1. The police spoke with Mr. Brooks for over 20min, trying to get his side of the story, and determine how intoxicated he is.
2. Mr. Brooks admitted he drove drunk, which is a crime. He stated this more than once to the police.
3. His BAL was way over the limit, a .108, proving that he lied about how much he had to drink.
4. When the police attempted to handcuff Mr. Brooks, he chose to resist arrest, and fought with two police officers.
5. Both officers went for their non-lethal tasers. He was warned several times that he would be tased. The taser was deployed on Mr. Brooks, having no affect.
6. You can see Mr. Brooks punch at least one officer approximately three times.
7. Mr. Brooks stole one of the tasers and pointed + discharged it at one of the officers.
8. After these events, it is reasonable for the officers to believe that Mr. Brooks poses a threat to them after he attempts to tase and beat them. Mr. Brooks could not claim self defense because he was in the process of being placed under arrest when he started resisting.
9. Deadly force is used 36 seconds after the moment Mr. Brooks resists arrest.
NONE of this has anything to do with the color or Mr. Brook's skin, and EVERYTHING to do with his choices. He chose to drive drunk (possibly killing other innocent people), he chose to lie to the police about how much he had to drink, and he chose to fight and resist.
Had he made better decisions, this tragedy would never have happened.

Yes, drunk driving certainly doesn't warrant a death sentence, neither does running from police, and a missed taser shot isn't lethal by any stretch. You're making up what If scenarios to justify an overreaching large government killing a citizen, doesn't sound very conservative small government minded to me.

And by your same logic if I shot at you and missed there would be not problem because I didn’t hit you right. Apply your logic to different situations and see what happens. Now do I think a taser is a deadly weapon. Not really, but the DA apparently does charging those cops before. In my opinion it’s justified but not the best course of action
Feel bad for those officers, imagine getting arrested because you did your job and had to shoot someone.
Yeah, imagine having a family and working hard being assaulted everyday, imagine at the end of your shift after a hard day during riots, you arrest some guy who is a child abuser, domestic violent and loads of other shit, he punches you, shoots your partner with a stolen taser, and then you get 11 felony charges against you.

5star D imagine being that dumb yes there has been isolated incidents where race has played a factor, but in this case, especially in this case it wouldn’t matter what you are, if you were a convicted felon with things like domestic violence, being charged with a DUI assaulted me and shot a perusing officer incapacitating them with their own non lethal which you stole, I would be inclined and feel threatened with certainty that you could act in a way which you could further endanger not only me but members of the public. If you were in that scenario where your partner had been incapacitated and the person you’re perusing had a weapon would you not react, even in just fear?!.

I'm not going to condemn that officer for killing him in the moment, but if that's me (and I'm in my right mind) during the confrontation, I wouldn't have shot him after he discharged the taser. I feel I would've been completely justified to shoot him as soon as he grabbed it, but not after he already shot it. That would be on my conscience for the rest of my life.

When tasers were first being brought in to the police department, we were instructed that while a taser could cause a death, it was not considered use of deadly force (although in rare cases it could cause death). The next comment by the instructors is more important. They said that if a suspect gets your taser and is going to use it against you, what is he (she) going to do to you when you are incapacitated. We were taught that the SUSPECTS use of a taser against you IS deadly force. We were to respond in kind.

Unarmed in general is meaningless. Trayvon Martin was unarmed. He was also in the process of trying to kill George Zimmerman with his bare hands when he was shot. If Mike Tyson in his prime threatened to punch your face through the back of your head it's a credible threat of lethal force.

To make it even more annoying, from all the occurrences of this story in the media they do not show the bodycam footage nor the surveillance camera because it would ruin that narrative.
The DA’s statement was complete crowd control and is an absolute joke of a charge from a legal standpoint. I pray that the defense attorney in charge of this case does his best for the future of other cases and these officers and isn’t shit.

HOTPOCKETHunter well according to investigators the taser had been fire twice before Brooks stole it, so lethal or non-lethal, it doesn’t matter as the taser had no use, also according to investigators. Then again if that were true I have no idea what the things coming out of the taser on the CCTV footage are.
Per Georgia Law, a taser is classified as a “less-lethal” FIREARM as they do occasionally cause death.

These offenses are important because there is a case law called Tennessee v Garner
What Tennessee v Garner states is:
“When a non-violent felon is ordered to stop and submit to police, ignoring that order does not give rise to a reasonable good-faith belief that the use of deadly force is necessary, UNLESS it has been threatened.”
So this goes back to the taser being classified as a firearm that can cause death or great bodily harm.

The 2nd officer chased after him and tried to use his own taser against him, but he didn’t get a good connection.
Brooks then turns, aims the taser at the officer, and fires. Statutorily, this is no different than firing a gun.
(The taser that APD carries has 2 cartridges, so Brooks could have potentially shot the officer twice.)
The officer dropped his taser from his left hand after it appears he was hit by a barb on the video, draws his sidearm, fires 3 shots, falls against a car in the parking lot and Brooks goes down.
Brooks was not only a continuing threat to the officer since he could still fire the taser again, but he also showed and EXTREME desire to get away, with a weapon. So it is not unreasonable to have the fear that he would use that weapon to carjack a motorist sitting in the drive-thru line, take a hostage, or otherwise hurt another innocent party.
What does Georgia Law say about deadly force?
OCGA 17-4-20 (b):
Sheriffs and peace officers may use deadly force:
1.) to apprehend a suspected felon only when the officer reasonably believes that the suspect possesses a deadly weapon. (He did)
2.) to apprehend a suspected felon who possesses any object, device, or instrument which, when used offensively against a person, is likely to or actually does result in serious bodily injury. (He did)
3.) to apprehend a suspected felon when the officer reasonably believes that the suspect poses an immediate threat of physical violence to the officer or others (He did)
4.) to apprehend a suspected felon when there is probable cause to believe that the suspect has committed a crime involving the infliction or threatened infliction of serious physical harm (He did)
The officer only needed one of those requirements, but he had all 4........
Now the reason taser’s are considered “less-lethal” is because when used appropriately, you are “less likely” to kill someone vs using a gun. But Brooks hasn’t been through the training to know how to avoid certain vulnerable parts of the body, and he doesn’t understand how neuromuscular incapacitation (NMI) works, which makes it MORE likely for him to cause great bodily injury or death than if an officer used it.
And just to support the fact that tasers can and do kill, there is an East Point Officer currently sitting in prison for improperly using a taser and killing a man a few years ago.

I believe the particular police department shown in this video uses 2-shot tasers. Don’t quote me on that, and correct me if I’m wrong, but I’m fairly certain that’s the case. I’m sure you know where that could go very wrong very quickly if he hadn’t been taken care of after the first shot.
Hey donut! I just looked at the footage again. The cop who got tasered had even used a taser initially before switching to the gun.
If the rayshard cops get charged then the ones that pulled the kids out the car should be let off the hook because the DA just invalidated his own point.

I think by charging one cop for using a taser as a deadly weapon and then saying a suspect with a taser isn't a deadly weapon invalidates both cases

If a bat can be a lethal weapon in one case, it can also be a non-lethal weapon in another, and it can be a piece of sports equipment in yet another.

Good Point: The “Fine” Fine Print of every general liability and indemnity insurance contract ever written. The best part was the family coming out today to talk to the press.
They got to the part where it was his daughters birthday and how he was supposed to go skating with her(very sad, for the little girl) but now will never be able to. Trying to paint this loving father picture. except for the tiny problem that daddy was getting pass out drunk and wouldn't have been there anyway.

Even if this cop who killed Brooks is free of all charge, he's gonna continue getting death threats, he honestly probably have to move and delete all social media etc.

I dont think thats going to happen. I live in GA and have family members who have been incarcerated. The Justice system here is corrupt and I believe the officer who did the shooting is going to get thrown away for a long time. I really hope they dismiss the charges, but I highly doubt that will happen because of how much the public has gotten involved.

But here im Ohio, you can only get charged with aggravated assault if it the crime was in a "sudden act if rage" and "caused serious physical harm". So, if someone attacks you with a pillow, you could technically charge them with normal assault (In Ohio). Also, some departments have tasers equipped with a second cartridge on the handle, so he could have loaded it up again and tasered again. Any of those two ways could have been used on either the police officer or a bystander. If it was used on the officer, the handgun would have been at full disposal of the guy

I think it gives the content some nice room to breathe, and you can expand on previous commentaries and new developments without trying to jam it all into one video. I also appreciate you explaining concepts like the use-of-force continuum; explanations like that, how police officers approach situations, are really why I started watching your channel in the first place.
I think my one piece of unsolicited advice would be to stay off of Twitter. Social media is really not worth anyone's time, and it seems clear that it just aggravates and disheartens you whenever you go on, and it never seems as though you feel like you spent your time productively arguing with people on there.

Technically, at the time of shooting, he was unarmed. He had deployed the taser, wildly into the air, without re-inserting the probes, he had used his one shot. Then he was shot three times in the back.

Once Rayshard Brooks fired the taser and missed, it was virtually useless. I don't think he had training or (given that he was drunk) the wherewithal to convert it into a stun gun. Wasn't he effectively unarmed when he was shot?
The officer also laid hands on Brooks in the first place without saying he was under arrest. Brooks was compliant, why the hell was he being cuffed?
Furthermore, under Stand Your Ground law, didn't Brooks have a right to defend himself against assault?
Lastly, involving the use of force continuum - if it can be shown that a particular officer repeatedly *cannot* self-regulate their use of force to exactly one level above the threat -- should it be time to bust them down to "Power Rangers" rules and force them to _match or remain below_ the percieved threat?
Yes it poses additional risk to the officer, but IMO, public safety comes first.

Tasers CAN cause heart palpitations, especially if the prongs land too close together. Admittedly though, not super common.

The statute says “or any object that can be used in a manner that results in serious bodily injury”. The OR is important because it means the taser doesn’t have to be considered a deadly weapon but if used improbably can result in serious bodily injury.
@Donut Operator just wanted you to know I JUST saw on the news in Nevada, Iowa a man had a sword and was knocking door to door when an officer tased him and he passed away. They’re currently investigating whether he died due to the taser or other causes but either way, I think it’s good evidence toward a taser being more towards lethal. Also, I’d consider a sword pretty lethal but a taser was opted for first in this Iowa case. Either way maybe you’d like to look into it! Love your content especially at a time like this! Thank you!

I was going back and forth with a woman on twitter yesterday. She thought he was killed for sleeping. Then she thought she got me with "When did they do a breath test?" after I mentioned he was drunk. Best part was a guy chimed in with stills of him breathing into the unit and his BAL on the machine itself. She was silent after that. She had no actual knowledge of what happened, other than what she was told. You shouldn't be surprised.

2. Pursuing Officer deploys taser- no joy.
3. Mr. Brooks turns, fires stolen taser to incapacitate the 2nd officer. Fails to do so.
4. Officer uses gun to end threat.
Take aways:
1. DUI is bad... Don't do it. Bad choice. 👎
2. Being cooperative is good. No fights, no brutality, no shooting. Both sides treat the other like humans. Good choice. 👍
3. Officers decide he is too drunk to be on the road. It sucks, but they arrest him. Just doing the job keeping others safe. Neither good or bad, but officers had no real choice after he blew that high.
4. Mr. Brooks attacks officers, downs one, steals weapon, uses it to attack the other officer (and using a Taser to commit a violent crime is an aggravating factor in GA law as I read the statute/case law as it can cause "serious injury"...but I'm not a lawyer). Many bad choices in a row. 👎
5. Officer reacts to taser shot (would like to know if either barb hit him, but he sure jumped) and uses lethal force. I don't know his thoughts or his heart... But seems a reasonable call. Choices have consequences, and he died for his bad choices. I'm sorry he threw away his life.
6. The shooting officer's life is ruined. He has lost his job, may loose his liberty, and quite possibly will lose his life if the "peaceful protesters" get hold of him. His family is threatened as well. I'm sorry he did the right thing, but it looks bad right now... so his leadership will break all their promises to give the mob a human sacrifice.
7. I, a white male, have the "privilege" of being more than twice as likely to be shot and killed by police when unarmed than someone with a much better tan. (Ps. Sunburn sucks... Yet another privilege.)
Mr. Brooks was a human, and I wish he hadn't forced the officer to shoot. Mr. Floyd was a unreformed criminal who didn't deserve to die in custody. The officer who kept pressure on his neck should go to trial, and jail if convicted. (In NM I would advise Murder 2 with "depraved interference" as a factor. But, not a lawyer.)
Protests are part of our rights. Yell, walk, call politicians... That is all right and good. This is the way to make America better... By getting enough people to work together to change the system.

i'm not one of those "everything the cop does is police brutality" type of people and I'm even trying to become a police officer. I wouldn't consider it lethal because if your're an officer, I'm pretty sure everyone in academy gets tased and pepper sprayed so you can handle that, know what it's like, know what to do. A person shouldn't be an officer if they have heart problems and a taser is possibly deadly for them, they aren't physically healthy enough to have the job. Even if Georgia law says it's justified, isn't the whole point of these protest is to have police reform? There was 2 officers there, one was shot at with a taser and the taser missed, and if it did hit the officer, do you think the guy would've stopped running yo continue tasing while his partner is running towards him? Officers shouldn't be so quick to pull out a gun when they know the suspect doesn't have a lethal weapon (in this context because a officer shouldn't have his heart stopped if he was tased...) and the suspect isn't beating the shit out of somebody that will possibly kill them. Only when someone is a threat to someone's life is lethal force on the table, and I don't believe a taser is when used at officers.
On one hand someone can claim that the officer was in the right for using lethal force since he attacked an officer stole his taser and tried to use it against them. They can claim that the suspect basically was a threat them or the people around them based off his actions.
On the other hand someone can claim it was excessive force since he technically wasn't a deadly threat and there for using a gun on him was basically over kill. For example if someone peper sprayed someone else is it justified for the person who was peper sprayed to use lethal force? To me no but that changes if that's a cop making an arrest and that person is avoiding arrest using a non lethal weapon.

There's that tricky "OR" that's placed in between "deadly weapon" and "any object". The DA might have considered the taser under "any object", implying it can cause harm but is still not a deadly weapon and thus, non-lethal.

There is a difference between single shot (discharge) with taser, and multiple discharges, and especially frequent multiple discharges. One shot might have negligible probability of injury, shooting again and again may increase this risk significantly (e.g. of cardiac arrest).

The actual wording of “less than lethal” does not insinuate “non-lethal”. A taser is not called a “non-lethal” weapon (meaning it is never lethal); it is called a “less than lethal” weapon (meaning it has a greater chance of not being lethal without eliminating the possibility). 100% justified in any court of law. Period. And if this DA places charges on this LEO, I pray a band of attorneys will descend upon him quicker than he can think!
wrong, just wrong. if the chances for a taser to be lethal were high enough it wouldnt be the go too for every police officer. also the threat of him using the taser is incredibly small considering they work only 40% of 50% of the time they are deployed. if some miracle happened and the taser actually hit the officer and worked the drunk man running away would still run away, and the second officer on the seen would still have been there either way to cover his partner. you cant assume someone is going to kill you when they dont even have the means to do it.
I hope the 6 other officers charged in the other incident immediately motion to dismiss considering the DA literally said tasers are non lethal.

@that guy, over yonder oh? then why did the cops shoot him? they dont know what he was going to do after missing with the taser. he is already running. running away is inherently non confrontational. his instincts told him he is black and those white guys are going to kill you.

If the charges run directly through the heart it can stop the SA av node meaning your heart will stop.
The same if it runs through the brain it could kill.
I'm honestly sad for the loss of life but the action taken by the police is justified.

For those not understanding how strong a proper taser connection can be, its not a "non-lethal". its a "Less-than-lethal" meaning it has a lower chance to push an off switch, but under right situations still can. Hope all works out for the officers.
