I returned them asking for a like for like replacement (as I actually liked them). The retailer did exactly that and I have had no issues with the replacement at all in the five years I have worn them.
Sometimes stuff happens, something slips through the Quality Assurance, I am a firm believer in giving retailers a second chance.... But, and this is an important but..... I will not give them a third.

What seems to be a growing problem are collectible items (for example a model aircraft engine) are sold and the customer subsequently returns the item for a refund. When the parcel is received and opened it contains a chunk of concrete or half a brick. eBay and PayPal aren’t interested because the “item” was returned.
Another thing that is happening (commonly with a certain carrier,PB) where they claim items are “contaminated” and must be destroyed, they later turn up on eBay, often with the original photographs.

@steve5772 Generally, I have had a good relationship with everyone on Ebay. For example, I bought some repeat items and found they were not identical, the seller replaced them without asking for the old items back, which I had offered to return. On the other hand, have had "working" items that did not work, "new" or "unused" items which had clearly been unwrapped and stank of cigarette smoke. Please don't misunderstand, these were a very tiny minority among many kind sellers. Biggest problem on Ebay or the "big river" company is the delivery drivers. Either they claim to have tried to deliver and said I was not in, when I was waiting for them and even saw them drop in a card stating their supposed inability to deliver the item. On other occasions, they have left the item in a "safe place", but failed to inform me, or the person I was sending a gift, where the item was, thus leaving the recipient open to a charge of fraud because the item had been "delivered".

They destroyed the house inside, had a rabbit that crapped all over one room, let a leak in the upstairs shower ruin the floor, carpet and ceiling, left cigarette burns in living room carpet. It was a mess that left them demoralised and infuriated. They now only rent to workers doing short term jobs from different parts of the country, using a intermediary. No damage, no stress and they pay on time.

@@Valehass It depends on where you look. Some of the "news" pages that pop up when I open a browser are heavily one-sided towards the wealthy and the landlords and will bring up the dark sides of tenants. On the other hand, the same "news" sources seem to be totally unaware of issues that are in the news, on youtube or the internet, esp. those stories that show bad landlords and poor treatment of tenants. I am sorry for your friends and I agree it must be a nightmare for them, but I have also worked with people who need housing and who have had real problems with private landlords and unaffordable rents. To be fair to your friends, I believe that tenants agreements should include protections for the landlord and the property. Perhaps everyone should have to provide a bond or indemnity which is forfeit in the case of damage to the property. If tenants had to provide reasonable identification, the problem of tenants who run could be dealt with, at least in part, by a database which would identify such unreliable tenants and which would prevent them from being able to repeat their behaviour.
On the other side, landlords should ensure the property is up to a liveable standard and that tenants can't simply be evicted without good cause.
The problem with housing is that everyone has an anecdote about individuals, but the housing crisis is a national one, such that there are too many empty properties and too many homeless and not enough will to solve either problem. Remember that some MPs complained about increasing benefits and about benefit claimants but failed to disclose that they were raking it in as landlords to benefit claimants. When some people are making money from the suffering of others, there is no reason to sort things out.

Dumping a parcel on someone's doorstep and taking a photo before walking off isn't delivering the parcel to the named person at said address. Hermes and Amazon do just this! The majority of my Amazon parcels are left on the doorsteps of other houses on my street or, if small enough, posted through their letterboxes. Thankfully, I have always managed to track down my Amazon parcels and, to date, nobody has stolen a parcel that was left on my doorstep by Hermes (thankfully). Royal Mail is pretty good, although one time I ordered a Canon Flash for my DSLR from Curry's and Royal Mail delivered it to a house across the road! Curry's didn't want to know. That nearly cost me £150! I raised a complaint with Royal Mail and they sent the postman back to my house later that evening, who managed to retrieve it from the address he delivered it to (it had been opened).

It's happened to me a few times. I would never lie about something like this because I know it is dishonest and stealing. The police should be prosecuting this, but as usual its easier to police people's thoughts and speech than actual crimes like theft, or fraud. It's no wonder so few people respect the police. If the police do nothing then the traders should work with the card and delivery companies, and start blacklisting the people who do this, so they are unable to buy anything online.

I had a brand new XBox get delivered to the wrong address because drivers relied on their GPS rather than reading road signs. I was on the phone to the seller and stated I would absolutely phone the Police after the call to report theft if they didn't find out where it had gone. There was a knock on my door and the person who received my parcel was delivering it to me instead. They were genuinely embarrassed, but I was given yet another reason to have faith in humanity restored. Most people are honest.

    • @charleshayes2528
      @charleshayes2528 Год назад

@EgoChip I agree that some people genuinely do not receive their packages or are not informed of where they were actually delivered. But admitting that immediately creates a problem. If the police did investigate, how would they be able to tell if I am someone who honestly did not get the item or that I am someone who is lying? If the delivery driver is capable of lying about their own dishonesty or incompetence, they are capable of lying to the police. Even if the police search my home and find nothing, that does not prove that the item was not delivered. Even if the police suspect dishonesty, they cannot claim I stole it if they cannot find it. They are not likely to want to search entire homes and outhouses, just in case an item was misplaced, nor are they likely to be able to demand that all the neighbours allow their homes to be searched.
If the traders do decide to work together with the card and delivery companies, how will they distinguish the honest customer who never got their items from the dishonest ones who only claimed they did not? Finally, my experience is that the delivery companies, themselves, will do anything to hide the failure of their drivers, even to the extent of changing the name of their company or preventing customers from reporting poor delivery. (A certain company named after a Greek God has reinvented itself and has done so repeatedly because their performance does not improve.) The same thing applies to some big companies that employ their own drivers, they are not necessarily going to admit to failures in their system. For example, I can no longer review books from a certain online bookstore and marketplace because I pointed out some potentially fraudulent behaviour in my reviews. I was in the right, but the seller removed all my reviews and not just the few offending ones.
I would love to see the problem solved, but how are the customers to prove their honesty and how are the sellers to ensure they do not punish the innocent?

They must refund standard shipping costs that the consumer originally paid when purchasing the product (if you paid extra for an upgraded shipping service, they don’t have to reimburse you for that). Many retailers say they won’t refund shipping costs and customers often fall for this misleading information as they don’t know their rights, but retailers are legally obliged to refund original shipping costs. I have been asked to raise an issue with a specific driver (of a very large company) and have refused when it was clear that the driver did not have enough time to wait to hand a package to a member of staff in a building without a letter box. In that case, it was clearly the company that was at fault and not the driver. In the case of drivers who turn up and drive away without even attempting to deliver, I am fully willing to pursue the issue. On one occasion, I contacted the very large company - who were subcontracting the delivery firm - and was specifically told "We will not use this firm anymore!". The result? The next two deliveries were from the same company via the same delivery firm and then the delivery firm changed its name. They do not care about the individual customer, even if they are a loyal and repeat customer and their staff clearly do not tell the truth - or, more to the point, do not have the authority to act on complaints. They are not there to help, but only to fob people off.

There are a few occasions, however that have caused some concern when I have received notification of dispatch, but the tracking for sometimes weeks after shows no sign of the goods.
If a trader on eBay, for example, prints a postage label, the system immediately marks the item as dispatched, whereas it may actually remain in the trader's depot or not even exist at all (perhaps due to being out of stock).

The police have followed up hundreds of thousands of "non crime incidents" (possible over a million by now) and seemingly no accusation of alleged "hurty words" goes unpunished, even though they do not cross the threshold of being criminal offences.
Yet they don't have time (seriously, the fact is they can't be arsed because "insurance will cover it anyway" - ( quote a relative detective sergeant)
If a car is stolen - the "victim gets reimbursed so "why bother".
And it's not just the polcie but the CPS and Judges who appear to bend over backwards to find reasons not to prosecute / convict.

What I find interesting about the balance of probability is that it doesn't make logical sense. For example, I was cycling to work many years ago and was hit by a pickup truck which didn't stop as it approached the roundabout, I was cycling past the front of the vehicle and it hit me. I could see it wasn't going to stop as I passed the left turn off from the roundabout but was going at a speed which meant if I braked at that moment, I would have halted in front of the vehicle and I couldn't speed up enough to clear the lane, so I knew the vehicle wasn't going to stop and I was going to be hit, then I was.
I was in hospital for just over a week, off work for a couple of months, then lost my job due to my injuries meaning I couldn't do the job properly anymore (the company made this clear to me as to why they were sacking me, but said they obviously couldn't record this as the reason, and I agreed that they were right, I couldn't do the job now so they were paying for another member of staff to be on shift with me just because I couldn't do the job and as a small, new company they couldn't afford to keep hiring someone just to be on shift with me to do my job).
I decided to sue the driver, so the police, who closed the case at the scene when I was put in the ambulance, lost my bike and the notebook of the officer at the scene, reopened the case when I told them I'm suing the driver.
They did an investigation and found the driver guilty, yet my solicitor said that we should accept some liability because it will look good to the court. I said that if the driver has been found 100% guilty following the police investigation where we were all interviewed under caution etc, then a civil court where it is based on probabilities should be obviously 100% as well, but the solicitor disagreed, which confused me.
The criminal case had things like the driver saying the passenger said look out, bike and that I came off the pavement in front of his truck (which, given where in the road my bike was hit would have meant I would have to have turned sharp right, cycled out into the roundabout then sharp left to be in front of the vehicle), the passenger said he was asleep, heard a thud on the bonnet, opened his eyes and saw a cyclist being struck and said look out bike.
I stupidly wasn't wearing hi-vis clothing and it was dark, but I did have reflectors on the wheels, and front and back of my bike and front and back lights.
The solicitor said I should accept 30% liability for not wearing bright clothing, so that they can knock it to 40%, and that I have the right to challenge this for more money but a judge will then see me as being greedy and could throw out the case and it's no win no fee and because I received an offer and rejected it I would be liable to pay the fee myself, so they strongly advise I accept any offer made to me, which is what I did, they named an amount and said this is 60% of the amount they would put forward as the payout and I accepted it. Mainly because this had gone on for two years by this point of me every week thinking about, talking about and filling in forms etc about the accident and I felt if I accept I can finally put it all behind me. But it did confuse me that the police can find someone 100% guilty, yet they are only 60% guilty in a civil case...

Dear BlackBeltBarrister, your police force is not underfunded.
They simply need to reallocate some funds from "taking care of hurt feelings due to words on the internet" to actual crimes, like theft, consumer fraud and all the worse crimes involving coercion and violence.
Sadly that will not happen because the people you can prosecute for "bad words on the internet" are a lot more English than the people you can prosecute for actual crimes.
So their crime-statistics would become "less English" and a lot more diverse, revealing a very sad truth to British public.

Maybe I'm replying too early in the video but what evidence is proof of delivery? Before covid a signature was required but then it seems that was skipped. Increasingly I'm receiving parcels for a neighbour and apparently my neighbour is alerted but is that proof of delivery? Often we find parcels are left at our door, in a hedge, or on some occasions in a recycling bin. Are those delivered? What is stopping someone else taking those items or the bin being emptied by the council? A good solution might be to require delivery drivers to wear a body camera and record the moment the parcel is handed over, if handing over is not possible then the parcel is taken to a collection point.
Now I'm far from saying that there are no customers who commit fraud but surely you'd think delivery companies would make sure they have the evidence that they did their job.

Agreed. The police have more than adequate funding, how they spend that money and which crimes to prioritise is their biggest problem.

Isn't easier and cheaper to issue a small claims against the fraudster? This prosecution mechanism sounds very expensive.

That is what I would do, prosecution might have a greater effect on the fraudster, but it does require more effort.

This exact thing happened to me on an eBay sale. Even though the tracking said it was signed for the buyer filed a not received claim and I lost. They had it up for sale on their eBay days later. eBay won't do anything.

I was watching a video very similar but opposite, the seller makes many excuses why the buyer has not received the goods, and stretches out to 60 days which is the maximum the banks will allow for refunds, and there’s nothing you can do about it

If i spent all of my time playing video games i wouldn’t have the time to clean my house, cook meals and keep the garden tidy. This is not a question of insufficient time & resources, it is a problem of time management. Similarly, if the police spend their time policing the internet and censoring speech, they don’t have time for investigating crime. It’s not lack of resources, it’s their preference to allocate resources to specific areas that is the problem for us- the taxpayers.

That's simply untrue. There's a standing cost for each function and insufficient funds to pay for policing and the court service.

The issue is that any kind of proof of delivery is likely not good enough evidence - The door was green and it was signed for by Squiggle, when you know the driver went no where near the delivery address... You need to have pictures of them with the goods, you provided, not just similar ones, to prosecute
