    Thank you very much. I need to know that I am doing my NCLEX in Australia. I don't have any idea about advance directive and HIPAA is applicable for my NCLEX. But I am practising the US question bank.

    What about implied consents? Like a patient who’s depressed verbally consenting to surgery but won’t sign the paperwork? Can their significant other sign if they discussed it together?

      If a patient is capable of consent (an adult, cognitively intact, alert and oriented, sober, etc.), no one else can consent for them unless there is a court order or the patient has a power of attorney, etc. Implied consent exists for emergency situations. So, if someone comes to the ER and they're unresponsive and unable to provide consent, we treat them anyway under "implied consent," because it is implied that a reasonably prudent person would consent for the life-saving interventions. Of course, there are specific state laws and different contexts when it comes to each patient, but a patient who is legally capable of providing consent must be the one to consent in the majority of cases. --Meris

      @@LevelUpRN I was a little confused about implied consent and informed consent. I answered that it was only the patient who can consent for themselves on my exam since I was thinking the procedure was not an emergency based upon reading the question, and I got it right. I actually saw another video of Cathy on her mental health playlist after watching this video, so that was really helpful for my final exam. Thank you for clarifying that, Meris! 🩵
