We filed an answer to a motion for judgment with the lawyer who bought our medical debt and with the court and he never responded to it. 3 months later we got a certified letter saying he got default judgment and a also a judgment for lean. I want to know what we can do and how to fight this, or if we're just screwed and should make payment arrangements
When you say 'filed' that should mean that you sent the answer to the court clerk and it was filed in the case - if that happened then there would be further proceedings (unless you admitted the allegations) before a judgment could be rendered against you and you would be notified of those proceedings. Please get a copy of the court records showing what was filed and when so that you can plan your next steps.

How do i go about dealing with a judgement. based off of unemployement and being laid off of work due to covid. I was allowing the collection agency take money bi weekly . Then stopped it. Because i could barley aford rent and utilites after being denied further assistance . I Didnt respond to voicemails due to the fact that i owed a collection agency that was different from the lawfirm that was trying to contact me. Until i recived the papers. Then understood that im dealing with the same payments that i had stopped.

If there was a judgment you were paying on by the withdrawals then the balance can be 'collected' by the regular means including garnishment to your bank account and sounds like they have the info for your current account. If you were paying on an account and now they are suing you then they can't garnish until a judgment is entered. For your particular situation you should ask for help from legal aid or from a private attorney - possibly a bankruptcy attorney- Look at our other videos on collection and execution to see if that might help.

Not sure what you mean by a 'letter for back rent'- if that is from a collection agency or attorney or the landlord and if this refers to a judgment that was entered on this same issue. Many states put moratoriums on landlord actions against tenants back in 2020 - we have a video on setting aside judgments and default judgments. look in the playlist for this video and go watch those- they will give you information you can check out for your situation. Please make a video for if you are trying to pay off your judgment but other party raised up double amount saying there is a post judgment fee and interest after one month of judgment issued. What is the law and how to handle it. Asset hearing alreay in placed about months later.
Hi @All About - will expand on this topic. A judgment amount is determined by the actual judgment document- the journal entry or memorandum decision or judgment entry or order- whatever it is called in a particular state or court. Other than interest which is specified in the judgment- there are not any 'add ons' allowed- again unless there is a state law or they are provided for in the judgment. So if one is paying on a judgment that needs to be clear and documented. Hope that helps.

Hi @Ed The papers you received will tell you what they are- if a summons and petition or complaint that is the beginning of a lawsuit. Ask your consolidation group what they can do- usually they help with payments - read all contracts before signing and make sure you understand them. Ask them specifically about this court situation. Show them the papers. Depending upon the charges you can go to an attorney who can handle it all for you. All your choice.

Great start to the video! :) Capital one lawyers sued me. First payment deal they sent me had a payment confirmation deal and a consent judgment to sign. I called them back and renegotiated but the second time around they only sent me a payment confirmation to sign and no consent order agreement (they already have a judgment order against me). Does NOT signing a consent order judgment benefit me in anyway or should I call them to have them resend the consent order judgment? What are the protections or benefits in having that? Thanks!
HI @First name Can't give individual advice here- generally if a judgment is entered and a payment plan is then worked out the parties can have the judgment documents filed in court to be changed to show the terms of the plan and that makes sure that the new terms will be followed by both sides such as time to pay, notices etc before the judgment execution begins.
hey i know your video is old and you may or may not be active on your channel anymore but i just seen this for the first time today and i had a question because i have a similar case right now currently. i have paid over 90% of the total balance owed however i am no longer in a position where i can pay anymore. and i recently received a motion to compel letter requesting i answer post judgement interrogatory's right now i am not in a position to hire an attorney to help me out either. idk what to do? what should i do? it says if i don't respond within 10 days it could result in me being incarcerated. i have two kids and i'm the only one that works right now. i'm really lost right now

Hello, I received an affidavit requesting me to reply to a garnishment for a judgment that I have no recollection of. The attorney for the collection company provided their phone number and asked me to contact them if I had any questions. Would you recommend contacting them or just contacting an attorney for myself? Also, would I have any chance of overturning the judgement if I was not properly served and couldn't ask for a debt validation from the collection company?
I can no longer pay the creditors. Do I have to go for several months without paying them or do I pay them what I can? I have used all my savings and don't know what to do. PLEASE HELP!
Hi @Larry sorry you are having problems. If you live in the US please seek counsel who can evaluate your individual situation and check to see if you would be eligible to file a chapter 7 bankruptcy. If you have limited funds it is best to try to make a deal with the creditors to resolve the situation. Perhaps a family member can help you pay for counsel and/or work out a deal with the creditors.

Do your best to answer the information. IF you are a candidate for bankruptcy then contact a bankruptcy attorney who can help handle this for you.
