It’s illegal. Pence as VP doesn’t have the power to do anything to EV votes other than count. The republicans tried to pence to accept false electors. This would have meant that certain states would have had dueling electors. Which would have had put pence in a position to choose which electors mattered and which ones don’t. But pence had another issue. He has a conflict of interest because he is a candidate in the election. He can’t push an election in his own favor

What Pence was asked to do was not a legal issue it was a procedural one. Pence is the one who say's if the votes are proper. If he thinks they are not he can call them in question throw then out. He can also make a determination which competing votes to use. It was totally with in his power to do so. If the votes are called into question then the senate can have the question sent back to the states for legislature to reconsider the voting.
This what the MSM has left out that 99% of the people were there to support Pence in doing his constitutional right to do. They have 300 people they want go to trail on minor crimes. When there were over 100K there for peaceful reasons. They sat outside while instigators where trying to insight the crowd to storm the capital. They instigators were called out for being plants. None of those people are under arrest.
Was Pence a wuss yes he was for not pushing for a fair election. and standing up for the voters. Because the only people who could do it was Pence and Trump. They had a duty to insure a secure election.
No he can’t. Once the states send their certified EC votes to congress to be counted it’s all but over. Pence does have the ability to choose which EC votes matter and who choose ones don’t. The 12th is clear on that.
Pence also has a conflict of interest. He is a and donate in the the election. He can’t choose electors to favor himself to win an election. If that were the case no president seeking re-election or VP seeking the presidency would lose. No state sent dueling electors and to date not state has shown widespread fraud. Trump lost and lied about the powers the VP doesn’t actually have.
