This recognition process worked for my cousin. Both his parents were already naturalized US citizens at time of his birth. He obtained his dual after his own parents reacquired their Filipino citizenship. STILL have to do the other processes to qualify for Filipino recognition. It does work. Just have to try and get the consulate to work it

Sadly my Filipino mom became a US citizen before I was born and my dad is a white American. So i can never obtain recognition by descent with the Philippines.
It’s unfair. I couldn’t control my mom’s decision. I wish the Philippines would give a path for people in my situation.

IATA has been working with the US federal level to organize such certification. I am forwarding this info to you as a good messenger to help our kababayan. For more info check IATA.Org. It only means those employees in Philippine Consulate, regardless of location, could care less about inquiries regarding Philippine Immigration laws, or, they are unaware or don’t know anything about it. Useless having Consulates in foreign countries funded by taxpayer money.

One can apply for recognition even if born in the US. I was able to gain Filipino recognition because both my parents are Filipino citizens when I was born. The process is convoluted and you may need assistance from a specialist. You will need to prepare your documents ahead of time. YOu will need supporting documents to prove your parents are/were indeed Filipinos when you were born in the US. Be patient but be persistent and follow up.

Is it really accurate that to apply for Recognition of Filipino Citizenship the applicant needs to do it in person at the Bureau of Immigration in Manila? This is what the New York consulate advises. It sounds a bit silly to me that a person will have to expend thousands of dollars just to get to Manila, pay for food and lodging, and hope that they can expedite their application. Would anyone know for sure?

Here in Hawaii I applied as dual and I applied my son as derivative but they told me that I cannot because I am US Citizen when I gave birth to him. They just told me that I will apply for the Recognition in Philippines when we are there. I research for the requirements and one of if is affidavit that one parent is Filipino at the time of birth. I feel sad about it so I am thinking if we move to Philippines I will apply for the permanent resident for my son. I may see an immigration lawyer if needed.

3:31 Actually the BI is expanding their criteria to include those children born outside the Philippines to enable this group to qualify for dual citizenship even after their parent (born in the PI ) and who are naturalized US citizens when these children were born. Not necessarily requiring their parents to have obtained dual citizenship to re-qualify them. So why question them and confuse us?

Good morning, it's refreshing to listen to your vlog. Here's a situation that will confuse you and subscribers even more. My younger brother (10 years) was born in 1964, on US soil, father a naturalized U.S. citizen and mother Filipino citizen (never applied for US citizenship) My brother has gone to the Philippine consulate twice, and was told he does not qualify for dual citizenship because he was born before 1976. He even went to the consulate after there was a change in administration...same answer. Do you know anything about this 1976 requirement? Thank you for your helpful vlog.

Hi grandpa, thanks for the helpful video and for asking for clarification on the text on the NY consulate website (fyi it’s still there!).
A quick alternative scenario for your kind advice pls:
Let’s say Filipino parent naturalized to the US in 1979 and had a child in the US born in 1980. In other words, the child was born after naturalization of the parent. But then, the parent reacquires Filipino citizenship through RA9225 in 2021. My understating is that the parent was deemed to have never lost Filipino citizenship. Will this mean that the parent is now deemed to be filipino at the time of the birth of the child and can now register a birth of filipino abroad? This way the adult child can acquire citizenship? Thanks!

    • @vloggergrandpa2707
      @vloggergrandpa2707  2 года назад +1

My understanding is that the parent as to be a Filipino citizen at the time of child's birth to qualify. Please verify that. Thanks.

Hello Grandpa, My wife and I love your videos and watch them all. I am a US Citizen and my wife is a dual citizen. We are due for our first baby on September 1 and he will be born here in the US. We are planning to go to the Philippines next May. Before going, we will get the baby a US Passport. We want to register the baby as a dual citizen. Do we file the Report of Birth with the local Philippine Consulate before we go; or, do we wait until we get to the Philippines and file for Recognition as a Philippine Citizen at the Main Office of Philippine Bureau of Immigration in Manila. True about dual certificate vs. PH passport. We always advise people with dual citizenship that their identity certificate (the document with a photo in it, not the oath of allegiance or approved petition) is more than enough proof of having a Philippine citizenship. Passports expire while the identity certificate doesn't. When going through PH immigration, your foreign passport along with IC is best.

I applied for her recognition as a Filipino citizen in the Philippines. My youngest daughter was born here in LA. As I got my dual citizen pina registered ko na din ang youngest daughter ko and get her a Philippine passport. In 2019, I personally went to the BI in Intramuros to apply for the Recognition Citizenship. Sad to say, I was denied because they said that my father was a US Citizen, not a Filipino. It is not just any law. It is based on the 1935 Constitution.
      Article IV Citizenship
Section 1 The following are citizens of the Philippines:…
…(3) Those whose fathers are citizens of the Philippines.”
The 1935 Constitution was replaced by the 1973 Constitution, promulgated during the Marcos presidency:
      ARTICLE III CITIZENSHIP
SECTION 1. The following are citizens of the Philippines:...
... (2) Those whose fathers or mothers are citizens of the Philippines.
The 1973 Constitution was replaced by the 1987 Constitution under the Cory Aquino presidency. It follows the same citizenship principles of the 1973 constitution.
Only former Filipinos can re-acquire PHL citizenship and become dual citizens.

      Welcome Grandpa.
Unfortunately I can't answer your question about the process as the NY consulate website may remain erroneous because the supplied link does not provide information on Petition for Naturalization as a Filipino Citizen. Perhaps the website is yet to be updated. I assume Naturalization will be subject to the standard requirements for foreigners.
I wish the PH govt would broaden their criteria to include children of Filipino people who had no choice but to naturalize when moving to the States before giving birth before the effectivity of RA9225.
Nonetheless, I have heard anecdotal stories of people in this situation being approved, so my Mom and I will be seeing an immigration attorney in the Philippines when I'm there later this year. God bless po and thank you for always providing us the facts

Good morning! I just want to be clarified regarding entry of Dual Citizens without a passport. Is it still suspended at this time? My brother who is a dual citizen but has no passport is returning to Manila in May. Will Phil Immigration allow him to enter without a Phil passport? I am all so confused now. Your kind clarification will be greatly appreciated. Thanks!

Yes. A passport is not a requirement. Simply show the US Passport and his Dual Citizenship Identification Certificate.

It should not be a requirement all the time to have two passports because international travel only requires one passport NOT two.

Please research. We are naturalized as a US Citizen. If we own a condo in the Philippines, how can my US born children own it when we die?
Hope this info helps. Thank you.

A foreigner can own a condominium if the Philippines. The prohibition is only on land ownership. A condominium owner does not own the land.

What happens to the children under 18 yrs of age who were born when the parents are still Filipino citizens, are still under the custody of their parents when their parents naturalized? Will their valid Philippine passports be rendered invalid like their parents? So they will need to reapply for dual citizenship as a child? Also, if the child acquired a birth certificate but not a passport, will the child need a dual citizenship document before applying for the Philippine passport?

I agree with you that they are wrong in the interpretation of RA9225. They are probably confused as Sec 2 of RA9225 states that “all Filipino citizens (former) shall be deemed not to have lost their Filipino citizenship under this act” REQUIRES a re-acquisition act on the former Filipinos part OTHERWISE the force of the renunciation part of the US oath of Allegiance is still in effect.
Thus, that person born in the US with parents who were Former Filipinos (who did not do a re-acquisition of Filipino citizenship under RA9225) and are now Americans only, is solely American and NOT a dual citizen of the Philippines and America.

Grandpa: I don't find a conflict. Context is important. Those who have reacquired Philippine citizenship through RA-9225 are deemed to have never lost their Philippine citizenship. However, those who have been naturalized- say in the US- have renounced their Philippine citizenship, unless or until they reacquire it through RA-9225. So, an adult child whose parents were both naturalized citizens at the time of the child's birth, but at least one of which has since reacquired Philippine citizenship through RA-9225 can apply for Recognition as the child was born to at least one Philippine citizen. An adult child may not apply for citizenship through RA-9225 as RA-9225 does not apply to adult children or married children under age 18. The "recognition" instruction (RBR-99002) was issued in 1999; RA-9225 was passed in 2003.

Yes, but the website did not say that they re-acquired Philippine citizenship. That makes a BIG difference. Can't leave anything to "assumption" when you're reading something like this.

@@vloggergrandpa2707 I believe the section you refer to presumes at least one parent has reacquired citizenship. It appears in the section discussing RA-9225 which does not apply to adult children.
If my child is already 18 years old or above by that time I applied for dual citizenship, what process do they need to take to be considered dual citizen as well?
If the adult child was born in the Philippines and at least one parent is still Filipino at the time of child’s birth, he/she may file his/her own application for dual citizenship under RA9225.
If the adult child was born in the US and both parents are already naturalized US citizen at the time of child’s birth, the adult child or parent/s can apply for Recognition of Filipino Citizenship at the Bureau of Immigration in the Philippines. (Please see Recognition of Filipino Citizenship)
If the adult child was born in the US and at least one parent is still Filipino at the time of child’s birth, the adult child or parent/s can apply for Report of Birth of a Filipino Abroad at the Philippine Embassy or Consulate which has jurisdiction over the place of birth. (Please see Report of Birth)

RA-9225 applies to former Filipino citizen *_who lost their citizenship due to naturalization in another country_* . To reacquire their Philippine citizenship, they will need to apply for Dual Citizenship under RA-9225.

This recognition process worked for my cousin. Both his parents were already naturalized US citizens at time of his birth. He obtained his dual after his own parents required Filipino citizenship. Have to do the other process to qualify for Filipino recognition. It does work. Just have to try and get the consulate to work it
