You can't file concurrently for NIW right now . As for your question, I can't tell you what's best to do, it depends on your situation. Consult a lawyer if you have doubts

Thanks for your comment. No, it's not a problem. Once approved you will include her name in the DS-260 and then you will submit a DS-260 for her as well. As long as you have the papers for the marriage it should be ok

Hi Oscar, thanks for the beautiful videos for EB2-NIW visa process, me and other will get more knowledge and information for their applications , I am here to write one important scenario to get in your notice and you might make one video on that side. this is a real situation with 1 of my friend. he is applying for NIW visa and almost all the requirements he can full fill easily now their is one big problem he is facing and want to get an idea, so my friend is applying from abroad like from Pakistan, but he has a conviction for 3 years on one case and he was jailed for that conviction but High court suspended his conviction and till that he now awaiting the court processing , and on consular interview I think its necessary to bring the police certificate to the embassy on interview time or mention the conviction information about his case, so how he or anyone else on that kind of situation or even they are convicted and sentenced for jail in their own country what are the chances to get approved for this NIW greencard. plus also tell us remedy if you have in your knowledge it would be great help for everyone who is following your channel. And one more question related to family: His family like his wife and his son is already USA national, but there are some family issues so his wife don't want to live with him and she already file a divorce, she and his son is in USA already , so in that way should he add family members documents and marriage certificate for his NIW visa application ? The best way is to ask someone in the USA to go to USPS and buy a money order, and then mail it to you to include in your package.

They won't lose it as long as they were able to receive it before they were 21 and unmarried
