It appears that when the NPCC guidance on public photography was reissued, because it was ratified by the Home Office and the College of Policing, the MET senior management team were obliged to endorse it. In reality they were most upset and tacitly approved all the excessive challenges including the Sec 43 searches. However due to the number of successful civil actions and the IOPC giving them grief they changed their strategy. The " unofficial " policy is to now to suggest the bloggers behaviour is not normal or is strange, this is designed to create an atmosphere of suspicion and provide justification for the intimidating searches. You will see that all the newer " audits " on MET police station start with the challenge, your behaviour is not normal or don't you think you are being a bit strange ? are you on any medication ?. The implication is the blogger is not mentally proficient and thus adds further credence to the need to question and search.

They leave a police book in the front windscreen as a get out of jail card. So unless they are attending a crime scene at the police station, they aren't on any operation. To see a more typical set up look on Google Street view. 8 Parked illegally and one from Southwark council too boot. If you also look, they aren't going to be using meeting house lane as a means of getting to a crime scene so the fast getaway doesn't add up. Too many parked cars and speed humps. It starts by you telling them that you cannot ask any questions because you are a private security consultant and expect to get paid for your services. You then say that if they wish to continue with the encounter you need to know their names and addresses for the invoice, this should get rid of them. In the unlikely event that they say they want to continue you can then say that your standard charges are say fifty pounds for admin expenses, then at ten pounds per minute. It is possible that they will not understand this or take you seriously but since you have told them that this is a condition of continuation and that continuation assumes acceptance of the contract they have no way out, in civil law the contract stands, you can them send them the invoice and if it is not settled within the specified time, say thirty days, you can launch a claim in the small claims court, if they fail to respond the court will judge in your favour and you can then go to the police station they serve from and insist that they are suspended until the claim plus all reasonable costs is settled in full, based on the fact that all of them sign the same contract terms that forbid any of them from service while in debt!. All of this is civil action, completely separate from criminal law. While all of this above is rather speculative it does at least offer one more way of resisting the tyranny. This poor deluded individual is unable to understand the difference between perception and reality, this is very much embedded in our culture now and is not entirely his fault, more a matter of defective training, the people that are responsible for that are also sadly deluded. The careful and patient way you explain all this to them is just the sort of work they should be paying for.

Section 43 of the terrorism act only applies if the officers have reasonable grounds to suspect someone is a terrorist. If they do, they have a right to search. Filming a building openly is not reasonable grounds.
Don’t forget… 1) BWV advising is the Law (GDPR) not just policy. 2) Ask why they’re not wearing their hat? …as per uniform policy 3) Ask why they’re talking to you with their hands in their pockets?… against policy 4) The best answer to “why are you recording” is … “I can’t draw very well” or “the same reason as you… evidence”. 5) Ask them why they didn’t fully identify. 6) Ask the name if their Superintendent (it makes them worried, and more careful about what they do).
