What is TERA? | VA PACT Act Claims

  • Most veterans have heard the term, yet wonder "what is TERA?" Well, it relates somewhat to VA PACT act claims and in today's video I explain exactly what it is. Many people confuse it with "presumptive" and ask the question "are TERA and presumptive conditions the same?" They are not and I will tell you why.
    Toxic Exposure Risk Activity (TERA) is the topic of today's video.

    Korea used agent orange also. It was a brief period but it was used. My uncle was service connected for his exposure to it.

    Yup! My hubby was in the burning oil fields. He was a communicator. So, they were instructed to BURN their lithium batteries.
    He's now 60 years old. Just had his prostate cancer removed in January 2024.
    Things are going wrong with him. Have been for years.
    He was born, raised & served at Camp Lejeune. Yes. His entire family is filing for that too.
    I'm watching your video to help him with his claims. I did mine 5 years ago (29 years after the fact, & won 100% P&T, no future exams).
    It's a painful process, but if you have a solid claim? And get a GOOD C&P examiner? You're gonna fair better. Do your homework!

    Us veterans were not included ( Korean Vets ) in the PAC Act from 69 to 71. There are a lot of vets who served there a few later and now have all kinds of problems.

    If a veteran has a problem, stop saying “don’t assume it’s from deployment “. Do the work to ensure the potential outcome. I was assigned to convoy security team, rear guard in a 7 ton truck in an open turret with a .50 cal. We were told to complete our missions even during sandstorms when the helicopters and planes were grounded because of “Red Air”. That’s when visibility was almost zero, most time less then 20 ft in front of you. So after 12 sandstorms and a sciatic injury the VA still only gives me 90%. I currently have a left knee replacement, pacemaker, type 2 diabetes (VA diagnosed), steep apnea (VA diagnosed) and sciatic injury from deployment the the VA continues to downplay. I will be having a L5-S1 or spinal fusion operation done in about a month. I am currently only rated at 90%. Raters need to listen to veterans not only what they can give a vet from a f&$king list from a group of doctors appointed by a political group. I have 22 years in, now retired with an MBA that I worked for after getting out of the military. If you are going to make a video, be “informative” not assuming. Keep working on it.

    Thanks for this video. Up until now I had never heard of TERA, and I've been working with a very good VSO team. I'll be talking to them again soon and bring it up. And you may hear from me again when I get my decision letter if it doesn't support my claims.

    My husband just got denied for prostate cancer, due to the PA’s DBQ, but the VA agrees that he was exposed to a Tera. He was a fire fighter at Whiteman Airforce base so exposed everyday to PFAS or AFFF. I am so tired of the denials due to AFFF. Now we wait 5 - 7 years for an appeal.

      The wait is only if you appeal to the BVA. Supplemental Claims and Higher Level Reviews are faster.
      As a strategy, we tend to stick with the Supplemental Claims and Higher Level Reviews, when we can - they can be a bit more work on the front end, but when successful, it's faster than the BVA.

      @@guidonlaw this appeal process was made by the VSO In our county. I am beginning to think they work for the VA not the veteran. My husband will be 75 by the time his appeal will be heard. The whole process is out of whack. The VSO officer blames all the veterans filing claims.

      I am sorry to hear that. That's rough.
      I mean, the VSO isn't wrong about that - but Veterans have a right to file claims.
      I personally blame the VA for failing to educate Veterans on what they need to do (which is why I started a RUclips channel), and the VA being unable to process these claims in a smart way. It shouldn't be this hard.

    I found the document appointing me as waste collection site custodian from my in-service training folder. Is that enough evidence along with medical records both in-service and post-service, medical conditions like chronic sinusitis, chronic bronchitis, asthma, dizziness/imbalance, headaches, and insomnia with frequent waking? These conditions are currently not service connected.

      It could be. It really depends on what the science says - we rely on doctors (either VA or private) to tell us whether the conditions you are experiencing now are related to the stuff you were exposed to then.

    Was denied a COPD Presumptive Condition using TERA as the justification. I was in Iraq during the designated time period, engaged in combat and have a current diagnosis assigned to me by a VA doctor. I was then sent to an outside doctor who opined that the Presumptive Condition I have possibly is the result of something other than what is acknowledged by the Pact Act. Appealed and hired a Lawyer almost a year ago with no decision as of yet. Confused and frustrated with TERA.

    There are many bases located right here in America that have stored toxic chemicals.

      There was as much AO used in the US as there was in Vietnam albeit over a much larger area.

    I filed for a presumptive condition and the c&p said most likley it was not from bad water in the 70's

    Yes, all the things that you stayed about in the VA system is true. The only problem is if the VA doctors nurses doctors do not follow up and nothing that’s ever done. You tell your primary care doctor that you need a consult and nothing gets done. you call him back hey what happened to my Consult what consoled and then you move for 20 years?.

    I was a mechanic. Inhaled diesel fumes and exhaust every day. Also, worked with solvents and oils every day. Now I have sinus problems and headaches all the time. Can I use TERA to service connect me for sinusitis and rhinitis because of toxic exposure due to my job? Please help.

    i have tera conceded during my service and in favorable findings, lung bladder and prostate removed...Denied need to appeal

      Sorry to hear that. If you can connect the dots (scientifically), definitely keep at it.
      Recommend finding out what TERA was conceded, as in, what were you exposed to. Was it jet fuel? Burn pits? VOCs? Lead paint?

      It's not presumptive, but it can be a TERA.

      Can it be TERA due to your job? I was a mechanic inhaling diesel fumes and working with solvents every day while on active duty.

    denial for claim in 1999 they said: (the DOD letter that was sent out) the Letter refers to possible exposure to low level agents as the veteran was near Khamisiyah on March 10, 1991. Veteran could have easily been in that area providing water to the other soldiers

    thank you for the information. I have been in search to see if anyone has ever tested for VOC's? I have lots of fatigue or lethargic and have been feeling this way for the last 8ish years. I have been seeing doctors and one had me do a heavy metals / toxins test.
    I had the following VOC's tested in 2021
    Ethylparaben: in control is less than 6.10, mine is at 166.03
    4-Methylhippuric Acid (4MHA) (mcg/g): in control range is less than 74.00, mine is at 2941.99
    My assumption is this is what is the causation of my chronic fatigue, but have not found anyone else that has mentioned getting tested.
    I was in Iraq, jordan 03, and Kuwait, qator, bahrain in 2012.
    If have been doing bloodwork every 3 to 4 months to ensure things are aligned. I just don't know how to go about filing for a VA Claim for CFS. I heard it is impossible, but not sure with this PACT, presumptive etc how or if I can.

      Filing for CFS is like filing for any other condition, but with CFS, it's definitely one that want to have a doctor's diagnosis for first.....but CFS can be tricky to diagnose.
      Stick with it though.

      I have so many times and never received or I get an email stating they cannot send them to here that I have to get them from someone else and there is no way to get ahold of the other people since they aren’t really named

    Was cleaning the barracks floor with bleach and ammonia, went to sick call and they enter that my mucous membranes were severely damaged, is that a TERA claim. Happened weekly in Bermuda in 1970. I can no longer smell or taste.

    Why aren't there presumptive conditions placed on Military bases that have been listed as EPA Superfund sites? Doesn't seem fair that those of us who served on those bases and were exposed to a wide range of toxic substances should have to jump through so many hoops and in many cases still be denied when the PACT Act removes that hurtle for Vets who served in specific locations during specific time periods...

    This is really interesting I’m an Gulfwar veteran I worked on the flight deck. I was just Granted 70% PTSD and 50% sleep apnea total 90% I noticed in the decision letter under evidence there were a couple of Tera memorandums i didn’t have a clue what it meant… but it must have had some type of outcome on my claims.

      What carrier? I was involved in SLEP SERVICE LIFE EXTENSION on CV 62 @ Philly ship yard then took to San Diego. Few years ago diagnosed with pulmonary fibrosis. Eventually lungs were shot, received double lung transplant two years ago. Served 87-90. Also did some work-ups on CV60.

    My tinnitus were denied by TERA. The rationale " my ship was docked in Dubai for 4 days and see no link to my tinnitus" SMH

    Rater added a tera to my already SC arm only exposure i have is being stationed on a posts that have be declared toxic my injuries come from in-service trauma events

    So I just received a 30% rating for my migraines and in the decision letter it mentioned it was granted under TERA. I assumed the condition would be granted under PACT Act. What happened? According to what you have espoused here, they placed me under a much more stringent criteria under TERA instead of granting me service connection under the PACT Act. Ideas?

    The problem is in theory what people state hey Tara go for Iraq Afghanistan, Vietnam Abc in service connected to get the VA to actually get off their ass and actually do anything after that and we’re talking the whole system. mostly employees don’t have a clue of what’s going on. They just going to work every day and collect a paycheck or they sleep at home answering phones and collect a paycheck. VS officers have no clue what’s going on VS officers going to meet veterans VS officers doesn’t wanna talk to Veterans. You guys all talk and a, like closed environment is VA and Double doctors and VA nurses and VS and American Legion VFW don’t have a clue and don’t want a clue as long as the veterans are dying in the streets. VA is happy example why would VA put out propaganda on RUclips and not have a comment section because they know how bad the VA system is and they don’t wanna hear it. They just want to put out their propaganda.. like we’ve done 1 million claims at 0% help nobody and then you moved on doing a claim at Help unless that veteran doesn’t have any other way to get Medical but just because he has here she has VA medical doesn’t mean they’re gonna be treated by the VA it just means they’re on the role of the VA and the VA gets money each month to not treat veterans and disrespect veterans veterans services. that’s the real world all these other people live in a different world where they get on in front of RUclips and say yeah it’s just that simple you claim that you claim that you see your doctor they do Nexus letters DBQ’s now they don’t and then when you show up your CMP, then your CMP doctor clue, clue all they want is money from the VA to give you CMP physical that’s supposed to last three hours.
