ASSAULT & BATTERY are two difference offenses. You can actually commit a BATTERY without first ASSAULTING someone.
There is also the concept of a MEDICAL BATTERY. This would be something like a patient granting CONDITIONAL CONSENT to the doctor before going under anesthesia. “If the doctor sees X he has consent to remove Y.” But if the doctor goes in and DOESN’T see X, but removes Y anyway, then he has committed a MEDICAL BATTERY, no assault required.

Does a right to refuse conflict with physical and chemical restraints? Certain circumstamces(violent) forfeits a pt right to refuse? Are there any other rights that can be forfieted due to circumstamces?
Please give an example of negligence i always get confuse with malpractice and negligence
She did :) Negligence is not doing what a nurse is expected to do.. like fall prevention. Malpractice is not double checking your giving right meds to the patient
2:59 *FALSE IMPRISONMENT:* _”So for instance, if we have a patient that we have put in seclusion, and we didn’t have an ORDER for it, that would be false imprisonment.”_
This is the second nursing video I’ve watched on this, but neither one explains what they mean by “ORDER.” An order from who, a judge? … an order from a doctor? An order from a senior hospital official? What do you guys mean by this?
An order from the doctor. You have to have one with restraints! :)
