Dear HIRA, I am Thanh from Vietnam. I would like to ask you a question: many people here apply for EB3 Visa (unskilled worker) through local immigration agents. Those agents find a U.S based employer for them (the sponsor), apply Labor Certificate for them, fill I-140 for them…everything is approved. Of course, on the other side, the applicants pay a huge fee for the agent (20k to 50k). And then, 100% of these applicants fail the interview at the U.S Consulate. (Their cases go to 221g and then being rejected). The common reason is that they paid a lot of money to the agent! And that is against the immigration and labor law! According to the visa officer, The decent case should be: the employer pays all the fees to sponsor the foreign unskilled employee to the U.S to work for his business, not the employee pays these fees to get eb3 visa! Jesus! Can you believe that any U.S based employer is willing to do that without the agent? (Paper work load, money, time…) and without the agent, how can the employer and the employee find and connect to each other? So what’s wrong if the applicant pays fee to the agent? Why it’s against the law? What do you think about the consulate’s criteria?
Thoroughly explained what administrative processing is. Good job. For normal understanding it is refusal to issue the visa for time being unless documents required or flag triggered during interview/ documents submitted is taken care of. Simple example if you have a sponsor with zero income, but joint sponsor is sponsoring and that joint sponsors documents aren't submitted properly or taken to interview can cause delays. For example joint sponsors passport or naturalization certificate copy. So while submitting documents to nvc or bringing documents to interview bring everything you just think can prove your case. August 23rd, 2021 I had my interview at the embassy in Mumbai. The consular officer kept my passport, didn't ask for more documents, and didn't hand out a 221(g) just said something like, is "Half Approved". Today's Status went straight from Ready to Administrative Processing.., I thought AP word was no longer in use as per the video above. Is very confusing, What's going on?
We had a diversity lottery visa interview on Sept 05 and 17, 2024 at US embassy after getting a yellow paper as a second one. They gave back our passports and told us to go and wait for them to inform us. After that we sent a follow up email and they made the last update on Sept 27, 2024 and told us that there is no more information and documents required. Now our visa is still refused in 221(g) under administrative process. Can we still have a chance to get updates on our status or granted visa, although our fiscal year ended?

At first they told me to send my passport and a copy of my I-601 apprpval notice so I sent them via DHL, three weeks passed and I didn't heard anything so I called and they where asking me to submitt more documents which where a new police certificate, new medical exam, pay the $325 fee again, and tp upgrade the DS-260 so I went last week to the Counsel to drop those at the window.

The consular was keeping my passport but I refused to keep it with them because they told me that they’ll take 30 days to give me the update and I had my travel plans. @@yungjetset i had the same issue, after a week i sent an email to the consular from the country that i had applied from and the next day it was updated to administrative processing

@@Drmata11it took us 6-7 weeks it remain refused then for a week it remained ready after that it changed into administrative processing and with in a day it became issued

Hello! I am K1, I had my consular appointment on March 6, 2023. They gave me 221g but my case was REFUSED. I sent the document and change to "Ready" on March 15. Since that date, they have been updated 3 times and it is still “Done”. On the 30th he sent me an email that he is in the final stage of the visa. Does anyone know how long that final stage lasts? Today April 10, 2023 is still “ready”…😢

Got my interview last October 12, 2022. My F2A family based visa is currently refused and under the 221g letter it says "Your petition is eligible for conversion from FX2 to F1. The priority date of your immigrant visa petition is not current."
Should I reapply for another type of visa or the embassy will be the one to convert my F2A to F1 family based visa? Also, what is the expected time to receive an update from CEAC website since there's no update after the interview?
