no they're not , the tenth amendment gives states the right to write and apply , enforce laws ,,,,,,, free speech is NOT absolute, there are conditions, our right to free speech and our right to film is protected by the constitution in a TRADITIONAL PUBLIC FORUM and in a DESIGNATED PUBLIC FORUM
TRADITIONAL public forum = sidewalks, streets, public parks , plazas, alleyways etc., outdoor public areas ,,,,but that right is stimm subject to time, place and manner restrictions , we cannot hold a political or religious rally/debate at 3am (time) on a residential street (place) using loudspeakers/amplification (manner) ,,,, DESIGNATED public forum = a space/area specifically reserved for free speech , and again there are restrictions that can be enforced and they do NOT violate the first amendment ,,,,,Rights are NOT absolute...

I will say honestly, though, that you weren't in my top 10 as far as the auditor/copwatch/government accountability videos community. I felt as though your disposition when engaging with cops was just a bit too aggressive for my personal taste (although admittedly, I do enjoy a good verbal beat down from time to time). But I gotta say, this format you are doing now is really good. You are a good, articulate speaker with the ability to break things down analytically but also understandably. Just a suggestion, but you should definitely keep building on that natural talent of yours. You would do well hosting a well produced show. 👍🏼

There are four tenants of speech .
    1) The right to speak.
    2) The right to listen.
    3) The right to not speak.
    4) The right to not listen.
In public if you do not wish to hear another you can simply walk away, however if you cannot leave and are forced to listen, the individual speaking is guilty of what is know as creating a “captive audience” (see captive audience doctrine).
So when you are officially detained not only do you have the right to remain silent but you have the right not to listen! You are under no obligation to assist a cop in an investigation against you so just advise the cop to shut up! Inform the cop that you have the right not to be forced to listen and that the cop can say whatever the cop wants the moment you’re free to leave!!!
Notice that in this video the cop kept the individual in cuffs and was forced to listen! You can even hear the cop mention that before he let the guy out of cuffs and understanding had to be met! These cops broke multiple laws!

  • @dianarockwell6256

This guy wants his victim to feel sorry for him because he’s responsible for security in a building. And he’s got wussy working in the building who are afraid of a man with a camera who’s never threatened anyone with anything but the laws that they are supposed to enforce. In the same conversation the victim says you’ve got four guys surrounding me with guns and I don’t feel safe. The answer was that’s OK but no, you need to feel sorry for us because you’re such a big bad man. They can always victimize a victim even more they must take a class in it.

keeping in cuffs after he found out he is wrong, pisses me off more than the cuffs in the first place. Now it is kidnapping for sure because he knows he can not arrest him.

All that safety nonsense is so bogus.
Does he make absolutely sure that the police officers in that department don’t cuss?!? Oh, wait, I forgot about officer discretion.
Laughable. No matter what, they always gotta shove in that last little veiled threat orrrr not so veiled.

    Marbury v. Madison 1803
“A Law repugnant to the Constitution is void.” With these words written by Chief Justice Marshall, the Supreme Court for the first time declared unconstitutional a law passed by Congress and signed by the President.

    Playing excessively loud music.
    Throwing a large, noisy party.
Shouting obscenities, offensive words or slurs, or fighting words.
Getting into a physical (or a loud verbal) fight.
    Public intoxication
These are arrestable offenses. Frauditors think the first amendment gives them free reign to do whatever. Wrong again

I worked for the Department of Welfare and spent 1 YEAR in training at the State ffdice Building learning the laws and procedures of the department. Then another several MONTHS part time in a field office learning additional laws and procedures under the tutelage of a supervisor. But, If I'd become a cop, I'd train for 6 MONTHS and then be turned loose on the public.
