Off Duty Cop Arrests Neighbor After Arguing with Boyfriend

  • Full police report:
    “I Officer Jacob R. was dispatched to an address in Carrabelle, Florida in reference to a verbal disturbance. The complainant was the wife of Deputy Toni Raffield who stated her neighbors were arguing and Deputy Raffield was going to see what the problem was. Upon my arrival I made contact with Deputy Raffield who stated individuals that were renting out the house next to his were in a verbal argument and he stood by until I arrived. I then made contact with Andrew who stated he and his girlfriend/ex-girlfriend Gerrilyn were at the bar and he decided to leave her there and go back to the air bnb. Andrew stated when he arrived at the air bnb Gerrilyn and another male drove up and Gerrilyn continued to argue wih him. Andrew did have a scratch on his left cheek that was lightly bleeding and scratch marks on his left forearm. Andrew refused to state if Gerrilyn physically assaulted him. I then spoke to Gerrilyn who was extremely irate with Andrew and was continuing to yell obscene things at him. I asked Gerrilyn if she had anywhere to go for the night in which she stated she wanted to get her dog and go stay with the male that drove her to the air bnb. As Deputy Hewitt and I were discussing the situation Gerrilyn, Andrew, Deputy Raffield, and the male that did not want to provide information were standing in the driveway of the residence. That is when Deputy Raffield witnessed Gerrilyn walk up to Andrew and kick him. Deputy Raffield then notified me of this and I advised Gerrilyn that she was going to be arrested got domestic battery. Gerrilyn continued to let out a barrage of obscene language towards Andrew and began walking towards him once again. It was at this point I lightly grabbed the tricep area of Gerrilyn’s right arm to help guide her towards my patrol vehicle. Gerrilyn then pulled her arm away from me so I grabbed her right wrist and she pulled away once again, this time Gerrilyn turned around towards me and grabbed my shirt and open hand slapped me on my right cheek. I then grabbed Gerrilyn by the hair on the crown of her head and pushed her back away from me. Due to Gerrilyn being so intoxicated she tripped and fell into the side of the truck that was in the drive way. Gerrilyn did not receive any injuries from this incident. While Gerrilyn was on the ground in a seated / kneeling position with my hand still on the crown of her head Deputy Jarred H. applied handcuffs and double locked them. Gerrilyn was then brought to my patrol car by Deputy Raffield and I and placed in the cage. While talking with Andrew again he stated that he did not want to pursue any charges. Andrew also refused to give any other information other than his name, phone number, and address. The male that Gerrilyn arrived to the air bnb with also stated he did not want to be a witness in the incident and did not wish to provide any personal information.”

    It's sad that men who are victims of domestic violence to this day are scared of pressing charges against their abusers.

      In Kansas, we were obligated to make an arrest for domestic battery. The state pressed charges. Getting victims to cooperate in court was a different story.

      It's the same for women by the way. That's why many jurisdiction don't require the victim to press charges in the case of domestic violence.

      not defending it lol. but not like shes hurting anyone lol. shes clearly in a mental health crisis. You also have clearly never experienced any assault charges done by men. Unless theyre multiple offenders theres usually no charges pressed or you get a plea deal. He literally grabbed her and started pulling her, hes OFF duty. The department probably knew this would be a technical mess, and chose to drop it to avoid POSSIBLE repercussions for the dept/off duty cop. I'm very knowledgeable on this kind of thing. I'm not picking sides only stating facts. Up until he grabbed her when she was walking away, it was an investigation on a fight between a boyfriend and girlfriend. No charges are being pushed unless the boyfriend ever stated he wanted to, unless some form of violence was actively seen by a witness, but as far as I can tell the off duty cop only HEARD fighting.

      ​@@WholeSomeHomie I'd have to review their department policies and state statutes to be certain, but I suspect its cause they responded off-duty in plainclothes, at a minimum. They may have had alcohol in their system from what they described on camera. Even if they were allowed to respond off-duty, it would be very easy for a defense attorney to poke holes in their story. Cause they were in plainclothes and someone could claim they didn't believe they were cops, were off duty and had no business responding to calls without proper gear, potentially under the influence of alcohol, and deputies using their power unjustly, (e.g. they were sick of past incidents and overcompensated) etc.

    I wish law enforcement would stop emasculating men who are victims of domestic violence! “Do you want to be a victim?” “You don’t have to be a victim” “You don’t have to press charges, if you don’t want to”. When the guy finally agrees to press charges, he basically talks him out of it. Choose your words wisely and do better! This is not the first time, I’ve seen law enforcement do this.       An off duty cop is not a cop. He should be in prison for attacking this woman, he could have snapped her neck when he threw her against the car. You can see that he likes to beat the weak and abuse power, even when he is a civilian.

She could have still gotten assault and battery probably but it wouldn't have been a felony like it is when it's an officer in his official capacity.

    Holy crazy. I learned long ago that if you start to date someone and you drink with them and their whole personality changes you HAVE to either have a talk with them and tell that you won't ever deal with that again or you break up with them. Or even ghost them if they were horrible like this chick. I actually had a GF slowly go alcoholic over 5 yrs. The last 6 months she did 4k damage to my car and 11k damage to my new truck at the time. She didn't remember doing either but it was her. I woke up with destroyed cars. Twice. And both times I was getting ready for work and looked out the bathroom window out front and saw the damage in the same exact way. Haha. Then I gave her an ultimatum, she didn't stick to it so one morning after I said i was going to work I waited for her to leave after me since she worked an hour later than I did then I went back to the house and had friends meet me and we packed all my shit, I took half the money we had shared, told her to text me my half of the final bills and why I was done and there was no way she could change my mind. I literally only saw her once to grab some mail and never again. I should have left the first time she smashed my car. Lesson learned. Or I should have left when she started to get sloppy almost every time she drank which was a good 4+ nights a week and every night some weeks. Lesson learned.

      Well the cop wrote a letter asking for it to be dropped.. Im sure she did something to make him change his mind.. Like write him a letter of apology or something like that.. The cop didnt seem to be a hard ass, So im sure he shrugged it off as she was just wasted and emotional as it most likely didnt hurt him in anyway.. Would have been different if she broke his jaw.

    What the heck, why did the off duty cop tell the boyfriend "you don't have to be a victim" after the guy said "yes I want to press charges"?? I've watched a plethora of these body cam videos and this is the first time I've heard it phrased as "do you want to be a victim?" rather than "do you want to press charges?" I don't get why men do this and then turn around and get mad that "women get away with everything."

And while that was an extremely kind thing to do, the fact that she was willing to assault a police officer means she has some big issues. So I hope she takes advantage of her 'free pass' and takes an anger management course, at the very least.

      Well, the answer to that is yes or no. Once he decided to take law enforcement action and she is aware that he’s a police officer, then yes it now qualifies as battery on a Leo. If at the time she hit him she did not know he was a cop, or he had not identified himself as a cop, then that charge would not apply

    Erm… As an attorney I just want to add that she actually has to KNOW that he is a LEO in order to be convicted of battery on a LEO. She apologized to both of them apparently to make it go away. I’m glad it did.

    1.) Off duty cops shouldn’t be considered cops.
    2.) Assault/battery on a cop should be the same punishment as assault/battery on anyone else.
    The “I am the law” bullshit needs to stop.

    To those ignorant and confused (Which is a large percentage of people on every police video)-
    An off duty police officer is off duty. That means they cannot detain someone for a misdemeanor. If you think they can, you’re just wrong.
    Furthermore, in general- Cops don’t have extra Rights.
    A cop off duty can legally detain someone who is in the process of committing a felony, but so can any citizen.
    An off duty cop is a regular citizen legally.
    The absolute ignorance in the comments of every single cop video is sad.

      In the USA, off duty police officers and sheriff deputies have the power to arrest, use force and even use deadly force. It gets a little blurry if they're outside of their jurisdiction. Most courts hold that, with a few exceptions, “an officer is always on duty.”

      I watch several police videos every day. At least 1/3 of the comments show absolute ignorance.
      The reason why it doesn’t vary State to State has to do with Constitutional powers.
      I meant- The charges were dropped for this exact reason.

    Assault on a police officer should be automatic jail time and can not be dropped. This is why we are losing LE. I bet if the prosecutor or judge got hit, the person would serve time. I am tired of this and when i go to the voting booth, I check records and vote accordingly. Vote these people out of office!! It’s the only thing they care about is getting elected and power.

      So to answer your question he arrived in a patrol car and is actively arresting her for battery against a civilian. I mean I guess wearing plainclothes means you're off-duty even though the police report in the description is from his perspective as an on-duty officer.

    They let her off with no charges probably because they watched the off duty cop, who you guys think is the boyfriend, start the force clear as day on the video and realized that they would get sued for pursuing anything. Certainly never seen two off duty cops handle everything while the on duty one stands back until the big guy starts to get too out of hand. And then the way that he asks if he's recording did not feel like he wanted yes as an answer. Gotta remember that the good ones feel obligated to help cover for the bad ones because of the career alone.
