Hi Ralvdie. You're currently under implied status, which means you can only work for your current employer. If you wanted to work for a different employer (for whatever reason), you'd need authorization to do this.

Hi Susana, I would advise to not work in this case in order to err on the side of caution. You usually can’t piggyback an application off of maintained status, as it’s not a status itself. I’d wait for the work permit to arrive to start work.

Hi Bridgit, IRCC does not confirm implied status. If you need proof for your employer, you can show proof that you submitted the application before your work permit expired. This includes copies of the application, the fee receipt, and something that confirms the date it was sent and delivered.

Hi there, You have maintained status as long as you applied before your last permit expired. Maintained status does not expire (even if the government issued you a letter saying this).

Hi Abdou, you can benefit from implied status if you apply to extend your existing status in Canada. For example, if you are on a closed work permit, and you apply for a work permit extension, you can continue working. However, if you were on a work permit and applied for a visitor visa (different status), then you cannot continue working.

Guidance from IRCC says that you should only work if you had a valid study permit at the time of application. To err on the side of caution, I would not work until the PGWP arrives.

She has already applied for her PGWP extension as she did not receive her full length of PGWP as her passport was expiring. She has now renevewed her passport and already made a PGWP extension application. My question is will she be able to return back and continue working full time while her PGWP extension is still under review? Hello, no she should not leave while on maintained status, she may be able to re-enter but then she cannot resume work until there’s a decision on her work permit .

Hi Hunter. If you applied to extend your work permit before your initial work permit expires, you can keep working, even if your SIN is expired. I would provide proof to your employer that you have applied for a new work permit and provide them with information about implied status. Best of luck!

Hi Alvin, We can apply for a work permit while she’s in Canada, but it takes about 5 months to arrive, so be prepared for this. She can work online for an out of Canada application the entire time, if that’s something she can do or find.

Yes, you should apply for the Post-graduate work permit as soon as you have the letter of completion from your school. You’ll need to have valid student status or visitor status at the time of application, once you apply you have implied (now called maintained status). You can start working full time once you’ve applied for the PGWP. As far as travel to your home country, you could leave, and should be okay to come back on the study permit, but the safest option is to wait until your new work permit arrives. Make sure you have a valid TRV as well for travel if you need one.

You likely filed an out of Canada work permit, which means that your status is not maintained, you’ll need to extend your visitor record before the end of your 6 months in Canada.

I left Canada to renew my passport and to apply for an extension of my PGWP. However, the Canada visa application center in the country I live in was closed from the 15th of March to the 1st of July due to COVID-19. However, the expiration date of PGWP was on the 15th of May. Therefore, I had to apply after the expiration date of PGWP when I knew from the CIC website that we can submit an online application for a work permit. Today, I received a rejection letter from IRCC regarding my PGWP application because I applied after its expiration date. I want to appeal this decision, but I don't know how to go about it. I really advise against travel whilst on implied/ maintained status, there is a big risk that a CBSA officer will not allow you to enter. Also if you need a visa for Canada to enter, this would also be required.

Hi there, if you apply for an extension of your status then you’ll have maintained status. However if you leave Canada, you lose the authorization you had based on the maintained status. So, you can return to Canada and be allowed entry as a visitor (you may need a visa), but you won’t be able to work or study until the new permit arrives.

Hi there, you can submit a work permit application with proof that the LMIA has been submitted, this will keep you in status and allow you to keep working.

Hi Jade, very informative video. Thank you. How does the following work? Currently a person works on Post Graduation Work Permit (in other words Open Work Permit). The Post Graduation Work Permit (PGWP) will be expiring soon and therefore applying for an extension of work permit which is a Closed Work Permit (Employer Specific Work Permit). Can this person continue to work for 2 employers under the same conditions of Open Work permit until a decision is made on the application? (This is called the Maintained Status). The type of work permit changes from Open Work Permit to Closed Work Permit in this scenario. Awaiting your response. Thanks.

Hello Naveen. I advise my clients not to leave the country while on implied status. You could encounter issues at the border and be refused entry.

We can apply for a work permit while she’s in Canada, but it takes about 5 months to arrive, so be prepared for this. She can work online for an out of Canada application the entire time, if that’s something she can do or find.

Yes, the regulations allow for implied/ maintained status even if your letter states a date, you maintain status as a worker.

I'm completing my study last April 2022. Sep 30, 2022, is the expiration date for my SP. I will need PGWP and extend my SP as I will work and study for CPA in Oct 2022. I will apply for both PGWP and extending SP before the expiration of my current SP (after 90 days of graduation). Would implied status apply to me? Can I work while waiting for both applications to be approved?
I also plan to travel back home while waiting for the application processed? Would I be allowed to work if I come back more than 90 days after graduation and my applications have not been approved yet?

Yes, you should apply for the Post-graduate work permit as soon as you have the letter of completion from your school. You’ll need to have valid student status or visitor status at the time of application, once you apply you have implied (now called maintained status). You can start working full time once you’ve applied for the PGWP.
As far as travel to your home country, you could leave, and should be okay to come back on the study permit, but the safest option is to wait until your new work permit arrives. Make sure you have a valid TRV as well for travel if you need one.
Hi, my wife is here in Canada on a six month travel visa and we have applied for a spousal sponsor ship in the country. After her visa expires will she will still be able to remain in Canada under implied status until they give us an answer about our spousal sponsorship application? Thanks

Im under implied status (study permit to PGWP) and travel outside of Canada; the immigration officer allowed to me enter the country with student visa, but he said…I shouldn’t be entering ti Canadá because i dont have valid visitor visa, but for some reason I was allowed to enter with the condition: I can not work, until a decision of PGWP is made. will this case impact my PGWP approval?
No as long as your PGWP application was complete and you qualify you should be fine

You likely filed an out of Canada work permit, which means that your status is not maintained, you’ll need to extend your visitor record before the end of your 6 months in Canada.

No, you must extend your passport before it expires, then extend your study permit and any other applicable Canadian permits or visas.

Hi Sadah, you cannot extend a PGWP. If your PGWP expired and you want to work in Canada, you must apply for a new work permit.

I was only given 6 months of PGWP based on the validity of my passport. I left Canada to renew my passport and to apply for an extension of my PGWP. However, the Canada visa application center in the country I live in was closed from the 15th of March to the 1st of July due to COVID-19. However, the expiration date of PGWP was on the 15th of May. Therefore, I had to apply after the expiration date of PGWP when I knew from the CIC website that we can submit an online application for a work permit. Today, I received a rejection letter from IRCC regarding my PGWP application because I applied after its expiration date. I want to appeal this decision, but I don't know how to go about it. Hi there. Yes, my understanding is that the CRA allows you to use the expired SIN if you’re on maintained (implied) status.

You should apply online, she'll need to be working in a skilled NOC position (0, A or B) full time and provide evidence of this.

I really advise against travel whilst on implied/ maintained status, there is a big risk that a CBSA officer will not allow you to enter. Also if you need a visa for Canada to enter, this would also be required.

Hi there, if you apply for an extension of your status then you’ll have maintained status. However if you leave Canada, you lose the authorization you had based on the maintained status. So, you can return to Canada and be allowed entry as a visitor (you may need a visa), but you won’t be able to work or study until the new permit arrives.
