  • David Rudolf is best known for being Michael Peterson's attorney on the hugely successful Netflix docu-series The Staircase. In an interview with Mike Sheridan ahead of his sold out show at Liberty Hall in Dublin, he talks about the Peterson case in detail, how divisive America is right now, the reaction to Colin Kaepernick's protest and the comparisons of current American President Donald Trump to Richard Nixon.       @@Kelly-qv3wg Watched the Staircase, must be a decade ago-roughly when TV show Lost was released- VERY credibly explain ALL the blood + David Rudolph, he will get off. Blood was not explained. At all, really. Was a tall order.
      The daughters (all three) suffered doubly & am sad for them. Fine women.

      @Rufus Lloyd I slipped in my bathroom and hit my head on the door frame. I've never bled that much, is was all over the floor and my jacket got saturated. So yes, you can.

    For those laughing at the owl theory it is the only theory that really fits EVERYTHING. She is outside drinking wine either Mike, has taken a Valium. She leaves to go inside. Just before the door the owl swoops and both talons make deep cuts in her scalp, but she quickly wrestles it off (There are photos online with people needing hundreds of stitches for this). This explains the pine needles and feather remnants found on her hands, as well as blood drops on walkway and door and other kniks and scratches. She likely doesn’t realize the extent of her injury immediately but realizes she is starting to bleed so she runs inside and the blood really starts to pour as she heads up the stairs. Perhaps she gets dizzy, blood runs into her eyes or in her haste she trips and falls backward down the stairs and hits her head. Now disoriented or briefly looses consciousness the blood really starts to flow. She coughs, sputters, tries to get up falls again or looses consciousness and continues to bleed without someone to provide pressure. Mike comes in after some time. Blood is drying and she is almost dead. Of course he runs to her, tries to arouse her, steps all over everything as you would, gets towels etc. I’m telling you, it’s what happened. A fall alone doesn’t make any sense with those gashes. Neither does a human attack with no bruising or brain trauma. They are lacerations fromsharp gallons and the pattern fits.

      The owl also got into Michael Peterson's shoe, stumped on Kathleen, left a bloody shoeprint on her sweatpants.

    The shitty part is that to merely defend yourself in court, you need to pretty much start your own company and have a team of lawyers that cost 1 million dollars....even if youre innocent. And if youre guilty, you can afford to be acquitted...if not, you go to a jail for the poor.

      its really unfair the prosecution gets to spend whatever they want, millions to prosecute you and only the rich can afford to defend themselves...it should be a bit more fair as to what you can do

    The owl theory is the only one that makes perfect sense. You can actually see the talon marks on the back of Kathleen’s head. It’s a shame that the neighbour who knew that there were barred owls in the trees surrounding the property didn’t come forward initially. Had he given evidence at the time , this whole case could have been solved.
    The fact is that the police despised Michael because of the scathing articles he had written about them. They were determined to frame him for his wife’s death. Michael is indeed a strange character but he’s not a murderer.
    Beware of cute looking , cuddly owls. If they feel their young are in any danger they , like most wild creatures, will savagely attack. Kathleen had gone into the front yard to place two wooden Christmas reindeer there. It’s possible that the owls saw these reindeer as a threat and instinctively attacked her.
    Owl attacks are a lot more common than people think

      i think towards the end even he knew the man was guilty. Thats why he was told to take the plea....No lawyer will ask his client ...his innocent client to plead guilty under any plea unless there is reasonable doubt. Thats what it was . he was guilty but they didnt have all the facts to prove him above and beyond.

    I’m from wicklow and now live in Nashville .
    I have had corespondents with David. While I am not involved in Law in my capacity to help others in my work I found him to be a great example of fighting for the rights of others.

    Whether you think Michael Peterson is guilty or not, David is a straight G! OG Triple OG. We be need more stand up lawyers like him in America, because the justice system is so unfair. Everyone knows the prosecutors have access, resources, and the ability to generally do whatever they see fit. All the while the defendant is limited and constantly restricted. IMO I don’t know if Michael Peterson is guilty or not, but he’s a definitely an extremely weird person. He was very strange. And I think the series the staircase actually made him seem even more weird to me. The forensic files episode of it was too cut and dry. Freda Black and Duane Devers are both scumbags and that’s the only reason I think their is so much doubt surrounding this. At least for myself. Even before the OWL theory came out I was thinking both of those prosecutors were grimey. Freda looking like Cruella Deville, with her strong southern accent would have made me shit my pants if I was a defendant. I guess that’s a compliment to her, cuz she was scary as shit! Lol

      I don't know about that... He failed to keep him out of prison the first time around & the main reason Michael Peterson is out is because of a review ordered by AG Roy Cooper of all cases involving the discredited forensic splatter blood investigator Duane Deaver.
      As far as I'm aware, he (David Rudolf) wasn't working diligently on appeals after his conviction & when he did get involved pro bono he later dropped Peterson stating he could afford to rep. him any longer without getting paid & finally rep. Peterson once again after a mutual agreement.
      In the end, he's involved in getting a guy out of jail that pleads guilty (Alford plea) & somehow PPL chose to believe an owl did it... Blood on the ceiling - Elizabeth Ratliff in Germany.
      I believe he's currently working on a book, maybe it'll be like OJ's 'If I did it'

      He got Casey Anthony off and Aaron Hernandez off of A Double Murder.
      Baez made Johnnie Cochran look like a racist Jew !

      It takes a good attorney to get an innocent man out of jail, but a great one to free a guilty one -- provided the resources are abundant. Once the money runs out, you get stuck with an Alford plea. Bravo for a job well but not perfectly done.

      Peterson belongs in prison. Look up Todd Peterson's recent video about his father allowing his mother to die from a heart attack after she babysat him and gave him a place to live when he couldn't find anyone else to take him in.

    Liked the interview quite a lot. Both the interviewer and the interviewee were great, in my opinion. I feel David is a terrific lawyer/professional! You could almost feel his passion for what he does. First time I see Michael and his interviews and gonna watch some more. Really liked his style and the way he conducted the interview. Asking good questions and letting his guest tell it all.

      Lenita A How lost are you? This was an interview with David. And to challenge him? He's a lawyer, this was based of when he was Michael's lawyer. How much do you think he can tell, other than what he has already put out in court?     Rudolf is right about the constant excuses for politicians behaving badly. The kind of people excusing every sex or racism scandal surrounding Donald Trump are often the same conservative types who would position themselves as moral crusaders against anything harmful to "Christian, family values." Nothing means anything to people anymore, they just want to be on the winning side.

      Cool. Thanks for sharing your opinion. There simply wasn't enough evidence that Michael killed Kathleen. There is a lot of evidence that suggests she was attacked by an owl and bled to death after falling on the stair. We'll just never know for certain what happened, though. If you watched the Staircase you'd know that David did a lot of pro bono work for Michael when he could no longer afford to pay attorney fees because he truly believed Michael was innocent. That speaks volumes for his character if you ask me

    What nobody mentions is at the end of the Netflix documentary, the judge says he made a mistake by having the homosexual evidence and his ex-wife death to be permitted because that was "very very prejudicial". Also, he said he thought "he could have had a reasonable doubt ". Means he was not guilty!!

    Dude it's one thing having your wife coincidentally attacked and killed by an Owl at the bottom of your stairs. It's another thing having another woman in your life where YOU were the last one in contact with, also killed from head injury and also at the bottom of the stairs.
    David Rudolf is just good at playing the legal game - if the prosecutors had an equally-capable lawyer Michael would still be in jail.

      Everyone likes to play this oh dead at the bottom of the stairs twice thing, but stairs are a common place for people to traverse day to day. If the two women had died in a car accident nobody would have said anything.
      These things just happen in life. And both women died in completely different ways. With Ratliffe there was no blood, and she was declared as having a stroke by a neurologist. That has nothing to do with Kathleen's death, which showed lacerations on her skull.
      So did he kill them both two different ways but stage both as a staircase accident? Why would he choose a staircase both times?

    This is RIDICULOUS!
    I think the original defense ( and “expert” testimony from Henry Lee) makes the most sense.
    She fell UP 3 steps, then down 3, then back UP 3, then down again. Then she stood up and slipped back down again. Then, she did the hokey, pokey but instead of turning herself around, guess what? She fell UP 2-3 steps again. Because so many people die annually from repeatedly falling UP and down the same 2-4 steps.
    The defense made $800,000 to come up with that testimony yet my 7 year old could’ve come up with it ( and the owl theory) for an ice cream cone.

      Then she saw her head was cut and used her finger to flick blood 9 feet into the air against the wall.
      After that, she played dead and when Peterson approached her, she flicked more blood onto his inner shorts seam.
      Shes a flicker for sure.

      I mean, come on..the guy did it. There is no mystery here. There just isnt enough evidence to convict him. You need a murder weapon at LEAST. Bloody clothes would help too. Where would he get rid of them? Convince me that he left his house if you want my conviction. Yes, he probably did it. But we dont convict people on probably in this country.

    Anyone who laughs at the Owl theory only do so because it's an Owl, an animal most people see as cute and even wise, rather than a more 'sinister' bird of prey like an Eagle.
    Owl attacks whilst rare can cause very heavy bleeding, can knock men to the ground and leave the 'victim' in shock, as was the case to John Mackay in 2013 who thought he had been hit by a brick:

    I've only recently caught up with the case, the TV documentary series and... the owl theory. The latter has blown my mind. It’s so plausible, and so terrible.

    I think he represented Peterson very well. What a job he had, and although it wasn’t a “win,” he did his job well. I think MP is guilty, but I do think there was reasonable doubt.

    How can it be an owl ? She left the pool area and before she came in the house the owl attacked her ? Mike clearly would of heard her scream , and a trail of blood would of been from outside to the stairs ! ( a drop of blood at the front was seen ) Why would she go upstairs when she’s bleeding so heavily rather than go to the kitchen or call on mike ...

      Actually, the pool was in the back quite far from the house but the owl theory suggests that she went into the house and out the front door to check on her Christmas lawn ornaments ( wooden reindeer) she had just put out that day and the owl attacks her out front, as that is where the blood drops on the walkway are, and the blood on the front door jamb....it wasn’t out back b the pool that the owl attack would have happened.

Also I think in one of the documentaries, at first he said he went into the house shortly after her, then later changed his story to going in 45 min later (to of course try to account for why the blood was dry).

      If you look at a Google map of the house, you can see the pool is quite a ways from the house so you can't hear anyone scream. She obviously went outside to put out those reindeer because they weren't there the day before, the neighbor said that. There was no mention of the blood in the driveway and no mention of her bloody handprint on the door. It's also very mysterious that she had debris from outside in her hair and in the grasp of her hand

    Only one of the kids is biologically Kathlee's while not biologically his. And guess what! That's the kid who is convinced that Peterson murdered her mother.

      That's also the kid who stood to receive her life insurance money if Michael was out of the way. And she did receive it (also allowing for her biological father, Kathleen's first husband, to receive a small portion of the money as well). It wasn't surprising to me that she was the only child to switch sides...she had the most to gain.

    Death by owl sounds ridiculous, I know, but it does line up, if you really give it a chance and look at it reasonably, and it answers a lot of questions that were unknown. For example, during the trial it was brought into evidence that after looking into 271 similar cases of blunt force trauma death, the victim sustained either a skull fracture or brain damage, or both in every case, but in the Peterson case she had neither.

      Your cherry picking. How many owl deaths are they? Name me in that state how many deaths by owl. Also if he fell down stairs, surely it would be by same death. Brain hemorrhage etc. There was strong evidence of strangulation on her neck. The circumstantial evidence from the phone call, to the dry blood neurons etc showed he did it.

    The first wife did not fall from a staircase. She just happened to have died by the staircase. He'll forever be referred as the staircase serial killer. One thing is for sure,Michael Peterson did an excellent job raising his kids. Lots of love and respect between him and his children.Beautiful family.To David? Love him. Love his dedication. He put his soul in the case,as did the private investigator.

Had my father did what he did,cruising gay boys and I have the slightest doubt he's a murderer of both his wives,I doubt very much I'd be as supportive as his children were to him. Also,his team of lawyers amazed me of how much they personally dedicated themselves to his case.

      if youre commenting from watching the netflix version I would say Peterson paid for it and the rest of the case were his lawyers, childfen, family members and the court room. Dont know who was telling the truth...''seems like they were all playing for the cameras. I was very surpirsed such a high p rofiel MURDER case could be privately paid for by the accused and didnt it disrupt the proceedings. It wouldnt happen in my country. no justice. and thats what he didnt get . HE DERSERVES IT

    I heard someone say Michael must have hit Kathleen 48 times. Even so, with way fewer blows, I didn't see anything about evidence of him missing. If he had to hit a moving target, blood often makes the hand slip on the instrument used, often a knife, down and get cut by the knife, etc. Although, with valium and .07 blood alcohol in Kathleen's body, it seems she could easily be knocked out.
    I did not understand the L.A. toxicologist. With the opinion that Kathleen had high tolerance being a regular drinking, BUT a therapeutic level of Valium and trace amounts of other benzos, she said she could not say how Kathleen would be affected?

    The owl theory appears far fetched, but they are large birds, they fly silently, and their talons can absolutely cause deep lacerations. Pair that with alcohol and Valium and you potentially have a tragedy.

      Very very far fetched... if it happened in the stairwell... the owl wouldn’t have had the space required to flap its wings (google owl wingspan and standard widths of staircases) to stay up in the air long enough to conduct this attack... Also, when a bird attacks like this, it would be because it feels threatened and would be highly stressed, due to this - the owl would molt many many many feathers during this short time... there would’ve been feathers EVERYWHERE! (have you ever owned a cat who’s a hunter?)
      They found a feather in her hair - which could’ve got their from her sitting outside at night lying back in a lounger - like they usually did... next time you go for a walk - pay attention to how many feathers you see just on the ground alone... (birds often make their nests in eves of homes, so when you walk out of a door (front or back) or even open up windows - is how you might end up with a feather in your hair...
      Onto the possibility that the owl attack happened outside - well Michael would’ve heard her screams for sure, there would’ve been blood outside and a trail to inside where she was found...
      My theory is they were arguing about how he was setting up dates with male prostitutes so not just cheating but putting her life in danger (aids & hepatitis alone were two massive risks at that time). He grabbed her head and smashed it on the lower steps, there’s no evidence of a fall as far as I’m concerned.
      He didn’t use a poker or any other weapon apart from his bare hands. He had done it before and thought he could get away with it again (he was defo having an affair with lady in Germany).
      Remember that the documentary was completely biased - and only included the defence’s theories and use of their specific evidence, conveniently leaving out (lying by omission) ALL of her injuries. If the FULL AUTOPSY findings were included no one would be in doubt about his blatant GUILT.

      If according to your analysis is anything to go by, banging Kathleen's head against any hard surface would have resulted in to some kind of skull fracture. And according to the expert analysis, the forensic pathologist, there were no fractures or anything that indicates banging of the head.

    I think the owl attacked her before getting to the door in the house for ever reason she didn't scream just ducked her head and ran for the door didn't realize how bad it clawed her head and fell down the stairs no other way to explain the microscopic owl feathers in her scalp and hair

    Yeah, he's pretty awesome considering that many defensive lawyers aren't exactly liked, but he's different because he cares about the law and wants to ensure that it is practiced correctly, so he's got a great sense of himself but he's also very good at his job. I'd hire him if I needed him but I don't have the money to afford his council. >. -

    Peterson has already exonerated the killer owl by stating in his two 911 calls, each of which he cancelled, that his wife at the time had fallen down the stairs. The killer owl's lawyer therefore calls Peterson to the stand as a witness.

    The OWL THEORY. My family moved to Raleigh, NC. Every suburban home there has been literally carved out of the wild life of NC. Deer, bear, rabbits, and birds of prey are in the area among the houses. Here in Grosse Pointe, MI (Detroit) we have squirrels & that's it so it's a big difference.
    You left something crucial out in FAVOR of the OT. There was blood OUTSIDE on their door and along the concrete path in front. Why would there be blood outside? WHY didn't the cops do DNA on that blood? Wasn't it hers? They were hacks in this case because they hated Peterson because he bucked the Republican local religious status quo & he was in the closet. These people are Trumpers and he lived in Europe for a time ffs.
    Anyway, the owl attacks her and she tries to walk upstairs. Just as in the recent HBO fictional series. The fall and the blood spatter from choking & spitting make sense. The main bit of EVIDENCE is the pattern of her wounds on the top of her head. They fit perfectly as an OWL's talons!
    "How many owl deaths have we heard of?" Silly question. She wasn't literally killed by the owl, she was just wounded by it. The steps and a heavy couple falls sealed her fate & Michael not doing anything to help her made sure she died. So, he is likely guilty of manslaughter or second degree because he sat there and wiped up blood and waited for her to bleed out. Yes, he needed her money. No, he would not have smashed her head in with a poker but this was too good to be true for the creep. It's like her death was served up to him. He has NPD (we didn't talk about this when she was killed or even when you posted this video. Now, with the Depp/Heard case we hear about it daily. )
    So, the OWL THEORY is 99% spot on. The 1% question? Um...it might be a 10% question to be honest. WHAT ABOUT THE STRANGULATION WOUNDS? No one on either side even brings them up! They could not come from the owl attack nor the fall. So these hacks on both sides in Durham (hillbillies in the end, no matter how much money they have) don't even bring up the wounds to her neck & throat.
    So now what? Kathleen was attacked by an OWL outside as she put the Christmas deer out. Blood on the walk and door handle as she got back in the house. The OWL is gone. She walks to the stairs, up a few & starts to bleed out. She falls back & that accounts for the rest. Liar, liar pants on fire, who couldn't live as he wanted to because he didn't live in New York or LA, saw his opportunity and strangled her to end it. Michael has never been innocent, we just haven't known how it went down. Why can't people see this complete version? Tell me where I am wrong.

    Thank you for finally hearing something intelligent about this case. I did not like the documentary because I found it boring. However, `i never believed that Micheal Peterson was guilty. The people who prosecuted him with that flimsy, ridiculous evidence should be on trial themselves for malicious prosecution and harassment.

    I watch alot of wrongly convicted shows/podcasts and 99.9% of the time, I agree with them. This time though, from not just the documentary but from research I've done on this case, I can't believe that anyone can think that Peterson isn't guilty. I know your lawyer has to believe it, but it's obvious that Peterson killed his wife. I know all the issues the prosecution made, but regardless there's more information to show that he's guilty

    A very sad yet compelling case. When I first saw the autopsy photos the first thing that came to mind was how much the marks on her head looked like talons. There was an incredible amount of mishandled forensic evidence. Also many things brought up during the trial that were not relevant to the trial just to try & discredit Mr. Peterson’s reputation. The evidence should speak for itself in the courtroom. So glad this poor family can finally get on with their lives.

    @David Rudolf please dude - if the blow poke had blood on it, there would've been no "found blow poke" in the series or on your record. Don't act like your case was in any way threatened. Really convenient for you to just "find the blow poke" one year later in the house which you use as evidence for your case.
    Also - stop holding the state/prosecutor's case to the blow poke. Someone as smart as you should realize that just because you could prove it's not "the blow poke" as the murder weapon, doesn't mean there was no murder weapon? The state made an educated guess that the blow poke was used because there WAS NO EVIDENT WEAPON on the scene (obviously Michael isn't going to leave the weapon on his wife's corpse if he committed the murder) and the blow poke fit the POSSIBLE weapon category purely because it was missing. Disproving the blow poke as a weapon doesn't win you your case nor prove Michael not guilty.

    the movie never mentions owl theory, it's fkng ridiculous that they don't mention it, imo it's what happened and as soon as I heard about it I thought "well that's what happened!" but of course the series needed to keep michael as the possible murderer and so they left it out

    Sure, it sounded ridicous when i first read about it. But what finally convinced me is the fact that there was no broken skull. How do you have massive blood everywhere and no skull fracture? Razor sharp talons.

    The owl theory is ridiculous, especially since the temperature was about 55 degrees/12 degrees and Michael stated he was outside for nearly an hour whilst being dressed in only shorts and a t-shirt. Also, Kathleen was on the PC upstairs with a recorded email sent around midnight.

      The owl also got into Michael Peterson's shoe, stumped on Kathleen, left a bloody shoeprint on her sweatpants.
      Even imbeciles can not swallow that shit. Even Rudulph couldn't swallow that shit, because he would have to explain that bloody evidence to a jury.

      FACT: Somebody was cleaning the blood from the wall.
      FACT: A bloody shoeprint print was found on her sweatpants.

    My ex-husband's sister was attacked by an owl as a teen in TX. It had a horrible grasp in her hair (she had really thick and long hair then) and it pulled out a ton until her mother came running out of the house with a broom beating it off of her head and it finally let go and flew away before there was too much blood shed. She was terrified and pretty beaten up.
    Kathleen could have encountered it outside by the door, freaked out, ran in, was floundering about in shock, a little drunk causing all the injuries to the body, trying to get it off her head. I think Michael came in in saw her there, freaked out and didn't know what to do and he and Todd (who was forced by his dad) staged the scene to look more like she went down the stairs becasue Michael was worried he would instantly be accused becasue of his bad history with the DA and the 'past stair death'. There's no way he and Todd would have really known what had actually happened with the owl at the time of death... they could not see the OBVIOUS talon marks on her head then, he just knew that he was gonna go down for it and manipulated the crime scene more to his favor. That's why they did not find her fingerprints on the wineglasses and the broken cartilage was already weak from the accident she had in the pool just a few weeks before.
    They had bats in the attic, owls are predatory, meat eaters. Bats would attract owls, not to mention they are everywhere. I live in the south and have seen them in the trees in my own back yard, you can hear them hooting.
    I think that Michael is a horrible man, tho and a chronic alcoholic. I think he was verbally abusive and messed up everyone he claimed to love and lied about everyone and everything. Family filled with secrets needs much healing. Lose lose for all.

      My daughter had a slight gash over her eyebrow and I was shocked at how much blood was dripping on her face, you would have thought somebody bashed her skull in with a bat, but it was maybe an inch long. The head and face in particular bleed quite a bit

    If there had been an owl attack, there would have been multiple feathers in her hair, on her cloths, and on the ground, not just the one microscopic feather mentioned in the autopsy. I would also expect to find multiple cuts on both her hands and forearms from her instinctively batting and grabbing at the owl. There would have been yells, and calls that none of the neighbors reported hearing. It was late at night in a quiet neighborhood someone should have heard something. Finally, Rudolf's hired experts testified that the injuries on Kathleen's head were caused by blunt force trauma. Even his own witnesses didn't mention any kind of sharp instrument (the owl's talons). Rudolf can't have it both ways.

      Their pool had a running fountain. It was fairly wooded nature esk backyard with a decent walkway and turn from the pool.. Maybe she didn't scream, or wasn't heard. They did sound tests with speakers and you couldnt hear a peep. Like he said when she left the pool, he stayed to relax and probably smoke and drink more distracting himself to noises over a heavy fountain if she did scream outside. There's a laceration on her head that literally looks like a talon. And they dis proved the blow poke, as the cops actually found it that night, photos with it then hid it, to be found later by the son a yr past. You have to be a woman. A 2019 woman. Stick to grammer not crimes.

      I hope you realize that there is not one iota of proof that they were anywhere near the pool that night. Michael Peterson made up the story. No proof at all, no corroboration, none, zero. However the documentary presents it as factual but it is not (remember Michael Peterson had a 15 year romantic relationship with the editor, Sophie Brunet, of the documentary "The Staircase"). Let's remember Michael Peterson lied about having earned 2 purple hearts when he had none. I regard that as a pretty despicable lie. He also had a secret "down low" lifestyle that he very effectively concealed for years from his wife, children and all the neighbors. Kinda despicable too I would say. Etc. Etc. Etc.
