    k, but, that Bethesda threat is a weak example because Bethesda is so trademark-crazy that they'll gladly sue anyone and everyone they can, even if there's no real trademark violation. 'Scrolls' and 'Fallout' are words- single words! -that Bethesda has tried to claim trademark on. They won the Fallout threat simply because the other publisher did not have the legal representation or budget to take Bethesda to court. They lost the Scrolls threat because Mojang isn't a small company.
    Pretty much, steer clear of any and all words Bethesda has ever used in a title, and you should be fine.

    Ok, those name infringement cases are awful. Neither game should have needed to change their name, just because it included a common word that some other company decided to use as their game's entire title. That's awful.

      Bethesda have a habit of it apparently, and because they’re such a huge company they can almost always get away with it.

    I don't really like super easy titles. Either you need to add "game" at the end of the search or it takes over the search bar. So if I wanted to Google "Inside" for art references or something, the game will take over the search. Not a huge deal at least lol.

    Good
    The game is about -space demons- meme hunters and is filled to the brim with meme references
    EDIT: iv'e started working on it, it's a -bullet hell- top-down shooter (bullet hells in unreal are laggy) with pixel art (so i can bypass article 13)
    you could script your own levels

    "Call Of Duty Black Ops was famously shortened to COD Blops by gamers. " That's the first time ive heard it shortened to that. Im used to just calling it Black Ops.

    Is the name “Hatastrophe” good? It’s a 2.5D platformer where the main protagonist and villain both have hats that help them in their quest to find a crown that can grant any wish they desire.

    I've been rolling with the concept of a game for over three years now, writing up so much information but not producing anything physical as of yet due to complex circumstances surrounding a lack of connections or technical skill, plus anxiety talking about personal projects, which I'm trying really hard to get over.
    The game is called Across The Stars, though I acknowledge it's still a working title, and I've felt like the name fits a bit less since I decided to refer to the universe's worlds as planets rather than stars (partially due to Kirby's use of the same terms, but also because they've always been planets on a technical level, so I don't know why I didn't just call them planets to begin with).
    I won't go into huge detail about it here, but basically it's a fully fictional world with space travel and adventure and conflict. I guess in some ways I'd liken it to old Ratchet & Clank games with RPG elements?

      The process varies from place to place (India or Japan will have different trademark requirements/processes than the U.S. or England), but the general rule of thumb is to find a legal firm that specializes or focuses on trademark and/or copyright in your region to start the process. Some places do allow for online applications, though. Best to do a google search for your specific region (include state/province if necessary) for a bit more info.

      In depend of State and countries. In Canada they are exist two types of trademark registred ® and no registred trademark ™ (or MD for registred trademark or MC for no registred trademark in Quebec). To protect all elements of your game registration is not enough. You must registred all copyright elements of your game at Intellectual Propritety Center of your country. Some registred trademark can be used in some country be careful. No registred trademark depending of the country can be have a some protection. I hope to be clear on the question. (Sorry for my English because I Speak French).

    Great video, full of helpful advice! Just wanted to say, Pokémon's namings in their games refers to specific nouns or collections for each 'generation' (e.g. Pokémon Red, Blue, Green, Pokémon Ruby, Sapphire, Emerald, Pokémon Gold, Silver), and may also name them on a Pokémon's name (e.g. Pokémon X (Xerneas), Y (Yveltal), Pokémon Let's Go Pikachu/Eevee), and with the recent announcement of Sword and Sheild, you can see that they are keeping this up. Just wanted to put that out there.

    Quick anecdote I wanted tossed into the ocean: a long time ago I wanted to make a run-and-gun much like Metal Slug. Starting out, I was giving it a goofy name: "Blow Stuff Up". But one day I found a random game name generator, and saw one that really stuck: "Heavy Metal Omega"! So naturally I'm changing it.

      not a bad idea if you already have a community that you are selling into - that'll build goodwill with your followers. Mind want to control it a bit by giving name options so as to avoid the community picking something you don't like.

    The limit for game title length is about 4 syllables before people begin to use abbreviations more than the full name. If you choose a longer name, think about how people might abbreviate it before deciding.

    I think another rather important thing to think about is "googleability" of your title. Especially if you're going with single-word names and you have no publisher powerhouse that would take care of advertisement and promotion of the game for you. Ensure that the Google results for your name aren't flooded with something unrelated and that your name isn't too generic for the same reason. Ideally, it should be one of the first search results even when almost nobody knows about it yet. Because if people are going to hear that a game called "wild hunt" being developed and decide to google its name to check out the results... Well, good luck to them finding the correct link in google results before giving up.

    I haven't made that mistake.
    but I recommend it and find a non-owned product(tm adn , alsoe maby (c)) in your country, but also check if it is available in the eu and usa, but first in your own Contry and then register trademark. so you own the name of your game or studio first in your own country and if you know it is available overseas/region ex: EU and USA/Asia then register it there as well. When doing this is difficult but possibly after having a clear design on the game and having a good playable demo Alpha or beta buld of the game and then arrange money for and register.
    ps translated from Norwegian (I am Norwegian play store with dyslexia so hehe)
    My experience by watching other over years since 90s that has made a great name for a Mod or Game but havn`t register it and company or some one else that has money buys the name so :)

    Well once I was making a prototype of a shooting game, it only had two half circles with legs that shoot bullets, it was supposed to be a contra parody, but them my sister saw it and said, what a bizarre game, so I named it project bizarre and the half circles became half skulls on a bio bot.

    I think this is probably the hardest part of any project, game dev or otherwise, that I face. Coming up with a name that sounds good, has the right kind of appeal to your target audience, they will know how to pronounce it and it makes sense. Another big hurtle is that the name you like -- or the top 10 names you think of -- are already used by someone else's game. If you make a slight variation of one of those, you are sometimes subject to IP infringement. Coming up with a unique and good name is very hard.

    I'm not good at naming things, so I thought I would have a hard time finding a name for the game that would hint at what to expect and give an obvious hint by what it was inspired, without risking too much of hitting something trademarked. Funnily enough, I found mine in 5 minutes and also seemed to be used in a very general way.

    Yep, I stopped on "Exploratory Period" and gave my indie game a working title of "Horse Unity Folder" as it's an RPG meets equestrian management simulator and while much is completed, a lot of details remain fuzzy to a point I'm not sure what that golden name is yet. Even the Sims 5 is working under 'Project Rene'

    For the Wasteland Kings / Wastelands, please note that was an amicable dispute. inXile wanted Vlambeer to change the name not because it was infringing on them (legally, it wasn't. Can't copyright one word of your title.) but because they were in the making of Wastelands 2 and wanted to see if Vlambeer could clear the search air for the second installment of the series. Vlambeer wasn't obligated to do so but they decided to do it as courtesy. (The 'Scrolls' vs 'The Elder Scrolls' debacle shows how hard it is to protect 1 word.)

    I think Goat simulator's title works beacause it descibes the opposite of the gameplay experience. You enter the game game expecting a simple goat and you end up playing as a living DEITY.

    Trademarking is quite costly though... Trademarking company name/brand is okay, I mean you only do it once per 10 years... But to trademark every game can be very expensive, especially when you release (small) games once every 2-3 months.

    Now I know this is for game development, specifically indie game developments, but in all seriousness Microsoft xbox division should listen to this😂I mean xbox(original), xbox 360, xbox one s then x and now xbox series x I mean what happened to the good old days when were naming gaming consoles numerically🤔😂 besides Nintendo though😌

    Can anyone tell me, how do I start learning.. do I learn the engine? Or do I learn the programming language first?

      Depends on what position you want to fill in. If you are working in a team, you might just specialize in one task depending on what you are interested in(eg. game design).
      As a single developer choosing a game engine that does not require traditional coding might be a wise choice. (eg. Game Maker, or Blueprinting Unreal Engine)
      That way you can learn how to make games by doing so, which is definitely more fun. You can still learn traditional coding afterwards or as a side activity.
      If you want to be hired as a programmer on the other hand learning the programming language would be top priority, since game studios often use internal engines, where all your knowledge of unreal or unity gets useless. Game Designers and Level Designers are better off learning the engines, while artists and animators should know the main tools but in general need to be experts on their craft.

      @@lstx1977 If you can be autonomous with visual scripting it's the better. Understanding the logic behind programmation can make you gain time for your team. :)

      The best way to go is to specialize, there is so much to know about the creation of games, that a single person can't learn everything. You can take a peak into every field, but looking deep into one is much more effective.
      I guess from your answer, that you want to make indiegames, so if you have some friends or like minded acquaintances who also want to make games team up with them, so everyone can learn a specific field. That way you can reach a higher quality in a shorter amount of time.
      If that is not the case you should probably start by following engine tutorials, making games with free assets or if you are already proficient at drawing you might create your own 2D Assets.
      If you are especially interested in programming I suggest checking the official unity tutorials. You will learn a lot about the engine and some programming in C# along the way.
      If you want to be a 3D artist or animator taking a look into a 3D application should be your next move. Blender is free and powerful and has a passionate community and thus many free tutorials. Once you feel you have created something good start checking out game engines (I recommend unreal engine because of its blueprinting system)
