There is no statute I'm aware of that mandates when funds from a non-profit have to be disbursed. Unless someone is using the donations for other purposes, there is nothing wrong here. The optics are awful and I sense negligence at least, but it's his money to do with as he sees fit within certain parameters. He can give it away when he's damned good and ready.

Here is my hypothesis: Jirard cares way too much about PR and how people see him. This is based off of interviews he's given. He would never risk his reputation and steal the money. On the other hand he would be way too scared to admit they messed up. So I think they ended up in this limbo. Where he said "if I don't do the fundraiser someone might notice! While also saying since we F'ed up I need to make sure it goes to the perfect foundation!" Then another year passed and another and each time his anxiety about the issue grew and he felt the foundation had to be even more perfect. Of course since there is nothing perfect he could never find it. The other possibility is that his family stole the money. They run the thing together so there is no way he only talked to his family about the funds he's raising last year. It's more likely that he discovered some one was pocketing the money last year and has been panicking since then.
