life was his own fault…..

How about some details? Exactly what is going on? As an insurance professional, I would help that she has a homeowners policy on her house and that would take over paid for replacement cost for the building and then chase down the aircraft insurance. Absent her own homeowners, what offer did the aircraft insurance company provide her? Are they off by $10,000 or $200,000?

Seems like a request needs to be made for the Judge to make a decision based on the evidence... you know, using the same power they utilize to let criminals go free and punish those guilty of nothing. The facors associated with the crash and the pilot are of no relavance. As with any vehicle hitting a residential structure, the operator of the vehicle is respondsible, even if they died of a heart attack behind the wheel before impact. I'm guessing someone is dragging their feet in an effort to redirect funds in relation the the Estate, as to prevent and or minimize the payout; classic Deny, Dely, Defend!
Could have landed it in the dirt, on some of them roads, on the paved roads , and made bad choices, That little plane with a half way decent pilot would have had little trouble doing so! Pilots are taught that making a turn when you're in an engine/s failure glide is to be avoided! The homeowner lost everything, including priceless treasured baby photographs and videos, documents, clothes, furniture, etc, which make up a family home. The insurance company owes the victim a duty of care to settle as swiftly as possible, and to do so with a credible offer. Its unacceptable to have strung this out for over a year, stressing the family as insulting low offers are made. Shame on the insurance company.

We pilots pay HUGE amounts for insurance they should pay. SUE them for all the time without a home too. Doctors are the WORST pilots as they believe they don’t need to follow the rules everyone else has to. I became a commercial pilot 40 years ago and one of the first things they teach is not to do the “Impossible turn” that he attempted. Lots of open space there.
So lemme do some quick maths here: The insurance company doesn't want to spend the money to make a phone call and get the nearest place that sells double or triple wide manufactured homes to send over and install a home for her, and write her a check for the contents, but they DO want to spend the money to defend themselves against a law suit, pay a hugely increased amount for her legal bills, and her legit pain-and-suffering claim, and then still have to buy her a new home.
She should have just claimed it on her homeowner's insurance, (If she had any) and let the insurance companies fight it out. That would have made her whole again but doesn't work if she is holding out for a big payout.
FYI Arizona is a "pro-business" state. And Insurance companies #1 practice to maintain profitability is denying coverage, that's why this is happeneing.

Training for emergencies is poor at best because every pilot knows they are safe, it should mean instant suspension of licence for even a minor incident and loss if the pilot does not complete requalification in 90 days.
You have to as part of the process. If you don’t, you don’t have a claim on anyone else either. You have to sue everyone involved or you can’t sue anyone involved. Seems like a waste but that’s what the courts require.

Really ends up being a claim on homeowner's insurance or business insurance (perhaps if he was claiming this was a work-related vehicle). The airplane insurance, too. I am no lawyer or business expert, but I couldn't see this having to go beyond any one or all related insurance companies rather than actual estate cash. Besides, grieving is no excuse for not making this woman whole in the first place considering their own loved one did this, and it is only involving a few hundred thousand dollars. Guaranteed, the family members received or stand to receive millions in life insurance alone. There is a lot beyond that in the estate as well.
Piloting an airplane isn't for every body. Just because you can buy one don't mean you can handle it! A dear friend of mine went out and bought a helicopter, but he had the sense to realize that he wasn't up to the challenge of flying it. So he hired a professional pilot and also out sourced the maintenance by an approved ser ice company. He flew many years like that and is still alive!

I would have flown straight out from the runway and just landed in a glide pattern with both wing tips even so neither hits the ground causing a tumble. In this case, everyone gets investigated from the flight school who trained the pilot, to the tower's flight controller. Probably the insurance company is waiting for a full FAA report, but that's cruel. Everyone just dragging their asses. This family needs a home.

It is not illegal for insurance companies to try and get out of the contractual obligations. The key term here is “try” they can try and do, in a court of law they may be ordered to pay but they will not be persecuted for “attempting” to get out of the legal obligation. I think it is so expected that it is excepted, that this is what you must do, take them to court, not all states will allow in a settlement for attorney fees and the insurance companies take advantage of that.

It's sad that they need a lawsuit to settle this claim. It seems rather obvious and clear cut the amount of damages in this case. It looks like a double-wide manufactured home. Just replace the house, the truck, a fair amount for the contents and she would be mostly made whole.

As an insurance professional, I would help that she has a homeowners policy on her house and that would take over paid for replacement cost for the building and then chase down the aircraft insurance. Absent her own homeowners, what offer did the aircraft insurance company provide her? Are they off by $10,000 or $200,000?

Seems like a request needs to be made for the Judge to make a decision based on the evidence... you know, using the same power they utilize to let criminals go free and punish those guilty of nothing. The facors associated with the crash and the pilot are of no relavance. As with any vehicle hitting a residential structure, the operator of the vehicle is respondsible, even if they died of a heart attack behind the wheel before impact. I'm guessing someone is dragging their feet in an effort to redirect funds in relation the the Estate, as to prevent and or minimize the payout; classic Deny, Dely, Defend!

He picks a house to land in , he totally lost control of that aircraft. Your not suppose to just let it fall out of the sky. The homeowner lost everything, including priceless treasured baby photographs and videos, documents, clothes, furniture, etc, which make up a family home.
The insurance company owes the victim a duty of care to settle as swiftly as possible, and to do so with a credible offer.

We pilots pay HUGE amounts for insurance they should pay. SUE them for all the time without a home too. Doctors are the WORST pilots as they believe they don’t need to follow the rules everyone else has to. I became a commercial pilot 40 years ago and one of the first things they teach is not to do the “Impossible turn” that he attempted. Lots of open space there.

So lemme do some quick maths here: The insurance company doesn't want to spend the money to make a phone call and get the nearest place that sells double or triple wide manufactured homes to send over and install a home for her, and write her a check for the contents, but they DO want to spend the money to defend themselves against a law suit, pay a hugely increased amount for her legal bills, and her legit pain-and-suffering claim, and then still have to buy her a new home.

Ok, yes the insurance should pay to rebuild her home and replace the things lost while covering her housing till the home is rebuilt. HOWEVER, this attorney saying the pilot should done all these different things like gain altitude and this or that makes no sense. The beginning of the report said engine failure, how the hell are you going to gain altitude when your engines are failing? Seriously unless this guy had a record of reckless flying or drugs or alcohol in his system when he crashed then this is a joke of an attorney. Next is WHY should the pilot who died’s family “reach out” to her? If someone in her family died in the house, then sure they should I guess, but they are the ones who lost a husband, father, grandfather? (maybe). They grieving also as they actually lost someone. Lastly I get the “news” needed a puff piece but a 5 minute “report” and interviews with sad mournful music playing in the background? Idk seems like putting your finger on the scales to me. Don’t get me wrong it horrible situation where two families lost someone or things important to them and it’s a tragedy for someone to lose the dad and husband but also for the family that lost photos and heirlooms or whatever when it burned down. I feel for them both and it’s something that should not happen. The insurance company should pay out whatever her costs are like I said up on top but the reason insurance companies don’t is because they’ve been scammed so many times in the past and sued for big settlements because they’re the evil mysterious DEEP POCKETS insurance company and in turn they’ve created policies where they have to conserve the amount of payouts, yes that’s wrong and yes someone shouldn’t need to sue the company to get a reasonable and realistic pay out. Funny thing is what is her insurance company doing? Why didn’t they cover her loss and then settle with the pilot’s insurance? Didn’t she own the house? If she did she’d have been required to have insurance and if she was renting (then what does it matter if the place hasn’t been rebuilt because it’s not hers) she should’ve had renters insurance or the owner would’ve or should’ve have insurance either way there are two to three insurance companies that should’ve settled this long ago.
The pilots airplane insurance could probably be sued by the home owners insurance. This woman lost a material thing that can be replaced. The pilot's wife and family lost their husband, father and child. He cannot be replaced. Come on! My wife and I lost a house with everything in it. It was sad. It took us a while to get our feet on the ground, but with help from churches, neighbors, family and a half decent insurance policy, we started over. We didn't lose a person.
I've got $100 says a family attorney told the pilots family not to reach out to this woman because it appears as an admission of guilt and they'll sue you. It's a self fulfilling prophecy every time.
Training for emergencies is poor at best because every pilot knows they are safe, it should mean instant suspension of licence for even a minor incident and loss if the pilot does not complete requalification in 90 days.

You have to as part of the process. If you don’t, you don’t have a claim on anyone else either. You have to sue everyone involved or you can’t sue anyone involved. Seems like a waste but that’s what the courts require.
