When the Seal was announced I thought that perhaps I didn't need to wait for the Han (maybe one of each) because it looks like a great car. However the warranty and servicing matters that have popped up over the last couple of days is extremely concerning as is the matter of the safety rating. I will be buying two electric cars as soon as possible but unless BYD or EV direct fix their warranty conditions and servicing costs maybe Tesla will get my money. I wonder how consumer law will view this.
Break pads or 12V battery are only under a manufacturer warranty, meaning when they break it must be because of a production defect. This type of warranty can not be less than 2 years. Otherwise break pads are not in any type of "extended" warranty. Wiper assemblys or tires are the same. Warranty for manufacturng defects but not for usage.
I think the BYD should take back their agreement with their distributor in Australia. Warranty may be at the mercy of the distributors whom may shorten or lengthen their period of free warranty service depending on their manpower availability and costs concerns. I am speculating here, of course.

Hi Sam, Thank you for an indepth analysis of the warranty details. It looks like the dealer has blown its business case for sales and now scrambling to cover the costs. Even though I stated I’ll not cancel my order now I’m inclined to do so.
But to put in perspective-when compared to its key competitors. Kia, for example, its customers can pre-pay five years of servicing for $1089 - compared to $1736.68 for the BYD. It's only marginally more expensive than the Ioniq 5 ($1684).
I have cancelled my atto3 order today due to warranty changes, no ANCAP rating, no Android or Apple app, and no delivery date. BYD is definitely not building my dreams.

YT creator bias is real too. So many RUclipsrs getting loads of revenue by promoting the cult of Tesla just won’t criticize even when needed for fear of offending/losing subscribers and harming their revenue stream. I appreciate Electric Viking for being independent.
Most EV manufacturers (non-legacy brand) sell their cars online instead of through dealership to cut out the middleman cost. If BYD is using dealers to sell their cars, they have to share the profit with them or let them make some money from the service cycle. Thus the strange terms on their warranty. It is very obvious. Follow the money.
MG here in the UK is the same day you get a 7 year warranty. When you look at the fine print majority of the MG ev is covered only for 3 years. Viking if you look at the online warranty for MG it’s 3 years for the majority of the parts . Only one that cover the majority of parts are Tesla and Hyundai Kia
They won't get away with this in New Zealand. Our consumer law is similar to Aussie. And still companies try to sell extended warranties which are just taking money out of your pocket for no good reason..
I think you are way right in you use of the Australian Consumer law. As I recall, from watching other Aussie auto experts that the law says something to the affect that you can expect what a reasonable person believes is appropriate for the purchase. So the question then becomes what can you reasonably expect from the car. We here in the US do not have such a law and I wish we did. My 2013 window wipers mothers went out in 2021. I keep my cars forever and I have never had a window wipers moter go out. My 2003 Ford still works fine. Anyway this cost me over $1200.00 to fix, same with my rear lift gate which cost about the same to fix. Was that "reasonable" not to me it was not. Most warranties in the United States very greatly between automobiles. In many cases as you have stipulated you have a 5-year unlimited mileage, or 100,000 mile warranty on the entire car. Then there are other manufacturers who offer a 3-year warranty on the vehicle bumper to bumper they call it and 100,000 mi on the powertrain. So there are a lot of different variations depending on the manufacturer you choose. And I'm really not sure what Tesla's is in the US. Perhaps this is just growing pains for BYD as they enter other nations. It would be good if consumer advocates from Australia could sit down with BYD and help them understand what an appropriate warranty would be for your nation. That way when everything was said and done, it could be signed off by everybody and you would have an agreement as to what an acceptable warranty for that automobile would be.
Well Viking we haven't signed a contact as such but paid a deposit with the intention to buy which is good enough in my opinion so the warranty given at the time of paying the deposit should be upheld or at a minimum the vehicle should have an all inclusive 6 year/150,000km bumper to bumper warranty. It's deceitful and does not install great faith in BYD supplying a quality product or they BYD, believe its not a quality product they are suppling the Australian public with that should in theory outlast the warranty by several years. If evdirect and or BYD don't come to the party then they should expect irreparable brand damage that I don't think they will recover from. Byd is new to Australia, people are hesitant about this Chinese brand and this isn't going to help their cause as they try and launch the BYD brand in Australia.
BYD sell to a distributor and that distributor can do whatever they want in Australia. So that distributor is a milk farmer, after your money only! BYD has been stupid but now most likely have a binding contract so game over before it did start
@@lumtavon1952 I'm sure BYD have a lot of conditions built into the contract with the Australian distributor let's watch this space for the next few weeks and see how it plays out.
Interesting... BYD's limited warranty on parts of their EV vehicles. I reflect on the useless warranty on my last (ICE) F-150 truck. (Did I say "useless"... yep... warranty was not worth the paper it was inked on).
I’ve put a lot of kilometres on my 1/2020 Tesla Model 3, and their service guys still fall over backwards to help me out. When I was in Sydney last December at 134,293km, they comped new front upper control arms and the corresponding wheel alignment. Then in April, when my first scheduled service interval hit at the 2 year mark, the Canberra service centre, who I can’t speak higher of, did the brake fluid check as specified in the owners manual, for $24.
The MG EV is the clear winner. Seven years warranty on everything has to be superior to the crap BYD wants to throw at you. My reservation for the Atto 3 has been canned, needless to say.
Visited the store yesterday and when I asked about warranty issues mentioned here the person said, there is no change in warranty and they are receiving orders still despite of warranty issues.
In 2015 I brought a VW amarok with a 3 year unlimited warranty, i could of paid extra for another 2 year on top of that. and they still replaced the headlights after the warranty had expired. (one was replaced within the 1st year and due to a defect with the plastic 2 years later it looked like it was no longer roadworthy, the other had a touch of sun damage so they replaced both with updated units) Its time the laws change that manufactures must warrant cars for a minimum of 200,000km and 3 years, this will improve quality and the overall environmental impact.
For comparison, Yuan plus in China offers 6 years/ 150000km warranty on the whole vehicle plus lifetime warranty on the battery, motor, and electric system for the first owner.

Its a manufacturer's warranty. Not a dealer or importer warranty. If anything, it HURTS the dealer as people will bring in every little thing while under warranty. But will put up with things they have to pay for.

I suspect BYD have confidence in their vehicles. The issues in Australia appear to have developed only since the appointment of AP Eagers. What is the situation in NZ and Singapore?
Maybe the MG ZS EV's warranty is different in Oz but in the UK there are quite a few things that are excluded from the 7 year warranty including the infotainment system which only has a 3 year warranty.
This should have been announced up front. The 'oh by the way, forgot to mention that servicing is going to cost you over $3k' is not doing BYD any favours with customers. Bait and switch tactics never really that popular with the punters as it looks really dodgy.

According to byd internal source, byd has now over 200 thousand oversea orders and 800 thousands local orders that cannot be fulfilled now. Byd is controlling the 4s shops strictly in China so that they are not allowed to raise price or request unauthorized charges for customers to jump the queue. But byd may not be able to control the behaviors of distributors overseas . As far as the demand is huge than the supply in overseas, additional charges and unfavored terms against customers may not be avoidable.
Clearly seems as if they wish to use the most lightweight, medium duty hardware and electronics. Likely will also seek to sell extended warranty for those parts like electronics, echoing the worst parts of the ice buy experience. There are many middle class cars in six year warranty with combustion engine. Lot of parts to broken in six years. No one give that to consumable parts.
When your deal keeps changing before you have recieved the car it should warn you to get out of the deal. I would cancel and get your deposit back. Wait for a while if you really want a BYD and see how there car goes as they certainly are unconfident in the car or the distributor/Dealers are ripping you off. Either way canceling your order and waiting would be the smart thing to do or just shop around for another EV.
I tell you this: the split of guarantee in this way is a big mistake. They should cover all as others for 7 years and rise the price a little. In this way, they just get away with customers... About Tesla, one very important thing: Tesla has each car produced with all the specifications virtually in their database, there are no problems to get any info about your car after 7 years for example... @@gregandkaruna6674 I do not know this, but the ICE car guarantees are a maximum of 3 years on average. Ah, there are 12 years for rust, but it is for complete hole rust from the inside to outside. Which you will not see it in 12 years but in 15, yes, a lot. Just Kia offers some parts with 7 years.

Agreed!
just cancelled my order, too many issues around transparency. Not a great feeling
Normally EVs don't cause a lot of brake wear because of regenerative braking. What's up with that BYD?
I think the BYD should take back their agreement with their distributor in Australia. Warranty may be at the mercy of the distributors whom may shorten or lengthen their period of free warranty service depending on their manpower availability and costs concerns. I am speculating here, of course.
BYD fault, BYD drafted the whole warranty to be same applied for whole Asia (Aus), those little stipulations.
However EU got much better deal 5yrs for everything except the battery (longer warranty 7yrs?)
So the one to get majority of blame is BYD Asia
BYD needs to step in and make things right. Call BYD China and find out what the warranty supposed to be in Australia.
On Media this warranty was drafted by BYD (said EV direct) same for all Asia.
So it is btotally BYD fault, for whole Asia (Aus included)
Whereas EU, BYD gave better warranty
@@james_l4337 You believe EV direct? They're always saying stuff and then backtracking on it.
@@electronicfarts5105 u are right, too many people indicated Warranty in Asia mostly better then Australia. eg NZ
EV Direct is likely lying on Media knowing soon they will be found out, these people still have the confidence to lie
However some indicated there are clauses in NZ warranty that may indicate it may Not be bumper to bumper...
BYD need to come clean with their warranty agreed on with dealers ie NZ & HK, too many gossips here and there; best BYD need yo come out and amend this with dealer and let the dealer announce this to save their face
Agree with you Sam let's hope there is some introspection on EV directs behalf
Hey Sam
There is no clutch disc in that car, button battery fuses and relays are not usually covered under warranty in other cars, nor are brake pads, common relays are used for things like horn and headlights.
As a mechanic there is a lot of items that don’t make sense or I wonder why they even lost them.
It has to be a mistake.
As you say I’m sure they will rethink what has been printed.
Scott meant "why did they list them". He's right, this was a list for an ICE car. I wouldn't worry too much about the 6mo stuff.
Basically its Only 6 months Warranty:
''Consumables and Quick-wear parts: brake pads, wiper blade assembly, bulbs, fuses, ordinary relays (excluding integrated control unit), air conditioner
filters (Filter net, High efficient strainer, Electrostatic filter), button battery, tires, labels, coolant, refrigerant, lubricants, glass cleaning agent and all kinds of
oils and liquids, etc''😱
Brake pad are not normally a warrantable part due to being a wear item. Same as globes air cleaners fuses etc.
The warranties in Norway and especially in China seem to be much better. The Chinese lifetime warranty covers the battery, motors, and control electronics.
Just like the GM and Ford dealers don't seem to have any power over their dealers. I am surprised that BYD would let their brand get damaged this way in Australia.
As soon as this news gets out around Australia BYD orders will fall to just a trickle. It's a pity because from what I've heard the cars are good and their batteries are very advanced.
What is with this stupid lifetime warranty! It's not based on a human lifetime! It's based on how long a battery should last and most brands are saying 10 years so the so called lifetime warranty is no more than 10 years in the real world!
EVDrict's management decided they don't want this much orders??
@@gregandkaruna6674 - It is really simple - there is a 30,000 km/year limit, which means that the batteries run out in about 30 years. How many first owners have had their car for 30 years and drive close to 1M km? They will be worth gold for BYD advertising department.
@@johannbrauer9285 It's not going to get a 30 year warranty! Battery makers "all" give a max of 10 years! That lifetime warranty is 10 years! OMG you lot are all stupid thinking that it's 30 or 100 years
--- I did order and still want the car. At the moment of paying the deposit -- it was 7 years warranty or 160000 km. On all of it. Battery and the rest. Now, everything is different. Can that be legal? Let alone "fair"? Lawyers are there, I can ask. And I do agree with You Sammy. I think others will do -- what I do intend?
Hope you are insured for legal assistance. If not they will milk you like a super 🐮
Cancel your order IMMEDIATELY!
If it's good enough product that I don't need to worry about the warranty, then I don't care about the warranty. If it's a shit product, and I need to worry about the warranty, then I don't want the product. If you want to avoid frustration don't pay for a good warranty - pay for a good quality product.
More like Build Your Disaster !
Sam ... a good summation if the poor implementation of warranty service & costs.
Keep up the good work with your reporting of things as they are .....unfortunately it appears in Australia Govt inaction over the years has come home to roost & the incentives to purchase BEV are not quite yet at the level that many would need to be able to purchase.
I'm contemplating purchase of GWM ORA but unfortunately that will not be in Australia due to purchase price / ownership costs within Australia .
Sorry to say but as a Senior Citizen, owning a vehicle within Australia is now not feasible for me so my hard earned cash wiill splash offshore where I can at least get value for money spent
People need to cancel their orders. Imagine what this does to your resale value.
I have an 8 year Full Bumper to Bumper warranty that I paid an extra $3600. Worth the piece of mind on my 2022 Kona EV. I received it Oct 2021 and no regrets for the entry level EV.
You wasted your money. Your car already has a 15 year (approx) warranty as described by the ACCC.
@@greghudson9717 I don't think I wasted my money. Bumper to Bumper includes many components besides the battery that's expensive. To add $100 extra for 36 months is all good.
This video is quite sad for all BYD buyers but funny to me since what is happening is exactly what I commented on your last video. The surprise to come with the warranty. Just buy the car and see what happens when you claim something under warranty. Let’s see how smooth sailing this will be if they already change their rules before delivery !
Had part of my Atto 3 damaged because two screws fell out under the front end. Was told by a BYD service manager it would not be covered under warranty because MyCar did the first service. He said I would need to try to get MyCar to pay for it myself! Booked that service on the BYD web site. Clear breach of consumer law regarding car warranty that they will be wise to back down from.
Thanks for the honest heads up! 👍 Truely appreciate your channel 🙏
Wait for the MG4 EV. It's has excellent reviews in the UK so far.
In Portugal and EU - 3 years is the legal minimum warranty for autos - except wear parts
Enough is enough time to cancel the order.
Try to write a letter directly to the BYD office in China. Maybe they just are not aware of this situation.
Glad I'm not caught up in this. It's a learning curve. Hope my Volt lasts until 2030.
(one was replaced within the 1st year and due to a defect with the plastic 2 years later it looked like it was no longer roadworthy, the other had a touch of sun damage so they replaced both with updated units)
Its time the laws change that manufactures must warrant cars for a minimum of 200,000km and 3 years, this will improve quality and the overall environmental impact.
How come people in Auckland are allready taking delivery of their Atto 3 of as yesterday
For comparison, Yuan plus in China offers 6 years/ 150000km warranty on the whole vehicle plus lifetime warranty on the battery, motor, and electric system for the first owner.
Surely the issue here is with the service providers for service.
So what, that's China. Down under the distributor decides, noone else
Woah that’s as expensive as my diesel servicing! That’s why I went out and bought a Tesla..
I bet you feel silly cancelling your Model Y order now.
Pm2.5 measuring instrument is used to measure air quality.
Well said sir! If I were BYD direct I’d be a little concerned about how the brand value is slowly being eroded by 3rd parties.
Good on you Sam for speaking up about a company you have invested in, shows a lot of integrity 👍
Very well said
Hi Viking I have been following for a while now and I just want to tell you thanks for clear unbiased reporting on EVs. That said I have been waiting for BYD to come to the USA and have bought a fair amount of their stock. One of the questions I was going to ask was do you know the reason the stock has gone in the past week. Now I know when a company enters a new market and changes warranties and adds crazy charges, I think it's time to sell their stock and look at other brands
All I can say is hurry up Aptera. If I have a problem with Aptera their factory is just down the road from where I live. I will see my first Aptera in person on September 10 at the fully Charge event in my beloved San Diego. People who live near the San Diego area will be the first to receive their Aptera. Mine will be the 400-mile range model with full solar array.
BYD Australia aka EVDirect doing a Typical Australian Business Stunt by screwing over the customer 🤬
Then screw them back by everyone cancelling theirs order and they are lumped with their deliveries.
exactly. This feels very Australian, in the worst sense
Who owns EV direct, if you know that then you will understand the root cause
Thanks, good work sir. I will stay away from this product.
Sounds more like a dealer/importer scam possibly not BYD
How would this save the dealer/importer significant money.
Its a manufacturer's warranty. Not a dealer or importer warranty. If anything, it HURTS the dealer as people will bring in every little thing while under warranty. But will put up with things they have to pay for.
No, BYD did select an ICE dealer group who must be used to rip-off customers. This warranty tells the whole story of incompetence
@@johnb7430 no this is a Aussie distributor who is in to make big money, left or right. Check out
@@danharold3087 because the dealer can charge the customer for parts snd repair that the dealer will get under warranty from BYD so in effect gets double for repairs as well as the service cost. I am not saying this is definite just my suspicious mind.
Sounds like No warranty at all. Warranty to me means EVERYTHING is covered and took care of.
If EV direct is fair, they must match the Warranty in China !!!!
They saw "Mad Max" They know how you Aussie's drive cars.
Would you really want to fight the company to enforce Australian law. How much is your time and energy worth?
This should have been announced up front. The 'oh by the way, forgot to mention that servicing is going to cost you over $3k' is not doing BYD any favours with customers. Bait and switch tactics never really that popular with the punters as it looks really dodgy.
I would say corrupt
Thats too bad. Living in Canada I only know about them through this channel. The car itself must be good or we know the Viking would not have bought one. It seems like they have so much potential but very odd and concerning things in the background. Thanks for catching this!
Save the crap. Just cancel the order. Easy.
Tomorrow I will do a test drive in the Atto 3. Here in Thailand there is an 8 year 160000 km warranty on everything. Wonder if it has to do with the dealer
Ok
They did select the wrong team to represent them in Australia.
So they will milk all buyers in a clever way, count on that
The led lights on my ice pug 3008 are classed as a consumables and not covered by the warranty
BYD Newzealand have the owners manual posted, which includes scheduled service.
Clearly seems as if they wish to use the most lightweight, medium duty hardware and electronics. Likely will also seek to sell extended warranty for those parts like electronics, echoing the worst parts of the ice buy experience. I recall Elon snickering at mention that byd is competition, followed by, have you seen their car? I haven’t, but presume it is like the first Kia. Spindly. Must be priced right to win that segment.
Was tossing up between BYD and Tesla, well this makes the choice much easier.
“I have altered the deal. Pray that I don’t alter it further “
Read the Tesla 'order' (if or when you make one). It allows them to alter everything because it is not a binding 'contract'. Not must different to this BYD debacle ...
Sounds like an ice warranty. Clutch etc.
The truth is that EV Direct - the dealer wants to get more out of the ongoing services. Should lodge an enquiry to ACCC.
Thanks for your warning I was in the process of ordering one
How does this compare to warranty conditions for vehicles sold in China?
BYD distribution in Australia is looking very amateurish.
BYD should punt the distributor and sell direct.
It's a good bet that BYD supports these warranty conditions and uses a third party to keep themselves from suffering lawsuits and liabilities.
For comparison only , byd yuan plus (atto3) in china first owner have battery SOH> 80% ,motor , ECU , Lifetime warranty, other part of car 6 year /150k Km warranty. explain for lifetime warrant, you can only repair or maintain car in BYD authorization repair shop, only thing you can do youself is tire replacement , but same type ,you can change tire brand . and if you sell this car lifetime warranty will invallid ,it become 6 year /150k km whole car warranty. if this car has traffic accident that cos replacement of battery, or motor ,or ecu the replace part lifetime warranty will invalid
There are many middle class cars in six year warranty with combustion engine. Lot of parts to broken in six years. No one give that to consumable parts.
Variable terms like this are pretty normal. Look at Toyota, MG, etc.
The car doesn’t have a clutch or a release bearing. It’s a single speed. A lot of those things seem like they refer to their ice vehicles.
Let’s not assume that this is the last surprise from EV Direct either. I don’t trust them and won’t be buying the Dolphin.
This is not happening anywhere else on the globe.
The whole Tesla car excluding the battery and drivetrain have an incredibly short 4 year 80,000 km warranty!
@@costiqueR Funny that MG is 7 years unlimited km regardless if EV or ICE as is Kia and a number of other brands, remember this is Australia not the states!
@@costiqueR Oh no your in Australia oh dear your warranty sucks MG and most brands cover most of the cars lol fail!

But probably I will buy a new EV after the technology takes the market and prices are more realistic for mass implementation. But, for sure, not in these conditions. I like the Tesla approach. I am in Europe, not States...
Why would an EV have a clutch disc or a release bearing?
It is probably a general list of insurance items applied which is also used for ICE vehicles.
PM 2.5 is air quality. Very important item in China
What's the story in New Zealand? They received their cars before us. Do they have a distributor or do they sell direct to the customer?
Two sides of the coin:
EVs are currently so hot merchandise, that manufacturers think they can get away with it anyway.
Otoh, such long warranty on wearable parts, like tyres, shock absorbers, windscreen wipers aren’t realistic.

Yah. 👍👍
I just hoping that Rever (Thai BYD) will not follow Australian BYD failures.
Well said
This sounds like the actions of upper management desperately scrambling to squeeze out a profit. Nor does it tell me that they have a lot of confidence in the over all quality of their product. I see this as a red flag that not everything is sunshine and roses over there at BYD. Also, WTF is an electric car doing with a clutch?!?!
True Dat...
Reconsidering my investment in BYD. Would bail on this if I were you. Love my Y and glad most of my money is in Tesla❤️
Wow! It would be really good to do a full economic analysis of this car compared to other evs including maintenance, non warranty costs and especially depreciation. First blush indicates a Kia ev would have a significantly lower overall cost of ownership than BYD for a much better car.
MG sound a safer bet?? To become major brand you will need customer care backup!!
Agree, here MG owns the distributor while EV direct is an Aussie dealer group.
just cancel. if everyone cancel, they will take notice. I dont think its a BYD thing but Eagers Automotive. You dont hear the same thing with NZ's BYD warranty
The suspension item carve outs, wheel bearings, shockers, clutch (why does EV need clutch?) display etc are a worry. Australian road surfaces take a heavy toll on vehicles (lots of shake, rattle and roll). Sounds like initial testing may have shown the vehicle is too fragile too support a reasonable warranty under Australian conditions.
Looks like the old Commodore has had a reprieve and will need to soldier on a few more years. At least it is built like a brick shithouse, it's showing no sign of falling apart.
Good point. The road here are completely stuffed. Potholes everywhere. I massive rain events didn't help too 😕
