  • The RAF CEO, Collins Letsoalo, discusses the R1.2 billion in duplicate payments to lawyers, inequities in compensation for public passengers, and systemic issues within the legal profession.
[00:00]The CEO of the Road Accident Fund reveals 1.2 billion worth of duplicate payments to lawyers.-
    - Lawyers were charging five times more than medical aids for photocopies.
    - Public passengers and taxi commuters had a limit of 25,000.
    - The CEO stands firm on allegations against the legal fraternity.
[18:28] The CEO discusses the inequity in the compensation system for public passengers in South Africa. The majority of South Africans, who don't own cars, are limited to claiming only 25,000 in compensation.
    - The speaker questions the fairness of wealthier individuals being able to claim more than those in need.
    - Public passenger liability insurance was introduced in 2008 to insure passengers in public vehicles.
    - Before 2008, public passengers were limited to claiming 25,000 until the restriction was removed.
[36:56] The CEO discusses the need for the Road Accident Fund to reduce administrative costs and avoid unnecessary litigation.- Emphasizes the importance of directing funds towards claimants rather than administrative expenses.
    - Questions the necessity of litigation when most claims are settled out of court.
    - Raises concerns about potential corruption within the legal system, citing examples of judges involved in unethical practices.
[55:25 Discussion about making upfront payments and practical examples of payments in the context of investigations and agreements.- Mention of making upfront payments to get by initially.
    - Explanation of practical examples of payments over 20-40 years.
    - Reference to a provision (possibly section 174) allowing instalment payments for loss of support or earnings.
    - Issue with lawyers wanting full payment upfront, impacting the time taken for claim payouts.
[01:13:55] Delay in processing claims at RAF due to lawyers taking their time, resulting in valid claims being delayed by 60 days.-
    - Lawyers sometimes delay processing claims by putting paperwork on a shelf for up to 3 years.
    - Once the paperwork is finally processed and sent if it arrives 60 days after the incident, the claim is considered valid.
    - RAF aims to address backlog claims efficiently by introducing preassessment for incomplete submissions.
[01:32:21] Discussion about implementing administrative decisions until reviewed and set aside in law.-
    - Explanation of not cancelling a panel but stating it was not needed anymore.
    - Reference to being taken to court by panel members under section 34 of the Constitution.
    - Accusations made and the aim to keep the issue ongoing discussed.
[01:50:53] Discussion about discrepancies in judgment and suspicions of foul play.- Discrepancy noted in page numbers and content of the judgment.
    - Lawyers express concerns and seek to amend the order through Rule 42.
The judge denies live appeal and lawyers apply for a variation of the order.
[02:09:22] The CEO discusses receiving emails on private matters, legal issues, and concerns about judgments being sent to journalists.- The CEO expresses concern about private matters being sent to his private email.
    - Discussion about typos in judgments and Zelda Fender knowing before him.
    - Questioning the benefit of judges sending judgments to journalists.
    - CEO facing accusations of contempt and personal court orders.

As an Actuarial Student, I found this interesting, I used to argue that taxis, buses, etc must pay insurance to cover their passengers then in the case of an accident the RAF must become the Reinsurer just incase the claim amount is very huge and there is a limit on it. I am surprised to know that that's actually the case, however the private sector does not seem to want to play their role and the burden seems to be laying on RAF. The private sector always wants to make themselves appear competent, but they are actually very often incompetent and shielding themselves by the state resources.

If only the RAF could actually do their job effectively, there would be no need for attorneys.
Some people fail to realise that professionals don't become professionals overnight.
They study and do training which takes years and costs money.
It's because of the years of hard work that they have invested they are then able to complete a task effectively.
Attorneys secure higher claims for injured claimants, and they accordingly need to be remunerated.
The attorney practically works for free for many years and has to invest their own money to see the claim through to finalisation.
The RAF employees earn well and are financially secure for the duration that the claim drags. Hence, they have no interest in speeding up the matters.

    • @Gaofenngwe_Dire
      @Gaofenngwe_Dire 19 дней назад +4

Agents of RAF are not in the wrong here; attorneys are in every respect.
To be fair, issues of such nature, attended to by whomever (be it an attorney or any competent person) should be done so on a pro-rata basis, given the sensitivity of the issue.
Attorneys in South Africa have made it a custom to enrich themselves, by taking advantage of the administrative process of RAF; whilst the taking of such advantage is not wrong in itself, It becomes unjustifiable if it happens at the expense of the claimant.
NB: Let all professionals benefit as they ought to benefit, but when the benefit starts to argue injustice, it is the benefit that has to be sacrificed at all cost.

It's limited to the lesser of 25% or actual legal fees incurred whichever is lower. Sometimes we complicate the explanations that is how lawyers operate or how the law was setup. If processes are explained in all local languages and everywhere, i.e. social media and preferably local radio stations. This will reduce the cost tremendously

It was a masterclass itself, it would have been nice if you host Mthunzi Mdwaba after this show because I'm really suspecting that they are twins with Mr Collins😁😊. They carry black excellence very well this people ❤️🖤. I love their attitude towards challenges!

The state attorney system is definitely the way to go and will lower costs!
Also changing the payments from lumpsums to annuities is actually a smart idea but there may be a need to pay some lumpsum to cover the initial costs e.g. a person who can't walk no more now needs a wheelchair friendly home. This will also create more business for financial advisors and insurers. Great opportunity for gov to create more black insurance companies and hopefully reduce unemployment.

You can handle your own legal affairs. I had to do it and the Magistrates Office may send you to Legal Aid if you struggle. As for the Public Passenger Fund, it pays for claims against the Taxi Driver, not against RAF.

Having the right person heading an organization is one of the key things the state needs to get right. The reforms being discussed here are monumental and take full review of the South Africa we currently live in. We are one of the most unequal societies in the world but it cant be that institutions of government continue to promote this inequality. These reforms are not just about dignity to the ordinary citizen but truly making an impact to the vision of freedom in the broadest sense.

The institution will punish if you fight it. See what happened to Busisiwe, Zuma, him and many others. In everything you do don't challenge the institution ran by the private sector, you will pay a heavy price

Mr Letsoalo must also be recommended for Department of Labour ( UIF to be specific). The Labour department is become useless for South African Workforce and this economy. He must start at UIF, transforming it because the fund has become irelavant for people it must benefit. Then must move and shakeup the CCMA including all bargaining councils.
