- For the people who wanted to know why, here’s the video. I had made this video a while ago but I didn’t use that video because I needed more time to evaluate it and be in a better headspace.

I been in this industry for 34 years. When the company says you have take a drug test. They mean immediately. No question asked. I don't care how long you been with the company. Back in day,i have taken them at the weight station before also. During a road side inspection. This was early 90's. Been there done that.

They call go instantly took physicals and told them I just drank energy drinks but took the drug test and went back the next day to finish the exam. You dodge a drug test and red flags go up quick . If you didn’t do drugs you would jump at a drug test .
JAMES that was with the bus thar went scale to scale when they had blizts. Haven't seen one since 1995. I just retired after 44 years. I liked mercer seemed like a great company.

When the mechanic notified you that you had to go take a drug screen you should've immediately called safety. Any Contractors or Employees must submit to a urine drug test immediately after being selected for random testing.
As others have said above, per the FMCSA you have 24 hours to take a drug test. Some companies have even stricter policies. You better hope they don’t put that on your clearinghouse. You’ll have a huge headache then.

Never had a mechanic tell me that it has always been from the office. What kind of operation is Mercer running, the next driver will get it from the guy in the wash bay .

I can understand if office personnel (Safety dept) tells you you have to take a drug test, but for it to come from a mechanic i probably wouldn't have taken it seriously either. I been driving for 20 yrs and no mechanic has ever told me i had to take a drug screen...
Things are different with a owner operator company. They have multiple building, so whichever building your at, someone from that building will inform you to go get your drug test
I'm sorry to hear this happening to you, sir. The company I work for, if I am on a load they will notify us to get a drug test that day, no exceptions. It's hard to understand, tho they didn't specify. I think it is weird. God bless you, Sir. Just trust God no matter what through your situation 🙏 😔

It's not weird. The company has x amount of time to inform you of drug test. Once informed which should have been done by safety department you have to go right then per the rules no exceptions.
If it’s been entered on your clearinghouse, you’ll have to complete a SAP to be eligible to be hired or contracted anywhere that’s reputable.
Companies assigning other dates for drug screens because you can’t go is illegal.

DOT policy is one told about the drug test, the clock starts ticking. You have a limited time to get that test done. It's not a comoany rule, it's the feds. Good luck driver!

Absolutely. The company gets in trouble if he doesn't. He is trying to say he didn't know. Once he said his authority was inactive it was clear to me he failed as a business man .

Well, back in the day when I started, you didn’t have to worry about drug screening and when I did, they (the office) always told me and I took it. So this is the first time in 45 years! But I’m cool driver!
@@jdtrucks5936drug screenings for hire are different from DOT drug test. The screening can happen whenever since it’s pre hire work but DOT has to be 24h. It will show up on clearance house
In 44 years i worked for 4 carriers . The last was owning my truck. If you had your dot number then you absolutely should have know about drug testing
I’m not really sure where everyone is getting the 24 hour time period from ………..the FMCSA uses immediately or reasonable time, as determined by the employer, consistent with applicable DOT agency regulations, after being directed to do so by the employer.

Brother, i hate to tell you. When they say you gotta take a drug test. They mean within 24 hrs. I was with UACL 29 yrs. And when they called to tell me to get a drug test. Theyde find oyt where i was. And gave me testing facilities nearby. The only way theyde actually give me 24 hrs. Is if there wasnt a facility nearby. And i was low on hrs to reach a test site. Otherwise it was pretty much understood. That it meant immediately. I get what your saying and agree with you. Because usually for courtesy purposes. They should tell you immediately. But by law they dont have too. Let me share my experience with uacl and the way they terminated me after 29 yrs. Never had a accident, never failed a truck inspection. Never had a damage claim on a load. Always on time with deliveries etc. And because i had 2 log violations in 1 yr. ( neither put me out of service). They terminated me without warning. At the time i was pissed. But looking back now. It worked out for the best for me. And now im retired after 40 yrs in the seat.

MARK I did 30 years union ltl. Retired. Obama an insurance sent me back to driving. I just hung it up in January after 44 years and I'm living quiet comfortably. Remember he had his own authority so that means he failed as a business man so that shouldn't be a surprise right. Owning my truck (paid for in full at dealership) I never fell under 300k a year hauling pepsi contract Gatorade. Just saying

Were you in Louisville? I drive for Mercer too, and that happened to me where they told me I had to take a drug test when my truck had to be DOT inspected. I took it that day, but I wasn't told I had to take it at that moment either. Sorry that happened to you.
Yes, it was in Louisville at their Terminal, My Coordinator didn't even tell me but it's all good!

Some of these Companies just have it out for you.
1st- they label you, oh yeah, someone will get this back to you
2nd- they will begin making sly (-) remarks about your work or time off
3rd- they will throw something out there that you are likely to dismiss and then, you know how the Pilgrim's work-

Come on man when you are ordered to drug test thats federally regulated YOU know you have to go right away that drug test trumps everything..we have to quit acting like we don’t know better…owner ops get that random call no matter where you are you have to find the closest testing facility and go test…

Any job that we work, when we are told that we have to take a drug test, it's best that we go take it that day or within 24 hours. Any company that doesn't enforce that is questionable to me and failed you. It's the law. Just for the future family, think of it like this. When you take too long, they start to think that we are doing something to alter the test
That notification seems suspect. I imagine the company has to designate a specific person to handle drug testing. Telling a mechanic to tell you is a problem. They aren't supposed to share that information because the mechanic could technically give you a heads up that its coming so you can prepare. But the notification of a drug test should come from a designated person in the company. At least if they try to use it against you maybe you can hold them accountable to how they handle the chain of command when it comes to their drug testing procedure. Get the policy and use it if you need it.

Your right ,the driver once notified has 24hrs to take the test.it becomes a problem when and where the company arranged appointment for it to be done.
If reported on your cdl isn’t that an automatic suspension by the state of your license and you have to start all over again driving school, written test, driving test etc or am I misunderstanding it I believe that’s the way it is here in Texas please someone correct me if I’m wrong
After you’re “Officially “ notified your time to take it starts counting. Most companies check your availability before acknowledging in the system that you’ve been notified. Mainly because you can be on your time off, you can have things scheduled, etc so most ppl I’ve ran for try to accommodate your schedule.

Sorry to hear that my friend. I’m so sorry the person telling you did not express the urgency of you getting to the collection agency right now. I imagine they have a collection agent on site or close by.
I worked for a Nuclear Power plant for 30 years and we all knew that a drug alcohol test was like right now. Anyway I just read the FMCSA RULE on drug testing and Bro is like right now. I think they give you a an hour or so at the collection agency to perform.
So bottom line as drivers we need to be in the know. I would as someone else suggested check your DAC report because that’s a huge offense as for as another company looking at your DAC report.
It might be a good idea to try an clean that up with Mercer. Check first because they may not have reported it.

@@JOSHUA8CS not the DAC it is the Clearinghouse that is key. He can't work with a refusal without going through RTD. MRO maybe his best bet to plea. My state suspends your DL for a refusal or fail.
The clearing house registration alone tells you that you have to test something fishy here his insurance company has to be notified fast and he has to be cleared of drugs With testing. He’s a accident waiting happen.

It is worse than a speedi g ticket. You don't show for a drug test it shows on the Clearinghouse. You got to depend on you. No excuses. Trucking is for independent thinkers. Federal law. You fail, refusal, or walk out is on Clearinghouse. Many insurance deem u uninsurable.

Very difficult I was in the woods. Lol. Unfortunately trucking is like the military your family, your health, nothing matters except regulations. Clearinghouse is bull shit. My urine was clear I wasn't told it showed a fail. Immediately suspended. I had to fight the doctor for not notifying me. I had to call Clearinghouse. A letter had to be sent to my state. Driver license suspended.. After few weeks everyday hours on the phone it was reversed as a mistake. I was able to retake it. Brokers as an independent can blackball u on this......Worth investigating and fighting. Cant have this on your record friend......Another thing Elog. I forgot to hit PC last week over 30 minutes traffic went home.. My company went ballistic. Trucking if you want it requires always onboard. No mistakes. I been sick still drove. Many sleepless nights. Loss Family, friends and loss a marriage in this industry OTR. It is brutal and tough. I hope you stay on your A game. Nice truck. You got potential.. License will be suspended. You have to take a RTD to go back yo work. Clearinghouse documented this. Need to contact Clearinghouse MRO. Medical review officer.

I smell Bullshit. Telling you that you need to take a DOT Drug test is Not a Mechanics job. It's the job of someone in your "Chain of Command" Your go between , between you and the higher up's , possibly someone in Safety. They were to tell you where to go. And yes it's That Day. Not at your leisure. At Schneider our STL (Our "Dispatch") had to read in full a paragraph. I'm sure they were being recorded as whenever I tried to interrupt and say Ok a drug test.... I'd be told they had to read it in full. Not sure if that was DOT or Schneider Policy.

Take responsibility man. Every trucker knows the lingo in the industry. Once drug test is mentioned no matter the verbiage, it is immediate
Might want to sign in to the clearinghouse and make sure they didnt put a refusal. A refusal is the same as a fail. It takes awhile to get the suspension letter. Its a pain in the butt. The return to duty process.

As you know, Mercer brings you to Louisville at least once a year, so they kind of restrict their pool of drivers to test to who is on the property that day. I am surprised that the gal that administers the test did not also call you directly as that has been my experience. It is just a shame you were canceled out for a simple miscommunication. Any drug like marijuana or opiates would still be in your system anyway. The only drug I can think of that would have been metabolized was alcohol and I dont know if they even test for that.

Drug screening for hire are relaxed and are not important on when they happen. DOT drug tests have to happen in 24 hours or it’s a refusal and will show up on your clearance house. Refusals are as serious as popping hot on a drug test.
I definitely would check clearinghouse, cause if you have a violation they actually revoke your license as of the 21st of November I believe

If they put that in the system that you refused it could make it hard to get hired on anywhere

I hate to break it to you but you're in for a REAL fight. You are essentially unemployable. Likewise, you cannot be on SAP and operate under your own authority. The path of least resistance is signing on with a Russian company. Take this video down. Get yourself a lawyer. Deny ever being told to get a drug test. Then threaten legal action against Mercer. It boils down to your word against their word. There is a reason attorneys love suing trucking companies. It's called out of court settlement.

You say you took the truck in for inspection and the guy doing the inspection informed you that you needed to rake the drug test . Who is he to tell you this. This is upto the safety department not a truck inspector.
You should have called safety and asked about this and not waited, this is your livelihood your talking about. Unfortunately this will follow you forever, theres not much you can do now but hire a lawyer but even that wont change the fact that you refused.
The same thing happened to me in 2021. And the next thing I know I was Fired and they put my name on the Clearinghouse List and ever since then No One will Hire me. So I just went and Retired. But it Sucks. I really miss Driving that Truck.
Well now your in clearing house so hurry and get your assessment test and drug video's etc etc done before November cause fmcsa will suspend your CDL privileges, your gonna have serious hard time gettin on anywhere so best bet get ya own authority and i believe thru out a year or so you'll have to take follow up drug test, depending on how u pass your assessment test telling counselor if u have drug issues or not is how little you have classes or video's, i did same thing i took drug test but didnt do it immediately i delivered load first same day i was told and didnt make it on time at quest diagnostic but went first thing following morning and passed drug test but was still put as refused so my assessment test i blew it out the water so it shows no drug problems so i had to do 16hr video and a year of follow up test. I will say this im not taking up for folks who do dope or even smoke weed but this clearing house is definitely a set up for drivers to quit cause it is costly, my counselor said she out of 100% she's delt with 80% of the drivers once they found out what they need to do they gave up license and moved on.
Once they tell you that you need a drug test you have so much time to get done. Be you have your own authority you should have known. Any time a company says you need to get a drug test you should have asked where. E you have your own authority you should have known the minute they say you need a drug test that clock starts ticking

You will be downgraded if you don’t complete a sap program . Anyone that has been driving any real length of time know you have 24 hours on a random period. You should have checked immediately. Refusal will hurt you even with your own authority.

CHECK YOUR CLEARINGHOUSE SIR, you will be prohibited come Nov, they are now taking your CDL without the SAP program. owner operator or not. and yes some companies do give you time to take the test. i have taking them 30days later. that's the consortium that's makes the call not the FEDS. The company can override that if they won't too.
