      So, guilt couldn't be proven to such a degree that her ultimate intent was to murder the victim.
      Obviously there was intent, it existed of course - but to what degree and for what purpose specifically? That's what it comes down to, at the sentencing hearing.

      Double jeopardy is legal. It's included in and guaranteed by the fifth amendment. And prosecutors can appeal. Sentencing and conviction are not the same. Conviction is the determination of guilt. Sentencing is the punishment dispensed upon a guilty verdict. In the same way that a person found guilty can appeal their sentence and ask for a reduction based on legal grounds. Prosecutors can appeal and ask for a harsher sentence based on legal grounds. There is no trial in a sentencing appeal but simply a hearing. The person's guilt or innocence isn't in question. Only whether or not the punishment was adequate. And either side can appeal the sentence. It's rare that the prosecution appeals, but it does happen occasionally. Information about the fifth amendment, double jeopardy and prosecutorial appeals are easy to find in a google search or your local library. So you don't have to take my word for it.

      I did some research as to why this happens, but do not take it at face value, I am not an attorney. It depends on the state the crime was committed in, but if we are talking California then the sentences can vary wildly as they look at the individual's criminal record, level of intoxication, circumstances surrounding the crime and many more factors can come into play when prosecuting them. Like repeat offenders get a harsher sentence than a first time offender, obviously. I'm not saying this Karen got the appropriate sentence, but since there was no (substantial) evidence other than eye witnesses i assume, they couldn't charge her with aggravated assault. If they would have, she might have gotten out scot free due to a mistrial. This is cause eye witnesses are solely used to established facts, and not taken at face value anymore. Of course this is just speculation cause I haven't reviewed this case, but it is how I think it went down

    At this point, wtf does justice even mean, cause we don't seem to be living up to that??🤦🏾‍♀️ 6 years is a slap in the face, it's disgusting.

      @How Why Premeditated is her making the conscious choice to chase this man down and ram into him at 90 mph. While he was on a motorcycle and she was in a large car. That was thought and deliberation. "Premeditation" doesn't mean she spent 5-7 business days deciding she was gonna kill stranger who cut her off. Premeditated murder can be and has been murder decided upon in a matter of minutes. The second she made the (sober, sound minded, and deliberate) choice to CHASE SOMEONE across two freeways and four lanes of traffic, it stopped being a 'heat of the moment" reaction. Not only does your weird comparison not make any sense (if someone hits you, they're an agressor who is also breaking the law. NOT the same as someone passively cutting you off in traffic wtf??) If someone punches you in the face and walks away and you grab a shovel and chase them down four city blocks to murder them, how tf is that a "crime of passion"? You seem to just be making up neat and tidy nonsensical hypotheticals in your head like they'd appear on a fictional crime show.

    • @schoudh
      @schoudh 3 года назад +7

      @How Why Premeditation is when an individual contemplates, for any length of time, undertaking an activity and then subsequently takes the action. It can be as short as, a few seconds, deciding to pick up a hammer to hit someone. First-degree murder is decided by the state, but it's usually the intentional killing of another person by someone who has acted willfully, deliberately, or with planning. She deliberately hit him with that car. You could argue she didn't think it would kill him, but that's really hard to believe since the victim was on a motorcycle. I am pretty sure the prosecutors just wanted to get a conviction they knew would 100% stick.

      Oh so the fact that the navy guy road raged and kicked her car, damaging it, then RAN is completely ignored. So her wanting to catch the guy who just kicked her car and ran away because he knew he would get fined and possible jail time if caught, this makes her a murderer? Something else to consider, they make it out like she dragged the guy for miles. It was 300 feet at 80 mph. Thats not very far at all. Im sorry, I feel bad for the guy dieing but this was his fault. This is todays motorcyclists attitudes. you piss me off, I take out your mirror. It wrong, its illegal and it should never happen under any circumstances ever. Dont get me wrong, she had some blame in this to but Im not sure it was cut and dry road rage on her part. This should be a lesson to motorcyclists everywhere. road rage and possibly lose your life.
      You know whats ironic here. If the guy had lived and been severely disabled after this, This woman probably would not have gotten any jail time because of him road raging and damaging her car in the first place. Sorry, I have little pity for motorcyclists that do this kind of thing.

      I'm 65 and I've been driving - in several countries - since I was a teenager. You can bet I've encountered plenty of idiot drivers. Yet I never felt I had any right to chase after anybody and run them down. SHE hit him and pushed him and his bike 300 feet down the highway at 80mph BEFORE he crashed. If he did something to her car then she needs to call the police. She didn't.
