RK17 SNV - pavement, wrong side of road, abuse and threats 20180502

  • Reported to Roadsafe.
Driver was charged with driving without due care and attention and had a fine and points.
I asked the police if they wanted my to report the other drivers, but they said "no"...
I was told by the police to not make this clip public on GDPR grounds. I questioned this as I didn't think there was any personal information in the clip. The response was: if the person involved finds the clip online they can request that it is removed.
(per comments, apparently vehicle registration numbers are "personal information".)
Lets hope the Streisand effect takes hold. :D
I asked if I should report the abuse and threats and was told that it wouldn't be worth it as there was "goading on both sides".

In such a rush to illegally mount the curb that he had plenty of time to stop and get out of his car and shout threats even challenging to fisticuffs. What a 110% 🔔END

Courts have been quite clear that you have no expectation of privacy in public places. I don’t see how GDPR applies here. Number plates are publicly visible, that’s kinda the whole point of them

cyclists are in a very funny position tho, they are frothing at the mount to put the plates of cars in their titles, yet if they do something illegal themselves, they can't be identified cause they don't have plates. Bit of a double standard, don't you think?

It's ironic how the car driver, after mounting the pavement to pass the stationary HGV so as not to get held up for another minute, ended up holding up the HGV, while he stopped and blocked the road to perform a public order offence to a cyclist for simply cycling.

Licence revoke. Certainly not the temperament to be in charge of a motor vehicle. Send the video to his Insurance Company. They may decline to cover him and that will have far reaching repercussions.

Anyone can request RUclips to remove a video and that is a decision for RUclips. It has nothing to do with the police.

themitsky yes, and it's a civil matter, not a legal matter. The police can advise you of that ONLY. They don't have the power to enforce a take down unless it is court ordered on the basis of a civil case being raised or investigation by the ICO based on data protection grounds.
The DVLA *does* in fact classify VRNs as Personally Identifiable Information, so you should be cautious in how you view the classification.

    • @doug7844
      @doug7844 3 месяца назад +1

@@GreyFoxNinjaFanI’d beg to differ on this information. VRN’s are almost always identified on a public highway.
No one is entitled to privacy in a public domain and only people in a position of authority can use the information such as VRN to identify the motorist behind a VRN.
it’s also conflicting when the DVLA themselves allow you to vehicle check a VRN for MOT, insurance etc.

Telling anyone with a driving license they have made a error is more than they can bear. Everyone who drives on British roads thinks they are professional and expert and no amount of discussion will persuade them otherwise. Better to just record and report to police and not discuss.
