    I'm gay af. Certain things about me are stereotypically gay....i work in fashion, I like Madonna songs...whatever.
    And growing up in the 80s, certainly everything i saw and heard should probably have convinced me not to be gay...IF that were possible! But it's NOT!

      We're still sadly having these conversations because people like Ben lack emotional intelligence and imagination like normal human beings. The lack of empathy and being unable to imagine a different lifestyle outside their own or even to self-reflect enough to recognise aspects of their own lives in others means they can't grasp anything beyond their own tiny experience.

    I'm gay but I'm a little behind on how to "behave" gay. Maybe there's a manual for that? I mean apart from maybe nailing someone in the ass, I can't see how 'behaving gay' is anything other than just my normal behavior. Driving a car, buying groceries, drinking water? Is that gay behavior?

    His rant about homosexuality being "behavioral" and "not being an objective state of the world that is visible to everyone else," and subsequently coming to the conclusion that therefore gay people should not be a "protected class," is very strange. By that logic, the right to practice religion shouldn't be enshrined in the law either.

      That's not what Ben is saying. Ben is saying that there is a distinction between being black vs being gay in the sense "being gay" is referring to a set of behavioral characteristics whereas being black has nothing to do with behavioral characteristics but instead only physical characteristics. If "being gay" is a protected class, then that means we are forcing people to accept a set of behaviors, not some physical characteristic of being.

      I have a lexicon issue with English, straight is something that it is not bent, curved or crooked. And mentally straight is associated with cleanliness, rectitude, correct, right, just word association. So if you are heterosexual you are “straight” and look at the connotations, the opposite of straight is what it is non-heterosexual. The use of straight as synonyms of heterosexual should be culturally faced out to avoid the implications of using this word.

    "How would they even know if they were gay?" It's not even about if the person is actually gay, it's about being identified: "othered", and discriminated against, by the bigot for their perception. This can literally even be done to straight people. The lady who just won the anti lgbtq case didn't even have a gay client, they were perceived, or likely made up flat out. I wonder if Benny realizes there would still be a perception, and discrimination by bigots, of two straight guys being gay if they were to hold hands, show affection, dress a certain way, sound a certain way.

      One of the members of the “gay couple” named in the lawsuit is literally a straight man in a heterosexual marriage.       What confuses me is even his basic premise is stupid. That's not the only way someone would know someone else is gay. It's not even hard to think of easy examples where that wouldn't be the case. But he couldn't be bothered to think that we now live in a world of social media where you can go search to find information about possible customers. Sure, that's probably not a step most people would bother following through with unless perhaps you're a zealot who thinks the person trying to buy a cake from you MIGHT be gay.
      But even still there's an obvious other way people could know about your personal life... And it's just that small towns exist. Where everyone knows everybody else's business. In fact just thinking about that has me horrified by the thought of how I gay teenager could be treated in a small town that is heavily conservative. They wouldn't be able to escape anywhere. They'd get bullied from kids at school and after school they could be denied service by those kids parents.

    99% of issues involving discrimination boils down to: "don't be an asshole." Just treat people with respect, regardless of what you do or don't know about them, and you won't have an issue. You're not going to get in trouble for misgendering a stranger in a bagel shop or fucking whatever. If you make a mistake you can just be like "oh sorry" and correct yourself and that'll be the end of it. People make mistakes all the time in social interactions, if you aren't going out of your way to intentionally harass or discriminate against somebody there's not going to be an issue.

      I have a lexicon issue with English, straight is something that it is not bent, curved or crooked. And mentally straight is associated with cleanliness, rectitude, correct, right, just word association. So if you are heterosexual you are “straight” and look at the connotations, the opposite of straight is what it is non-heterosexual. The use of straight as synonyms of heterosexual should be culturally faced out to avoid the implications of using this word.

    It's a fundamental mischaracterization to say that anti-discrimination laws are about "forcing people to accept" whatever the thing they want to discriminate. You can accept it or not; that's up to you. But you DO have to respect their civil rights. Hey Ben: if businesses are allowed to discriminate against the "behavior" of being queer, then the government can "discriminate" against the behavior of denying them service on that basis.

    I'm glad Sam brought up the comparison to the Spanish inquisition, because it reminded me of an old Catholic policy of how to deal with religious minorities (e.g. Jews and Muslims). Basically, they're to be semi-tolerated, but marginalized and censored in the public sphere. Kinda like how conservatives want to treat LGBTQ+ folks these days.

    it blows my mind that anyone says that one chooses their sexuality. It's really easy to test... you can try it. Go look at a picture of whatever gender you're not attracted to and try to find it attractive. No matter what you do, you can't. You're just not that into it. You can even go kiss somebody, or go on a date with somebody, or heck even go all the way, and you're still going to be like "...meh, that wasn't really my jam" (or maybe you find out it IS your jam, but that's not really the same thing).
    I don't really like the whole "homophobes are secretly gay" narrative, cause I don't think it's true and I think it can be harmful. But like.. if a religious person truly _does_ think being gay is a choice, aren't they basically admitting that they'd totally be gay if it wasn't a "sin"? Cause I can't think of any other way it makes sense. I can't rationalize it any other way; I suppose I should have applying logic would be a fruitless endeavor😂

      All Humans are born with genetic information to be attracted to the opposite sex. We know this is the case because 98% of humans identify as straight. If we were given genetic code to make us attracted to the same sex, we would not be able to pro-create. LGBT is outside the norm. It is 100% a behavior NOT an identity. There's not a man alive, gay or straight, that hasn't been attracted to a women at some point in their lives. It's just being dishonest when people say they were born LGBT, it's not possible.

      Some of these people protest too much. And I think lots of people are on some kind of bi spectrum. I have always been attracted to women, except I did feel attraction to a guy ONCE and it's actually in my top 5 strongest attractions. It was no big deal though, it was just an attraction, I really don't think I'd enjoy sex with a man, so I didn't think much of it. But if I was still fundamentally religious, I would have freaked the fuck out. And I believe many conservatives have had a moment of gay attraction, suppress it, and think they beat back Satan's temptations. In their view, walking with god will lead to less temptation, so they would believe gay men were just like them, but didn't stand strong against temptation. They don't really think there are guys out there with a natural attraction to men the way they're attracted to women. They think it's sexual perversion from giving in to aberrant behavior too often.

I don't know where you get your information but I'm a psych major and one of my text books literally said that even though we cannot exactly pinpoint the determining factor for sexual orientation right now, more and more evidence points to a biological origin.

    Without even getting into tangential arguments about identity and how this relates to other protected classes, his primary argument doesn't even stand up on its own. It can be deconstructed even on the terms he's set. "This isn't discrimination against the identity, it's discrimination against a behavior." Okay. What behavior? Getting married? This website designer isn't objecting to the behavior of getting married. She would happily design a website for a straight couple. So the behavior is marrying someone of the same sex? Is this a behavior that any straight person has done or would do? No. It's a behavior that's **exclusive to** LGBTQ+ people. Therefore, it's not the behavior or actions that is being discriminated against; it's the group of people engaging in that same behavior that another group of people are allowed to engage in without discrimination.
    At which point this does dovetail back into your train of thought about identities, and you can list an infinite number of examples of how this ties into race, religion, and other protected classes. Eating at the luncheon counter while black? It's just the behavior! Marrying a white woman as a black man? That's just an action, it has nothing to do with his identity! Etc. etc.

      There really is so much wrong with Ben’s view. A major jurisprudential factor has to do with why a behavior might be discriminated against. Because it’s even broader than you say - even if certain behaviors were not exclusive to LGBTQ+ people or uniform amongst them, but still very much associated with them, those behaviors might still be protected.
      In Canada a couple years ago there was a case regarding Sikhism - for part of the year, their religion calls for wearing a ceremonial knife, I think it was for an entire month, and it’s a pretty large knife and this posed a problem for Sikh’s going into government buildings. In America, it may jurisprudentially be ruled that wearing said knife is a dangerous behavior, and therefore there is a plausible reason to discriminate against the behavior independent of the religious view. Importantly, it could be argued there is (a) a good reason to believe that it is truly not the protected characteristic being discriminated against and (b) there is a jurisprudential argument that this form of discrimination is overall productive for society.
      The obvious problem with, say, discriminating against gay men who exhibit effeminate behaviors, is that it is really difficult to imagine a reasonable person agreeing that there is ever a valid reason to do so. It really doesn’t matter that effeminate behaviors aren’t exhibited by all gay men or are even necessarily exclusive to gay men. The problem would be that (1) it is difficult to imagine a reason that is productive to society for this form of discrimination and therefore (2) a protected characteristic is being discriminated against for no reason.

    Plenty of immutable characteristics have real world actions that alter their behavior from a norm. Tall people have to bend down, have products made for them thst thry buy and use that accommodate their immutable characteristic. Ben acting like being gay isn't an immutable characteristics is odd, simply with the logic that it's actionable. Even if I never acted on myself being gay, I would still have those feelings. Just like a tall person is still tall even if they don't duck down to avoid a tree branch they're walking into.

    According to Ben’s “logic,” a business owner can discriminate against Christians or Jews not because they happen to be Christian or Jewish, but because they engage in religious actions & practices that are against the business owner’s beliefs. 🤔

    And, on the "choice" issue, religion is NOT an immutable characteristic of people. If it were immutable, there'd never be converts to any faith. Cassius Clay wasn't always Muslim. Bob Dylan made a very public conversion from Judaism to Evangelical Christianity (he recorded several albums in the late 70s/early 80s that were heavily oriented to Christianity). Madonna was raised Catholic but she's explored Kabbala.

    For a long time it was believed that being left handed was bad and a choice. Children were forced to use their right hand. In some cultures it could be dangerous. Being gay is no more a choice than being left handed and the only behavior of being gay is being attracted to people of the same gender. There is no other “gay behavior “ any more than there is “ straight behavior “ .

    Might come as no surprise, but this is still the exact talking point old school racists would use. "We don't hate Black people, we hate their CULTURE", "We don't HATE Black people because they are Black, we hate them because they are CRIMINALS." As per usual, every word that comes out of Ben Sharpio's isn't just factually wrong, it's also unoriginal down to the deflection from a immutable trait towards supposed actions. A thing missing from this video is very clear: What counts as a "Gay" action and what is the line and where is the bounds of that line? If you quantify it as something that is legitimately gay [I.E. Kissing someone of the same gender] than you're a hypocrite given that you excuse that when it's you and your practice of Jeudaism. If it is assumed, than the clear answer is that he doesn't ACTUALLY know and therefore could justify the discrimination in any way he possibly would want, which undermines his idea of being a "Smart" and "Intelligent" person.
