    Hello po, I was born in the US and also my birth was reported to the Philippines so I am a dual citizen by birth. However upon entry to the Philippines, my PSA Copy Report of Birth did not qualify as a dual citizenship document and my visa was only for 30 days instead of unlimited time. They asked if I have a Philippine passport or a certificate of dual which I do not have. Do i need to apply for dual citizenship through immigration in the Philippijnes or United States Consulate in order to take the oath and receive a formal certificate? What should be done in my case so I will be able to get longer stay?

    I thought Jus Sanguinis means that citizens with Filipino blood can immigrate to PH. As a full blooded Filipino myself but was born when my parents fully naturalized( in 1985). Do I have to apply PH citizenship as if I was a foreigner? Or can the 2003 retention act can apply to me if my parents decide to become PH citizens again. I am interested in dual citizenship by the way.

      Jus sanguinis means that citizenship is passed on by blood - your parents' citizenship was passed on to you during the time of your birth. If your parents were not Filipino citizens during your birth, then you are not eligible to apply for dual citizenship since you're not considered as a natural born Filipino.
      If your parents apply for dual citizenship (and you're still a minor when they apply), then you'll be "grandfathered" and be dual too. However, if you're above 18 at the time, then you won't be included in their application for dual citizenship.

    Lawyer, I was born 1990 on Clark afb in the p.i. my mother was born and raised in San Jose, nueva ecija. My dad born and raised in USA. Do I qualify for dual? I'm currently usa citizen

    • @kitty_s23456
      @kitty_s23456 10 месяцев назад +1

      Yes. You were born as a dual citizen since you were born after 1973 to a Filipina mom/ US dad. If you have a PSA-issued Phil birth certificate, you can use that to apply for a PH passport. Inquire at the PH consulate if you're living outside of PH.

    If my mother is a natural born citizen of The Philippines (born before 1973) but became an Australian citizen before i was born, is my mother eligible to apply for dual citizenship and will i be able to obtain my dual citizenship after shes become a dual citizen?

    • @kitty_s23456
      @kitty_s23456 9 месяцев назад

      If your mother's father (your maternal grandmother) was a Filipino citizen, then she iis considered as a natural born Filipino and can apply for dual citizenship.
      However, since she was not a Filipino citizen anymore at the time of your birth, you are not considered as a natural born Filipino and thus not eligible to apply for dual citizenship (if you're not a minor anymore). If your mom applied for dual citizenship while you were below 18, her minor kids can be dual too.

    Hello atty. Im a Filipino born in the Philippines. My father is a Filipino my mother is a naturalized US citizen. By her petition i became a US citizen in 1991. Under RA 9225 I took the allegiance and regained being Filipino in 2007. I have been living here in the Philippines during the past 20 years. My question is can i ran for an elected government post?

    • @kitty_s23456
      @kitty_s23456 10 месяцев назад +1

      Hi. You can run for elected govt position BUT you have to renounce your foreign citizenship, like the case of Senator Grace Poe. She renounced her US citizenship. To be an elected official, your loyalty must be to 1 country only. (if you're dual, your loyalty is divided)

    Atty. Pwede po ba ikasal ulit abroad kapag divorce na? Pero yung previous marriage hindi pa naka nakapag file ng Judicial Recognise of Foreign Divorce sa Pinas.
    Kung nagpakasal po ako ulit abroad ( same country kung saan kami divorced ) is that considered a Bigamy???

    I was a former dual citizenship before but I denounced my Filipino citizenship. When I applied "Recognition of Filipino Citizen" and answered the interview that I denounced my Filipino because of the Japan law, the Bureau of Immigration rejected my application. Can I still apply again even though I was born in the Philippines with my Filipino mother/Japanese father and even I denounce my Filipino citizenship recently? If so, how should I convince the immigration or do the right way to grant my dual citizenship/recognition of Filipino citizenship again?

    • @kitty_s23456
      @kitty_s23456 10 месяцев назад

      Hi. Japan does not allow dual citizenship. That's why the PH Bureau of Immigration rejected your application to reacquire PH citizenship. To my knowledge, it must be reciprocal.

    Hello attorney, I just viewed this video and at the end you mentioned that a child born in foreign country of Filipino citizen parents are dual citizen by birth.
    My question is my father is a natural born filipino and my mother is a natural born American. I was born in the Philippines so RA 9225 will qualify me for dual citizenship even though I am currently a US naturalized citizen. My sister was born in the US before my father became a US citizen does she qualify in anyway for a dual citizen of the Philippines?

    • @kitty_s23456
      @kitty_s23456 10 месяцев назад +1

      Hi. Your sister (born to a Filipino citizen dad) was born as a dual citizen. She does not have to apply for dual citizenship because she already is one. However, she must check if your dad filed for a Report of Birth at the PH consulate. If not, your dad oe your sister can file a delayed Report of Birth.

      Hi. Were you born before or after 1973? The year determines whether or not you are qualified for dual citizenship.

    Hi Attorney. My son was born in Canada in September 2009. When he was born, my wife and I were still Filipinos but have moved to Canada as immigrants. After my son was born, our family decided to visit the Philippines in 2011. When we renewed our Philippine passports at the Consular Services office of the Philippines, we were advised by the persons in the said office to "report" the late birth of my son saying that my son would be considered a Filipino by doing so. As such , we submitted an Affidavit of Report of Live Birth with the Philippine Consular Office and such document was duly recorded by the same. It should be noted that at the time we visited the Philippines in 2011, my son held a Canadian passport since he was born in Canada despite the fact that when he was born from parents who at that time were still Filipinos. My question is with the report of live birth of my son with the Philippine consulate, does that imply that he is a dual citizen? Or does my son still have to do steps in order that he may become a dual citizen? It should also be noted that we the parents have become Canadian citizens in 2015.

    • @kitty_s23456
      @kitty_s23456 7 месяцев назад

      Yes, he is considered as a dual citizen since he was born while you were still Filipino citizens. You also have reported his birth to the PH consulate/ embassy. Your next step is to procure a PSA birth certificate for your child (you can get it online from psa gov ph). After he has obtained a PSA birth certificate, he can apply for a PH passport.

    My question lang po ko for my friend, if naging canadian citizen na ung parents tapos nagka-anak sila sa Canada. Totoo daw po ba na if hindi naging dual ung both parents at lumagpas na ng 18yo ung anak nila at naisipan ng anak maging filipino citizen. hindi na daw pwede maging dual citizen ang anak? (cad and filipino). Thanks po

    • @kitty_s23456
      @kitty_s23456 9 месяцев назад

      Yes, totoo po yun. Kung Canadian citizen na sila by the time na ipanganak yung anak nila, then hindi dual yung anak nila. Kung mag apply sila ng dual while minor (below 18) pa ang anak, then maisasama yung anak sa dual citizenship application.
      Kung above 18 na yung anak, di na maisasama yung anak sa application at di na pde maging dual yung anak.
