Did he agree to move out in writing? Did you make a written demand for possession? If not, you may have extended delay if you later have to send notice to begin the eviction process because he fails to honor a purely oral agreement.

I went over there Thursday to fix something, her dad let me in and i tried to hand her the vacate letter but she didn't want to come out of her room and talk (i have it in text message) so i taped the letter on the inside of door and took a picture of it, hoping that is good enough. Having the full number is helpful, but, by Texas law, you can only record the last 3 digits of their social security number in an Abstract of judgment.

You can report the fraud to the police, but little is likely to result from that. However, in the State of Texas, if your lease states that misrepresentation in the application process is a default of the lease, you can issue a 3-day Notice to Vacate and begin the Eviction process on this basis. How are you certain, though, that this was a misrepresentation? Remember, the burden is on you to prove this at trial. Good luck!

We woke up one morning to DEA agents all over the place. I was baking down the driveway with the kids and there were men with vests and drawn guns in my driveway. They did move aside and were very polite. I rolled the window down long enough to give them permission to be in my yard and left.

Why not send notices via Fedex or UPS? Upon delivery to the home, Fedex or UPS uploads a photo to the delivery instructions. Send it with signature required. They will update delivery attempts. You copy and paste the information into a Word document.
These are definite options. I always tell landlords that in the court's eyes, you can never give too much notice. The problem is not giving enough notice. The real key is when you can prove at least 1 valid method of notice delivery, as required by state law. If you can prove 3 valid methods and 3 additional methods, that's even better, and this strategy limits the ability of a tenant to claim they never received the notice, which happens often.

I sent one of our tenants in Michigan a notice of non-renewal 5 months before the lease ends with an out from the lease if they wanted to move. Now, they are in technically in default of the lease with chronic late payments. I made sure the tenant knew up front that late payments will not be tolerated. Chronic Payments will trigger an end to their tenancy. I am following the law. I sent them a cash for keys offer as well. I documented in writing each time this has happened and sent them a letter. For a couple in their late 50s, they are quire irresponsible. Now, I let them know that 1 more late payment ends the lease and legal action will follow if they do not vacate with a signature required. Do you think a tenant is going to drive out of your rental with all his stuff and live in his car because you gave him notice? Probably not. Do you think a tenant who has no car is going to walk out and live on the street because you gave him notice to vacate? Probably not.

@@LandlordAttorney I have had quite a few who had to be forced out immediately due to DVPO restraining orders. I just had renter recently who was forced out after an eviction order by the Sheriff. He was physically disabled, did not own a car, and it was raining hard that day. He sat on my front porch, called for a ride but couldn't get one. The sheriff stayed here and then gave him a ride to where he wanted to go.
Credit score doesn't mean jack shit. Someone with a great score can stop paying rent and trash your place. I have a low score and pay rent on time every month for Years and years. I'm a decorator so my home is clean and beautiful. I'm not my credit score. It's discrimination as well.
A credit score means something important. That's why we use it. It doesn't mean everything. That's why it's not the only screening criteria that landlords should employ.

I don't advocate wrongful Eviction. If someone is being evicted through NO fault on their own, that's not legal. However, if someone cannot afford to live on property that belongs to someone else for whatever reason but refuses to leave, that burden should not be carried by the Landlord, no matter how unfortunate for the tenant. If the tenant is without resources, there are funding sources, both government and private, to assist them, but this is not the responsibility of the landlord. That being said, my discussion has more to do with a tenant who simply picked a rental out of their price range or who mismanages money in such a way that timely payment of rent is not a priority.

Currently HUD is still asking for 30 Day Notice to Vacate. On my Market sites we can use a 3 Day.
The default is 30 days in the presence of government assistance, but not all courts enforce this, and most Defendants do not raise this claim.

Depends on what's in your lease, what happened in the "confrontation," and what your state's laws say about this as a valid basis for eviction.
I have electric and water paid. I put in ,if they don't paid on day 5 I turn off water and electric then start evection. 6 month lease.
This would not be a legal option in Texas.
As a LL, it is illegal for you to turn off utilities.

Credit score doesn't mean jack shit. Someone with a great score can stop paying rent and trash your place. I have a low score and pay rent on time every month for Years and years. I'm a decorator so my home is clean and beautiful. I'm not my credit score. It's discrimination as well.
A credit score means something important. That's why we use it. It doesn't mean everything. That's why it's not the only screening criteria that landlords should employ.

@@dav1d_andrew 100% real. It only makes sense to utilize the threat of loss (eviction) if the rental unit is worth keeping. No one worries about losing a slum. Check your math.

I don't advocate wrongful Eviction. If someone is being evicted through NO fault on their own, that's not legal. However, if someone cannot afford to live on property that belongs to someone else for whatever reason but refuses to leave, that burden should not be carried by the Landlord, no matter how unfortunate for the tenant. If the tenant is without resources, there are funding sources, both government and private, to assist them, but this is not the responsibility of the landlord. That being said, my discussion has more to do with a tenant who simply picked a rental out of their price range or who mismanages money in such a way that timely payment of rent is not a priority.
