"Hold them accountable"?
Accountable for deciding not to shift into low gear at the top of the grade?
Accountable for deciding not to use the two runaway truck ramps he passed?
Tell one of the burned or injured survivors that you're proud of his reduced sentence.
I'm thankful that his time was reduced BUT the sentence for a truck driver in Indiana who was under the influence of BOTH drugs and alcohol and also resulted in the deaths of 4 children didn't get as harsh of a sentence as this drivers reduced time. Our justice system needs to review penalties for crimes to insure fair sentences. This driver didn't intend to harm anyone and wasn't drinking or on drugs. I don't know if he knew he had brake issues before the runaway truck ramp OR after, but figuring that out would be the difference between deserving some prison time or none. If it was after then any prison sentence is unjust.
@StayMad Loser Tim is saying it's wrong that this guys sentence is longer than the intoxicated guy.
Truck drivers MUST be held accountable for mechanical failures. If they are not they would not be as careful (about their brakes).
10 years is probably a little lite. But he has to live with what he did. He passed 4 runaway ramps and killed 4 people. All because he didn’t want to be out of work for a few weeks. I think if he does all 10 that will be ok but he will likely be out in 5
There was a case in the Tampa area where a street racer hit and killed a pregnant woman. He got 24 years. If Mr. Madero was knowingly going 85 in a 40, I'd argue that this case is analgous to the street racing: they are both inherently dangerous.

It's easy for people to speculate on what a person should/could have done in an accident situation in which they are not involved. It is quite a different thing to be in an accident having to make split second decisions, that may or may not turn out to have been the best upon looking backward at the outcome. I've had the unfortunate experience of being in accidents that involved equipment failure or other conditions that were unknown until moments just before impact. There are so many variables and very little time in any immediately impending/possible accident situation (especially at highway speeds where unknown factors such as equipment failure are in play) for someone to be able to pinpoint, analyze and make the best of all decisions to preserve life and property with few if any seconds before impact. Looking back and being honest within my own heart as I can be, my last thought before any accident was to hold on for dear life, and pray everyone will be okay...vehicles can be replaced but not life or always health

@NBCNews Mandatory minimum sentencing DOES NOT give power to the prosecutor in general or in this case. In fact, the DA petitioned to have a lesser sentence. Mandatory minimum sentences gives power to a legislature, who are generally uninformed of the complex criminal justice system.
This is actually good news for the victims families because now the state of Colorado is liable for the civil lawsuit
@Mot Goaiu What he doesn’t speak English I know that already
Wrong. The prosucter is the one bringing the charges. They know they have a certain minimum but sill tried to charge him with 40+ counts. The prosucter is the one that makes up plea deals and has the power to agree to them. They also have the power to reduce charges aswell.
Mandatory minimums always shift power to prosecutors. The DA petitioned to have a lesser sentence only after the backlash she received . Prosecutor’s charging decision often dictates a sentence that a judge is powerless to avoid. Your statement about power to a legislature makes no sense.
Did they explain why he didn't use the runaway ramp?
That's good common sense, how about the Dot inspect the carrier and file charges on the owners for not being compliant with safety violations

As a truck driver, this young kid (23) had no business behind the wheel by himself. Some companies don’t let fresh drivers behind the wheel until a veteran driver drives with them and signs them off. A co worker of mine flipped a truck because he lost all his air on a steep mountain, the person he was with didn’t ask if he knew how to drive downhill and the driver didn’t say he didn’t know how. And Everytime the car just gets in front we have to brake again not giving time for the brakes to cool down while using the engine brakes. And gets hot really quickly whick willead to brake failure.

If he was licensed to drive that truck, he had to pass a test on the safety laws. He was well aware on the speed limit for trucks that big and for him to be speeding at all is the problem. If he wasn't going well above the speed limit, his brakes failing wouldn't have been an issue. He would have been able to react faster.
I watched a video that showed all the signs (going up the hill) and then coming down it that warned of the dangers ahead. He didn't speak English very well so that's partly to blame. Absolutely agree! He should serve at least 50 years (for 4 deaths). Due to his own negligence!
I huge problem with the way that the legal system works is that you can get charged for so many very similar crimes in concurrence for example. so instead of a manslaughter case having a reasonable 8-12 year range or something, the way the charges are levied, a crime could be 5 or 486 years. And there's no real reason to it besides the desire for the prosecution to be able to truly smother whoever they choose to.
And in this case, it wasn't even more his fault than the company neglecting to maintain their trucks. So it really should be less than 10 years AND the company should get a massive fine. But in the US capital always wins and the poor always lose.
Absolutely wrong! As the driver, it was 100% his responsibility. His responsibility that his equipment passed his check list. His responsibility to know the laws in the state he's driving in. His responsibility not to end four lives with his gross negligence. Walk a mile in the victims families shoes before you ignorantly make statements belittling the value of life lost.
