Delhi High के दो जजों की बेंच इस पर एकमत फैसला नहीं दे पाई. इसके बाद अब मामले पर Supreme Court फैसला करेगा. पूरा मसला ये है कि शादी से पहले किसी महिला के साथ जबरदस्ती करना रेप है. लेकिन शादी के बाद पत्नी के साथ जबरदस्ती करना रेप नहीं है. पूरी बहस इसी की है कि क्या शादी के बाद पत्नी से जबरदस्ती शारीरिक संबंध बनाने को भी रेप की श्रेणी में रखा जाना चाहिए. Marital rape should be criminalized, yes. But in all practical purpose, it is never possible to prove if an intercourse between the couple was consensual or non-consensual. Will you put a camera in the room? Or will you sign stamp paper before each intercourse. It is technically impossible to prove that the intercourse was consensual.
So unless and until a logical abd reliable method is there to deduce the authenticity of an allegation, this law can never come into existence. Bcoz in today's day and age where there's so much matrimonial tension, just the word of a wife can't be considered as a substantial proof to proceed in such a case.
1. What happens if wives keeps on refusing to have intimacy with their husbands again and again repeatedly...
2. What happens if wives initially gave consent and later denied it and wanted to send her husband to jail.
3. What happens if false cases being filed...
