    In this video, we review information about the asylum clock. When you have 150 days on your clock, you can apply for a work permit.
    How you check your clock depends on whether you are applying for asylum with immigration court or with USCIS. There are 2 different ways of applying for asylum: (1) if you have a case in immigration court, you can apply for asylum in immigration court OR (2) if you do NOT have a case in immigration court, you can apply with U.S. Citizenship and Immigration Services (USCIS).
    If you are not sure whether you are applying for asylum with immigration court or USCIS, please read this page to find out: help.asylumadvocacy.org/faqs-....
    Important: the immigration court hotline phone number (1-800-898-7180) will NOT work for people who are applying for asylum with USCIS! It is only for people who have cases in immigration court.

    Thank you for this insightful video. My question is this: I filed my asylum application with the USCIS, can I apply for Initial work permit if my asylum clock is more than 180 days but I've not been scheduled for my asylum interview yet?

    • @asylumadvocacy
      @asylumadvocacy  Год назад

      Thank you for your question and for being part of ASAP’s community! Yes, you can apply for a work permit once your asylum clock has 180 days even if you have not yet been scheduled for an asylum interview. Whether or not you have been scheduled for an asylum interview does not impact your eligibility for a work permit. You can read more about the work permit eligibility rules here: help.asylumadvocacy.org/work-permits/#current-rules. Thank you for your question and for being part of ASAP’s community! If you submitted your asylum application to USCIS, you can check your receipt notice (help.asylumadvocacy.org/work-permit-receipt-notice/) for the date that your asylum application was received. Then, add 150 days to find out when you can apply for a work permit. You can find more information about the asylum clock here: help.asylumadvocacy.org/work-permits/#apply-when.

      Thank you for your question and for being part of ASAP’s community! First, if you know your A Number, you should check your case status by by calling the court hotline at 1-800-898-7180 or by entering your A Number on this website (acis.eoir.justice.gov/en/). If your information appears in the system, you should submit your asylum application to the court that is listed in the system. If your information does not appear in the system, you can submit your asylum application (Form I-589) to USCIS. Hello! in an envelope, I sent my application for asylum to the court as well as a request to change my address because I changed state. ' state where I am, it will affect the clock for my request for a work permit?Thank

    • @asylumadvocacy
      @asylumadvocacy  Год назад

      Thank you for your question and for being part of ASAP’s community! Changing your address by submitting Form EOIR-33 will not affect your clock. However, if you moved far away from your immigration court, and you requested to change your immigration court to one that is closer to you (by submitting a Motion to Change Venue), that may affect your clock. If it has been less than 180 days since you submitted your asylum application and you submit a Motion to Change Venue, the judge will probably stop your asylum clock. You can find more information about what actions affect your asylum clock here: help.asylumadvocacy.org/work-permits/#problems-clock.

    I called the court number to find out about my watch, the watch says 180 days and the clock doesn't go why, what's the reason? Does the clock report go in descending or ascending order?

    • @asylumadvocacy
      @asylumadvocacy  Год назад

      Thank you for your question and for being part of ASAP’s community! The asylum clock moves in ascending order. Sometimes, the immigration court stops the asylum clock for certain reasons, and other times, the immigration court stops the clock by mistake. You can read more about the reasons why the immigration stops an asylum clock and what to do if you believe your asylum clock was stopped by mistake here: help.asylumadvocacy.org/work-permits/#problems-clock. Thank you for your question and for being part of the ASAP community! I understand from your comment that you have 150 days on your asylum clock. If that is correct, in general, asylum seekers can request an initial work permit 150 days after submitting their asylum application (Form I-589). Asylum seekers can receive the work permit 180 days after filing their asylum applications.You can read more information about how to apply for a work permit here: help.asylumadvocacy.org/work-permits/#current-rules. f you have specific questions about work permits, you are welcome to email us at info@asylumadvocacy.org. I had a biometrics notice that I did not know as my landlord saved it. It has been almost three months and she gave it to me. I was shocked!! I came to the appointment office directly and told them about why I was late. I was allowed to have the biometrics on the same day. It was done. Now, I am confused whether my clock stopped or not. My current case status: "The Next Step is Interview". Does it mean that the clock or days are okay? Should I file the work permit now as it has been 150 days from my asylum application date? I am so stressed and confused as I have been jobless for months and need the EAD soon.

      Thank you for your question and for being part of ASAP’s community! Asylum seekers can generally apply for a work permit 150 days after submitting an asylum application. If 150 days have already passed but you have not received your biometrics appointment yet, you can still submit a work permit application. You will eventually need to complete a biometrics appointment to continue with your asylum case, but you do not need it to apply for a work permit. You can learn more about applying for your first work permit as an asylum seeker here: help.asylumadvocacy.org/work-permits/#apply.

      Thank you for your question and for being part of ASAP’s community! If you have it, keep proof that you sent your asylum application to USCIS. That way you can show that you did everything possible to file for asylum within one year in the United States. If the immigration court confirmed that you do not yet have a case in immigration court, then it is okay that you filed your asylum application with USCIS. And it is okay to send evidence and documents to support your asylum application.

If you call the immigration court hotline and it says there is no clock, it could mean that you have not yet filed Form I-589 (application for asylum) with the immigration court. Hello, thank you very much for this video, I did exactly the way it was said over there, I applied with USCIS on December 6, 2022 and applied for EAD right after 150 days on May 6, 2023 (checked the right date with the google same as in the video). On May 30 I got denial letter stating: "A review of the record shows that you lodged or filed Form I-589, Application for Asylum and for
    Withholding of Removal, on December 6, 2022. At the time of filing this Form I-765, you had not
    accrued the required 180 Asylum EAD clock days. According to USCIS records the Immigration
    Judge has restarted the clock on your case. You are not eligible for employment authorization under 8 CFR § 274a.12(c)(8) because less than the required 180 days have elapsed."
    I really did not understand why that happened, please can you explain me if you had such situations, and what to do in that case. I would highly appreciate.

      Thank you for your question and for being part of ASAP’s community! Once you confirm that you have 150 days on the asylum clock, you can apply for work authorization. USCIS should be able to confirm that you have the necessary number of days by checking the immigration court system. However, it is best to include proof of the date that the immigration court received your asylum application. Usually the court can give you a date-stamped copy of your asylum application if you request it at the window, but you may want to call the court to ask for their specific procedure.
      You can find more information about how to get that date-stamped copy from the court here: help.asylumadvocacy.org/faqs-asylum-application/#how-to-get-receipt.

    • @asylumadvocacy
      @asylumadvocacy  2 месяца назад

      Thank you for your question and for being part of ASAP’s community! Generally, you can apply for a work permit in category (c)(8) as an asylum seeker when more than 150 days have passed since you applied for asylum. Because it sounds like you have completed all required steps like attending your fingerprint appointment, you should be eligible to apply for a work permit now. You can find more information about how to apply for a work permit based on asylum here: help.asylumadvocacy.org/work-permits/#apply
      But if you applied for asylum in immigration court and you have been calling the court phone number at 1-800-898-7180 and your clock is stopped at 160 days and does not advance when you call the next day, then USCIS might not approve your work permit application until the clock starts again and reaches 180 days. Thank you for your question and for being part of ASAP’s community! The asylum “clock” is a tool that USCIS and the immigration court use to count the number of days since you submitted your asylum application. When you have 150 days on your clock, you can apply for a work permit. When you have 180 days on your clock, you can receive a work permit. You can find more information about the the possible reasons why the clock may be stopped here: help.asylumadvocacy.org/work-permits/#problems-clock. @@asylumadvocacy thank you so much for your response. 150 days includes weekends and holidays? My friend's lawyer told me that 150 days does not include weekends and holidays, which confuses me. For example, the receipt date is December 14, 2023, so when is 150 days?

    • @asylumadvocacy
      @asylumadvocacy  Месяц назад +1

      Thank you for your question and for being part of ASAP’s community! Yes, 150 days includes weekends and holidays. If you submitted your asylum application to USCIS, you can check your receipt notice for the date that your asylum application was received. Then, add 150 days to find out when you can apply for a work permit. (For example, if your asylum application was received on December 14, 2023, you can apply for a work permit on May 12, 2024.) However, there are some actions that can stop a clock and you can find out more information about when the clock may be stopped here: help.asylumadvocacy.org/work-permits/#problems-clock.

The immigration court hotline phone number (1-800-898-7180) will NOT work for people who are applying for asylum with USCIS! It is only for people who have cases in immigration court. Thank you for your question and for being part of ASAP’s community! If you call the immigration court hotline and it says there is no clock, it could mean that you have not yet filed Form I-589 (application for asylum) with the immigration court. To apply for a work permit based on applying for asylum, you need to first submit an application for asylum and then wait 150 days before you can apply for a work permit.

      - If you submitted your I-589 to an immigration court, you can fix the mistake at your next court date by telling the judge about the error.
      If you submitted your I-589 to the agency USCIS, you can fix the mistake either through:
      - your USCIS online account, or
