      Hello Oscar, thank you once again for the prompt analysis of the February 2025. My suggestion is for us to be optimistic rather than being pessimistic. The first good news is that EB2 ROW remains the same without retrogression. That is going backward. Secondly, although filing of Adjustment of Status (Form I-485) for those living in the US will go backward from (1 Augus 2023 Filing Action Date) to (1 April 2023 Final Action Date) by February 2025, however, this will be for a short time because USCIS' current approach is to ensure that the gap between both Filing Action Date and Final Action Date is not more than one week at the end of a fiscal year. At the end of 2024 fiscal year (30 September 2024), the Filing Action Date stood at 22 March 2023, while the Final Action Date stopped at 15 March 2023. Those filing DS 260 through consular processing abroad are not affected with the issue of whether to use Filing Action Date or Final Action Date for the purpose of filing their DS 260. Thirdly, i got information from another channel that for the fiscal year 2024, the family-based preference only used 170,000 out of its statutory allocated 226,000 in the fiscal year 2024. Hence, there is an approximately 56,000 unused family-based visas that may be rollover to employment-based category for use in this current 2025 fiscal year. Kindly confirm if this information is correct. Fourthly, USCIS' new approach is to release major forward movement news quarterly. So, we should expect major forward news in April 2025 (Q3) and July 2025 (Q4). Lastly, In fiscal year 2024 the EB2 ROW forward movement was approximately 9 months. Hopefully, in the current fiscal year 2025, the optimistic expectation is for USCIS to repeat at least 9 months forward movement for EB2 ROW.

I need to look into family numbers to say if that info is right or not but the USCIS website states that "The employment-based (EB) annual limit for fiscal year (FY) 2025 will be higher than was typical before the pandemic, though lower than in FY 2021-2024." So it seems it is not true, unfortunately www.uscis.gov/green-card/green-card-processes-and-procedures/fiscal-year-2023-employment-based-adjustment-of-status-faqs

      @ , thank you for the quick response. I look forward to your feedback on the unused family numbers which may be rollover for use in the employment category. I am aware of the statement on the USCIS website which is good news to the effect that visas availability for use in 2025 fiscal year will "be higher than was typical before the pandemic". Thus, more than the statutory 140,000. However, it is unclear what USCIS means by the statement "though lower than in FY 2021-2024". It may mean a specific year between 2021-2024. It may also mean a combination of years in FY 2021-2024,

    This is depressing. My Pd is sep 29 2023 i was hoping they use table b and the date to move so that i can at least apply 485 for ead but now there's no hopes

    Sometime I think USCIS what they are doing, last april they increased the fees to smooth operation but now its almost one year passed they did not move atleast 1 month, I remember final action date was March 15 on July 2023😢 7 months gone they just move 15 days. They are just increasing their fund by applicant fees nothing else.

      @@sobhansabbagh6171 I already understand this bullshit system where its going on, they just hanging the sugarcanes infront of us as a filing date advancement, we started our filing by paying the fees to increase their fund and keep them in safe zone to confirm their salary, nothing else. They just gave us disposal fiber of sugarcanes which is name as a pathetic waiting period.

    Hi Oscar, Thank you for your great videos, keep them coming. My only question is that my spouse case is documentarily complete and with nvc right now, waiting on Islamabad embassy to call for an interview. Her PD is 22nd August 2022. What’s her best chance to get an interview at Islamabad embassy. To my understanding as you said that currently they are doing July 2022 cases so best chance is close to mid summer for an interview? Thank you

    The trend line has been fairly consistent since July 2024. An increase of about 0.86 month wait time per month... If that continues I'll have waited around 30 months from my PD (23 November 2023) to being current (mid 2026). Then we just have to hope consular processing doesn't have a huge backlog...

      Don´t forget: There are people, who are more frustated than you. My PD 14 Augst 2023. Documentarily complete 19 November 2023 via consular processing with Premium Processing (EB2 NIW)

      I reverted my RFE and they were questioning all the 3 prongs. Do not give up and use all the resources available. Nowadays, 90% are receiving RFEs according to many laywers I have spoken with.

    I got my approval last Feb 2024. Its almost a year and its not even in sight. I think I now have to write my EB1 petition. This is what I should have done in the first place.

      I’m thinking about doing the same, reapplying as EB1, but I know it will be more costly. I’m trying to extend my visa meanwhile, but at some point if things are not moving then I’ll have no chance other than reapplying

    Hi Oscar, thanks for sharing your thoughts on this latest updates on the visa bulletin. May I ask you to do a prediction 😲!
    During FY 2024 the visa bulletin advanced, if i am not mistaken, 251 days.
    Based on available data that you also published, like the total approvals, can we roughly predict how many days we should expect 2nd pref. to advance in FY 2025??

      Almost not possible to predict something because You can´t compare different FY to each other. Nobody is able to do a good prediction.You can only wait until the PD moves forward.

      @@heindadell490 I completely agree that we can not predict with good data. And USCIS do not provide detailed data. On top of that there is the family members effect that introduces another uncertainty to the equation. However, I was wondering if we can say whether the PD would advance the same as for previous FY or a lot less, like 50% less.

      Thanks for your kind words but unfortunately I never issue predictions because I don't believe in them myself. We can only assume certain trends with the available data as I mentioned a few times in previous videos. Given the high demand over the last years, it is unlikely things will get better soon without Congress action, but I can't speak to specific date movements.
