@@Gww-1requirements aren't as stringent as they once were. Ever since Floyd there has been a trend of locking up officers doing their job. Everytime an officer has to use force there's a portion of the public that cries over the scumbag criminal. Because of this, recruitment has been way down as people no longer want to be cops and risk spending their lives in prison over a split second decision in a high stress situation. So police departments across the country have had to lower their requirements just to fill positions. Florida isn't as bad as other states simply because of the governor and sheriff's like this guy here that don't make apologies for criminals.

Ok. So for those wondering the legality of the stop and subsequent requests, remember that you first ask yourself if they have broken a law, because suspicion is only a reason for an investigatory detainment. Lawful orders are only issued if you are legally detained for a specific crime you are being detained for. So, if they are just "suspicious" of you, that's not a legal basis for lawful orders. In this case, the sheriff shares WHY this becomes a legal stop. Being in a park after it closes, is a violation of county ordinance. The legality of the stop is that this individual was violating a county ordinance. Now everything the officer asks you to do AFTER that, makes the orders lawful. You don't have to talk to police, but you do have to obey lawful orders involving your persons. Remember, there is no such thing as a lawful order to talk to police. You never have to talk to them. That's a choice and usually a wise choice if you wish to dispel their suspicions. I cannot emphasize enough, that citizens should spend a great deal of time reviewing state and local ordinances. Read them, look at cases around them. Educate yourself so that you will always know if you are breaking the law so that your interactions with police officers are legal and cordial.

@@madaknight5792 Not at all, I demonstrated in my post that this individual was legally detained for violating a county ordinance. That's why the entire encounter was legal. That's why he was required to get out of the vehicle. He didn't have to talk to the officers, but he was resisting lawful orders because the original violation was being in the park after hours. If she had approached this car and made these demands BEFORE the park closed, this entire thing would have been done on an unlawful basis and the orders would have been unlawful ones.
@@DTRD-uu3tr What's your point? I was simply demonstrating that he was detained for a lawful reason. Had the officer done this before 10pm, the entire stop would have been unlawful. She didn't know that this individual was associated with car burglaries AND if you listen carefully, he wasn't ever accused of a car burglary or associated with any burglaries. The premise for her searching for suspicious vehicles was that there had been burglaries in the area. He was detained for being in the park after hours, (a violation of county ordinance). If folks want to know if she can legally order you out of a car for whatever "suspicion" she has, she can't. But if you are violating a county ordinance, she can. That's the point. There's a thin line between a lawful detainment and lawful orders and unlawful one. The fact you are a police officer does not make every order you give a lawful order.

Honestly, why would officers assume this is just a “routine” interaction (whatever that means) and why would they be so careless as to let someone “produce” a weapon and shoot them while physically removing him from his vehicle. Their gunshot wounds were preventable. This is not a profession in which you become lax or consider night time hostile encounters as “routine.” The fact that they did not know in advance they were dealing with a SovCit is no excuse.
