    Attorney, I was born in Manila on June 1951 to a American Citizen father and a Filipina. Both are deceased. I migrated to the USA in 1967 and became a naturalized US citizen With my history, am I qualified for the Philippine Citizenship Recognition? Your advice is deeply appreciated.

    I went to the bureau of immigration in Manila and applied for recognition of citizenship and was declined
    even in possession of birth certificate indicating my mother is Filipino.
    "Anyone born in the Philippines before 1973 of American father and Filipino mother can not claim for recognition of
    citizenship as defined in the 1935 constitution of the Philippines article IV"
    Is that right???

    Hello po Atty,I was born and live here Phils since birth,i'm 17 yrs old.My father is US Citizen but live here in the Phils.and my mother is Filipina.I got a US passport since when I was 3yrs old,I never been travel yet since birth.My question is Do I still need to get Recognition as of Filipino Citizen to get a Phil passport?

    Good day po attorney! Ako po ay US citizen pero dito ako pinanganak sa pilipinas at never pang nakaka alis ng bansa may CRBA po ako at US passport. Ang nanay ko po ay american citizen ang tatay ko po ay Filipino. Ang problema ko po ay hindi nakalagay ang tatay ko sa Philippine birth certificate ko naka "Unkown" po siya doon dahil nagkaroon ng ayaw ang side ng nanay at tatay ko before. Never pa po akong naka alis ng bansa, Ano pong magandang gawin?

    How specifically can I apply for a Philippine passport if all I have is a Recognition Certificate and American Birth Certificate. Because My mom didn't report my birth here in the Philippines meaning I also dont have a Philippine birth cert . How will that work po kung sakali. Im lost po atty.

      Kung i-renounce mo ang Philippine citizenship hindi ito makaka-apekto sa mga properties mo sa Pilipinas na na-acquired mo noong ikaw ay Filipino pa. Ung advantages o disadvantages ay depende yan sa needs or priorities ng holder. But one thing is clear, kung hindi ka na Filipino, ay foreinger ka sa bayan mo. You need a visa to visit the country. You cannot work without permit, you cannot run and be elected to public office. If you are considered as natural-born citizen, you may still enjoy limited investment opportunities and limited ownership restrictions. If you think that it is for your best interest na completely renounce your Philippine citizenship, then it's your choice.

    Hello po Attorney. Yung dad ko is 40 years old na pero overstayed sya sa pilipinas ng 12 years. American citizen po sya pero patay na po nanay nya pero buhay pa tatay nya and Philippine citizen naman yung tatay. May ibang requirements po ba kung ganun? Maraming salamat po

      The critical reference to determine whether your father may qualify for recognition as a Filipino citizen is kung ano ang citizenship ng kanyang magulang at the time of his birth. Kung at the time na ung father mo ay pinanganak, kung ang isa o both biological parents niya ay Filipino at the time of his birth ay maari siyang mag apply for recognition. Makipag ugnanayan kayo sa Bureau of Immigration(BI) upang maisubmit ninyo ang mga requirements.

      Kung at the time pinanganak ang nasabing pamangkin na Japanese citizen ang isa sa kanyang mga magulang ay Filipino citizen, at pinanganak ang nasabing pamangkin after jan.17,1973, ang pamangkin sa maituturing ding Filipino citizen kahit sa ibang bansa siya pinanganak. Kung pinanganak ang pamangkin sa Japan, ay Ihanda ninyo ang aunthenticated birth certificate nito ay duly acknowledged and authenticated by the Philippine Consulate. Kailangan din ang PSA authenticated birth certificate ng Filipinong magulang, copy ng Philippine passport ng magulang at kung married sa Japanese, ay authenticated and translated copy of the marriage contract at acknowledged ng Philippine consulate. Then through your lawyer sa Philippines, ay mag file kayo ng Petition sa Buerau of Immigation (BI) sa Pilipinas for Recognition as Filipino Citizen.

    Im a us citizen with both filipino parents,when my parents decided to go back here in the philippines nag apply sila sa bureau of immigration para ma recognize ako as a filipino,dito na ako lumaki then when i turned 16 yrs old i decided to go back sa US and wla naman ako naging problem sa immigration pinakita ko lng ung certificate of recognition ko as a filipino

      What's the question? If you have a certificate of recognition as Filipino, then you have all the rights and privileges of a Filipino citizens, such right includesm the issuance of Philippine Passport for convenience in going out and in of the Philippines.

    Good morning,Attorney.
    Japanese national po yun anak ko na 20 years old na po sya.Gusto ko po syang kuhanan ng certificate of recognition.Kailangan pa bang inotario yun Japanese Family Registration(Koseki Tohon)?Saan ko po ba dapat ipa notary?Sa Local District Legal Affairs Bureau(Japan)?Japan Ministry of Foreign Affairs?Japan Embassy? Or di na kailangan i notary basta certified true copy na lang and basta translate na lang sa English??

      Greetings!!
      Maari mong ipa-notaryo ang mga translated Japanese documents sa mga notary public sa Japan na accredited ng Ministry of Foreign Affairs ng Japan. Just be sure na mga Japanese documents ay translated na into English. Ang Japan at ang Pilipinas kasapi at signatories ng “Hague Apostille Convention”, kung saan ang legal na mga dokomento(Koseki Tohon at iba pa) ng mga kasapi at signatories na bansa ay kinikilala na ang mga legal na notaryadong dokomento at hindi na kailangan pang dumaan ito sa Philippine Consulate kung saan lalagyan pa ng red ribbon ang mga dokomentong notaryado ng consulate upang ma-recognized sa Pilipinas ang mga legal na dokomento.
      Sapat na ang Notaryadong dokomento na translated intoEnglish at notaryadong ng notary public ng Japan na accredited at registered ng Ministry of Foreign Affairs upang kilalanin ang mga legal na dokomento tulad ng iyong nabanggit hinggil sa pag apply ng recognition of Philippine citizenship ng iyong anak sa Bureau of Immigration. (BI).
      However, as regards sa birth Certificate mo sa Pilipinas, kung saan mapapatunayan ang iyong Philippine citizenship at the time of birth ng inyong anak, at ang inyong marriage certificate(kung sa Pilipinsas ka kinasal with your Japanese Husband) tiyakin na mayroon kang authenticated copies ng mga nasabing dokomento na galing sa Philippine Statistics Authority(PSA) formerly NSO sa mga supporting documents sa application ng anak mo for reconition of his Philippine citizenship. Idouble check mo rin sa kinauukulan ng Japan, kung allowed nila ang dual citizenship at ito ay hindi makakaepekto sa pagiging sa application ng inyong anak na maging dual citizen ng anak mo ayon sa batas ng Japan.

    Hello sir paano po pag naka detain po sa immigration detention sa bicutan for overstaying pwede parin ba sya mag apply for recognition isa po syang half british half Pilipino born in UK nasa Pinas na po sya mula nang 10 Years old palang po sya 30 years old na po sya ngaun almost 2 years na po sya sa detention facility ano po ang dapat nyang gawin

      Yes pwede parin. Kaya siya na-detained dahil sa mata ng batas dayuhan siya, dahil di pa siya formal na recognized na Filipino citizen,Kailangan lang i-prove niya, ung siya ay pinanganak, under the 1973 Constitution or thereafter, na at the time na pina-nganak siya both or isa sa parents niya ay Filipino Citizen. It is strongly suggested na kumuha kayo ng lawyer upang ang mga kaakibat na requirements, tulad ng birth certificate niya at mga pwerba ng Filipino citizenship ng parent(s) niya at the time of his or birth, regardless of the place where the subject individual was born.
      PAALAALA: DAHIL sa haba ng pila na naghihintay ng kasagutan na tulad mo, limitado po ang tanong sa isa lamang. Tungkulin ng nagtatanong na i-kompleto ang mga detalye at malinaw ang mga katanungan. Pag di maliwanag ang tanong, maaring mali din ang sagot o di mabigyan ng tumpak na sagot ang katanungan. Hindi na po sinagot ang follow-up, paglilinaw na mga tanong o bigay ng installments o spekolasyon, haka-haka ang mga katanungan. Ang mga SUBSCRIBERS at may clicked ng NOTIFICATION bells lamang ang bibigyan ng priority sa pag sagot ng mga katanungan.

    Attorney sapat na po ba ipakita sa airport immigration yung 1994 recognition as a filipino citizen ko na paper?. Wala po akong Philippine passport only U.S. passport lang po.

      Technically sapat na ung Recognition of your Filipino citizenship that was issued by the Bureau of Immigration(BI). However, may nababalitaan na ako na mayroon pa ring ibang kababayan natin na pag dating sa airport kahit na mayroong cerfificate na, hinahanapan pa rin ng Philippine Passport at nakaexperienced ng hassle and inconevenience dahil ung ibang BI officers are still asking for the Philippine passport at the airport, dahil hindi na nababasa sa passport reader ang certificate lang. Moreover, another reason perhaps from the legal perspective why immigration officer would insist
      na dapat mayroong Philippine Passport, dahil ang certificate of recogniton is only a prima facie evidence of citizenship. Ung Philippine passport on the other hand is a conclusive evidence that the holder is indeed a citizen of the Philippines. On the other hand, marami na rin akong nabalitaan na kahit walang Philippine passport, as long mayroong recognition or certificate ng Citizenship and Retention Act of 2003, sa ilalim ng R.A. No.9225, ay kinikilala naman sa airport ng BI officers kahit walang Philippine Passport.

Magtatanong lang po sana ako. kasi nung bata pa po ako age 6 or 8 dinala po ako ng parents ko sa England tapos naging British Citizen nadin po and then 2007 umuwi po ako ng philippines dahil sa namatay yung dad ko . hindi napo ako naka balik ulet ng England. gusto ko po sana bumalik ulet sa London kaso sabi po nila magbabayad daw po ako ng fee for overstaying sa pilipinas.tapos nag apply for renewal po ako ng philippine passport kaso hinanapan po nila ako ng Oath of allegiance or Identification Certificate kapag po ba kumuha ako ng recognition as filipino citizen mawawala po ba ung fee for overstaying sa pilipinas. sana po matulungan nyoko salamat po.

      Kung Filipino citizen ang ina ng bata at the time of birth, ay considered as Natural-born Filipino Citizen ung anak mo. Maging mas convenient na mapa rehistro mo rin ang birth certficate ng anak mo sa Philippine Consulate sa india. At kung mapapatunayan mo sa Philippine consulate na Filipino citizen ka at the time of the birth ng anak mo base sa mga dokomentong i-submit ay maari kang mag apply sa philippine consulate for the issuance of Philippine Passport. Depende sa mga circumstances mo at assessment ng mga dokomento mo, ay maari ring i-require na mag file kayo ng recognition of Philippine citizen ng anak mo sa Bureau of Immigration(BI) sa Manila, bago ma-bigyang Philippine Passport. Ang proof of your Filipino citisenship na required sa inyong usapin: Your authenticated birth certificate, valid and subsisting Philippine Passort, birth certificate of your child, your marriage certificate, among others.

      Pwedeng mag file ng Petition for recognitionsa Bureau of Immigration(BIR) regardless of your age, for as long ay you can prove that at the time you were born one or both of your parents is/are Filipino citizens as defined by the 1987 Philippine constitution and in relation to the 1973 Constition.

      No. Your Child US citizenship and the laws of the US does not prohibit dual or multiple citizenship. Moreover, the Philippines recognized Dual Citizenship.

    good morning Atty.
    ang anak ko po is born in the US with both parents are Filipino during the time of his birth. Last 2018 the mother of the child died ( we are not yet married ). Sa US birth certificate nya ay hindi naka indicate ang father's name pero surname ko ang ginagamit nya. i will be applying for his recognition as filipino citizen. Isa po sa mga requirements is for me to get his birth certificate dito sa Pilipinas. Kailangan daw po namin mag execute ng affidavit to use the surname of the father that should be executed by the mother pero she already died. sino na po ang mag eexecute nito? pwede ko na po ba ipalagay ang name ko as his father sa birth certificate nya dito sa Pilipinas? Maraming salamat po. Pwede ko din po ba makuha office address nyo or number para makapagconsult po ako

      Under Republic Act No.9255(An Act allowing Illegitimate Children to use the surname of the biological father) which amended Art.176 of the Family Code, now allows the use of the surname of the biological father of an illegimate child, provided that a written consent(usually in the form of Affidavit/ a public document recognizing the child as his offspring ; and also allowing the illegitimate child to use the surname of the Biological father.
      Kung suriin mo ang nasabing batas, wala namang sinasabi doon na pati ang biological mother ay gagawa din ng simila na affidavits. Ayon sa Administrative Order No.1, Series of 2016, ng Philippine Statistics Authority(PSA), ang ina or ama or guardian ng illegitimate child(if case of minor) ay maaring file ng application to sa PSA through the Local Civil Registrar kung saan naka register and inyong anak, na gamitin ang surname ng ama. Kung kayo ay residence sa USA or sa ibang bansa, maaring gawin ang proseso sa Philippine Consular Office, kaya lang medyo may katagalan lang ang proseso. Dahil sa patay na ang biological mother ng anak mo, at kung minor pa ito, at kung nasa poder mo ang bata, ikaw ay maituturing “guardian” at mayroong parental custody at parental authority sa minor mong anak. Basi sa nabanggit na kadahilanan, sa pananao ng Batas Pinoy, ay di na kinakailangan ang Affidavit ng biological mother ng ina due to” legal impossibility “ sa pag produce ng nasabing dokomento. Kung nasa Pilipinas kayo makipag-ugnayan kayo office of the Civil Registrar and/or sa PSA upang makuha ninyo ang iba pang mga kinakailangang dokomento, tulad halimbawa ng Certificate of No marriage(CESNOMAR) kung saan ito ay magpapatunay na at the time na pinanganak ng bata, ang magulang ay hindi pa kasal.

      Ayon sa Republic Act 9225, or the Citizenship Retention and Reacquisition Act of 2003, ang dependents sa ilalim ng Sec.4 ay mga dependent children under 18 years of age and unmarried. If the same vien, if the principal applicant has already applied for dual citizenship and failed to include dependent children in the application, he/she may file a petition for inclusion of dependent children who are under 18 years of age and unmarried.
