Kevin Franke civilly sues Jodi Hildebrandt for for Intentional Infliction of Emotional Distress, Negligent Infliction of Emotional Distress, and Negligence. He states that her actions harm his marriage and children. He is looking for monetary compensation which I am optimistic will go to the children's restitution and ongoing care.

Why? I don't understand the animosity. He's clearly a victim of Jodi's abuse and manipulation as well
Because abuses existed before Jodi entered the picture. He agreed with wife regarding children punishments, like making one sleep on the floor, or the youngest of 4-5 in the time not eating in school because she forgot her lunchbox, explicitly asking for school to not give her any food... And what we have heard from his own mouth, he is devoted to his wife regardless of what she done to her kids. He tried to put in jail her eldest daughter for stealing when she went to get some devices for her siblings from their house. He never asked how the kids were, he only cares about Ruby.
Yep, he really betrayed and gave up on his own children. He let them down big times and they clearly need to stay far away from their mother. Which is not going to happened since Kevin clearly plans to become the bridge between her and the kids. Disgusting.
yes, for sure. he was with Ruby before Jodi, and there is reports of evidence that Ruby was abusive towards the kids even bfore Jodi came on the scene. Such a tragic situation.
I am so sick of hearing about how resilient children are. The fact of the matter is that childhood trauma, even fairly minor childhood trauma causes lifelong lasting consequences for someone's social, physical, and emotional wellbeing.

He is a total flake. He was a willing participant in the abuse of these children for years. He admits during his police interview that he thought Jodie was giving them good advice. He willingly followed Jodie's orders and left his family with zero contact. He financed Jodi and Frankie's lifestyle enabling every single thing that took place in Jodi's prison/home.
If any money is won then a trust fund should be set up by the court to where this weak father cannot touch it!
Kevin is all about the money. He is the one who took the bag o money to Ruby's atty. The children won't see that money if Kevin touches it first.
His kids should sue Kevin for all the money he already has stolen . He forfeited his parental rights by allowing his wife and her friend to abuse his children
No the second interview with the police they were trying to find it. It was given to Jodi’s attorney and they were advised that they would have to file in civil court to get it back..
Sounds like you have either missed Kevin's side of the story or willfully ignored it. Kevin didn't just willfully "allow" kis kids to suffer and turn a blind eye. He was separated from his children, isolated and abused by Jodi and Ruby as well.
@Edward-W He never checked up on the children for a year. He chose not to see them for a year. He went after his eldest daughter for removing 3 electronic devices from the house. He abandoned them.

Kevin doesn’t deserve a DIME or to be called a FATHER.
How can he file a lawsuit on behalf of his children when he does not have custody? This is purely for Kevin.
I’d be cool with what he’s alleging except he’s got a not-so-great history of treating the kids horribly well before Jodi came into their lives. He was on camera looking gleeful in 8 Passengers every time they punished the kids. He also treated students badly when he was a college professor.
He was also ok with depriving a teenaged kid of privacy for a long time, making him sleep on the floor in a common area of the house instead of the teen’s room. He also was around when that teen went to a “wilderness camp” that has an awful reputation. Guess who used to work at camps just like that? Jodi.
I’m not buying his innocence act. I was waiting for his move to get the kids back, just like Ruby instructed him to the day the kids were discovered. I’m sure he was waiting til things calmed down in the media.
He acts like he didn’t know where they were, yet he’d met with Ruby 3 weeks prior to sign paperwork for the vehicles. He’s not someone I’d want to get custody of a goldfish, let alone severely traumatized children.
Exactly that…all an act in my opinion; and yes…he’s followed orders to a T, Ruby barked the checklist & he is working through it. I do not trust that man. He’s a gullible fool who’s blind to his wife’s hex, all monies should be tied in trust for the kids & he should not regain custody, didn’t he try having his own daughter arrested ??
@@jrader1524 Yes tried having the oldest daughter arrested when she was at the home getting things for the middle 2 girls who she had temporary custody over.

Did you not see how he was excommunicated and isolated by Jodi and Ruby manipulating and abusing him? He's a victim in this case. Obviously he's not as seriously harmed as the children, but he's a victim nontheless.
One good thing about this being public is it’ll be easier to get help and be listened to. So many abuse victims including myself have not been heard or listened to bc it wasn’t video recorded. I never got justice. And still to this day people will blame me for disconnecting from them 😢😢😢. Do you think any child wants that no. And I still haven’t had proper cptsd therapy.

One of mine is on Megan's List. A repeat offender. I have had lifelong medical problems, related to CA.
I did talk to his probation officer to make sure he knew he was a threat to children.
Let us hope our efforts will help these children build better lives.

I had a similar situation. My mother and step father tried to do it to my children before i realised and got us out of there. I am a very broken person. I had no therapy. These children are going to be very broken even with therapy. They should have all the help they can get. Don't know what i think of the father yet, but the children are going to be dealing with this for the rest of their lives
He needs classes for child abuse and anger management. He needs parenting classes. It is sad as he is not ready to be a parent to these kids but he may easily get custody because he was not in the home at the time and yeah well… the state let’s lots of terrible parents have custody. I hope they will find a loophole so he doesn’t succeed.
I sure hope the judge (or someone for the judge or someone against him getting custody) goes through all the 8 passenger vids, the police cam about wanting his daughter charged with theft and interviews other family members. All of those children have suffered at the hands of mummy and daddy dearest mentally and physically.
The minor children need their own lawyer and sue for all and everything they can get -- from all.
i hope that the court sees through Kevin the same way we do. He shouldn't see a penny of that, all of it should go to the kids.
Kids are resilient but trauma lasts in ways we can't always predict. Some trauma pokes out when you least expect it as an adult. They'll never be able to smell cayenne pepper without the association, for example.

I want him to have seen the light and do better, but the bigger more cynical part of me is worried that he is just taking advantage of this to give himself a "Dad of the Year" award. That the horrors Jodi and Ruby inflicted pale in comparison to his abusive parenting 'techniques' so he is just going to swoop in like a hero now and "save them". I hope he actually is going to be good (if he gets custody, which I'm on the fence about). I hope no matter how it shakes, any money for the children ends up being structured in a way that it goes for ONLY the children. Using this suit to detail HIS emotional damage and ask for money by dropping in that the kids will need it. Jodi is not worthy of the ground she walks, let alone the money she's cobbled away, but that does not mean Kevin should get unfettered access to it "for the children". Regulate the fuck out of it and fight for the safety of the children even if its from their own father.

I agree with you Emily. The children come 1st regarding $$ for their mental and physical care. Kevin is an adult and should not have control over the kids money if they receive any, should he gets custody of the kids. Jodi should not benefit from the sale of her house.
I just think he is a failure as a parent. He did not fight to make sure his children were safe. A year - a whole year he left them. He is not strong enough to be their parent. He called the police on his older daughter. His distress is because he allowed Jodi to bully and isolate him instead of worrying about the safety of his children. Let the money go into a trust not be put in his hands. of

Considering he was with his wife Ruby before she met Jodi, and Ruby was reported to be abusive towards their children back then also, imho, he should have been accountable as well. What happened to the children is horrific, but he is culpable for what was going on before the Jodi days as well. Just, imho. Also, I am cynical, I think he wants the money for himself, but I hope there is something left inside of him that cares enough about the children to put the bulk of the money in trust for them, (if he wins), but considering his behaviour in the past, I have questions... 🤔💜💜
All those families and men should sue Jodi Hildebrandt for malpractice, defamation, and any other torts they can find that she has committed against her “patients.”

Kevin deserves justice too. The fact that he suffered less than his children had to at the hands of Jodi doesn't make him undeserving of help, support and damages paid. He is a victim of Jodi's abuse and manipulation like so many others have been.
Any money that Kevin gets should be in that trust Emily mentioned… I’m a lot more cynical than she is, though. I’m not sure that Kevin can look past his own desires. I’m not sure he should get custody of any of his four minor children. A, J, R, & E, as well as Shari and Chad (ages 21 & 19, respectively) are going to need a lot in the coming years. I sincerely wish nothing but the best for all of the Franke children.

Lots of hate for Kevin in the comments but his son went public saying he’s living with Kevin now and Kevin has really pulled things around. Like the wool isn’t over his eyes anymore.
I’m glad to hear it but this could be temporary until he gets his kids back, I hope he working hard to be a better parent.
I don’t trust the old Kevin Frankie, but if he’s doing all of the personal psychological work and working with the state and DFS I think he should be given a second chance.

Oh, I want Jessi to get some of the money too. What that young woman went through. How her testimony is a huge benefit to this case by establishing how cruel Jodi really has been
It helps Ruby some, not erasing a mother hurting her children so badly, that some of the ideas over how children were abused came from Jodi.
It bites, hearing so little compassion for his children. Kevin just wants to get Ruby back pretending she wasn't done ruining the children.
When he described that his home use to be happy? I wanted to throw things. I've seen more of the family videos and Kevin doesn't spend much time in reality.

I hope Adam and Jesse get financial compensation also. All in all I hope Jodi loses everything and has nothing to fall back on when she gets out.

Were ALL 4 children at that woman's house? The middle girls were well fed and seemingly not harmed. Were they actually at Pam's house? Can/Will Kevin add Pam to that suit? I have so many questions. Good for Kevin for going after Jodi, even though I think he has some explaining to do.
My understanding is that the middle 2 girls were left at home and at times left alone for weeks at a time. So not good but in comparison to the younger 2 girls not harmed at all.

She might be a psychologist but she's not a psychiatrist. If she was a psychiatrist is a medical doctor and they would have been writing her up as a Dr hillenbrand. If she is a psychologist then she's at the very most would be up to her masters because if she got her PhD as most due once again they would be calling her doctor Hillbrand.

I hope to hell that Kevin does not receive one penny and that any restitution paid goes to the children that were harmed. I also hope these children are getting actual, helpful therapy outside the LDS Church. That's the only way they're going to move forward towards any healing imo.

I believe that Kevin Franke is earnest, once you hear the other stories, you too might believe him.
There could be psychological damage to him. How would you like to go to sleep and wake up in the morning knowing what was done to your children. That could haunt apparent. And it was brought on by Jodi and her friend. Plus he will, if he gets custody and work full time probably need to get someone to take care of them during the day because they might be scared to be alone scared that their mother or her friend are going to come back and get them. These kids might need 24-hour care. And he would need money for that. So it could be said that she is causing economic hardship to him if he did not think he would have to have 24-hour care for the children. Just guessing
I'll write it again. Kevin is a mandatory reporter. People all over the world, 18,000 of them told him this is CA.
He needs to be prosecuted for breaking the law by not reporting it. If he wants any sympathy he needs to come clean to his children about the role he played in their being abused.
Jodi and Ruby, add Pam in there too, wouldn't have been so bold if they didn't feel confident, Kevin abandoned his children. That is what it is called Kevin. He doesn't like that term but he accepted terms, as a father? He didn't have the rights to do. No birthday calls, Christmas not even a lousy card to any of his children. Had no idea where they where. He cannot put all of that on Ruby. There was no legal agreement or formal custody agreement stating only Ruby was responsible for their well-being.

I think he will get his kids back. So far, there has been no evidence that he knew what was going on. Unfortunately, he believed he was doing right by them, and their mother was taking care of them.
@@erinbisson918 He knew what was happening during 8 passengers though and was fine with it. Compared to what Jodi was doing that was nothing but by most standards that was an abusive situation and bad enough that Shari went no contact as soon as she left for college
Kevin shouldnt have custody of the kids whatsoever they should go to the grandparents or trusted family member thats stable and has 0 social media. Those kids are going be traumatized for life and shouldnt be with a "father" who failed to protect them. Also if any money is gained it all should be in a trust where when the kids turn 21 they can have the money to support them in their care or help with other expenses.
He was wronged too. I think he should have concentrated on that in that lawsuit… the 13 months away from is family and the implosion of it!
