- When you get married , you give consent and Will not only for Sexual Relationship- it's also Husbands have to take care and accommodate wives Financial, House, Cloth, Food etc too. Can Husband withdraw his consent & will what was given at the time of marriage to wife?
Many cases Husbands also have to accept wives desire for sex without his will, under threat too? Does we term wives a #Rapist ? Then terming only Husband a #Rapist Unfair & Injustice. As per IPC 375 If a man withdraw his consent for marriage after having sex then it's a crime he will be termed as rapist.
When a man can't withdraw his consent for marriage after having sex then How a woman can withdraw his consent for sex after marriage?
Wife have to fulfill sexual needs of husband she can't withdraw her sexual consent.

After this law..every husband goes for a consent memo before his wife for granting permission for Sex..with date and time …other wise if they have fight in between in future she may be file complaine that on particular date I didn’t gave a consent for sex but he did..so arrest him…her revenge is completed..
Even that consent form is won't be accepted by courts.

If a man doing forcefully sex then it's only a domestic violence not a rape , how can they say it's rape, why girl Marry him if she don't want sex never with him . Never a girl say "yes" first for sex always she expect that men's start first and then if then after some days girl filed a case and say my husband raped me , although it's doesn't matter for her that's she already having sex hundreds times with him before .but blind court defined it's a rape . People are raising points about the potential misuse of the law. I think that is secondary. The very foundation of this case is shaky. As Justice C Hari Shankar said -
"It would be artificial to assume that the degree of outrage felt by a wife who is compelled to have sex on a particular occasion with her husband, despite her unwillingness, is the same as the degree of outrage felt by a woman who is ravaged by a stranger against her will.”
It is really as simple as that.
The approach of the petitioners wanting to 'criminalise' marital rape is to penalise the husband rather than give justice to the wife. The wife has many remedies for justice.
Such an approach has no practical utility. It emerges out of spite.
In fact, this gladiatorial approach of the people supporting the removal of the exception is highlighted by Justice Shakdher's words. He wants the husband to face the 'full force' of Section 376. This exercise was never meant to give justice to women.
Also, most Indian women consider forced sex by the husband to be an inconvenience while rape by a stranger is something that destroys life. It is simply incomparable. Feminists may scream their lungs out but that distinction will remain valid. In fact, I think this immunity to rape charges should be extended to non-marital romantic/sexual relationships as well.
