I do think the kids that suffered physical abuse are entitled to money and should be put into trust fund. I don't trust Kevin Franke any more than Ruby and Jodi.
He doesn’t even currently have custody of his children named in the lawsuit and wasn’t involved in their lives for almost a year and a half leading up to Ruby’s and Jodi’s arrest and hasn’t been allowed to communicate with them in the months since then. I agree that his children should receive $, but Kevin Franke shouldn’t get a penny!

Kevin should just get himself a little jobby job. This could not have happened if he hadn't abandoned his children. Maybe they can sue him to for anything he is awarded for their abuse.

Exactly. How do any of these minor children get hurt by Jodi unless their parents abdicate their roles as parent-protector? And how does Ruby have free reign to abuse his kids unless Kevin abdicates his role as father, which he did by pursuing his own selfish goal of ingratiating himself to his wife? They both took Jodi into their lives and danced to her tune. The adults were all in a position to make these immoral, illegal choices.The kids had no choice in this.
Minors can’t legally file suit. An adult has to file on their behalf.
@@hostronic They likely have an atty ad-litem in the CPS case, and they can petition the court for that appointed ad-litem to file suit on their behalf, or arrange for the appointed ad-litem to secure them a private ad-litem atty to serve their civil interests.

This is really irking me.... This dude knew how these kids were being treated, he says it himself how cuckoo Jodi was in his presence, knew the kids were with her, he participated in extreme punishments on camera, left his kids and had no contact for a year and now he wants money?? I saw a police cam video where he was demanding the arrest of one of his older children for taking items from the house before it was searched. Even though the items were returned. To me, that says a lot about his character and I'm not surprised he filed this lawsuit. I hope it gets thrown out.

Kevin wasn’t legally restricted from seeing his kids. He went along with this “plan” even without knowing all the details of what was going on while he was away. I don’t think he should get any $$. It should go to the kids 100% and frankly it isn’t a good look in my opinion that he’s going after the money himself vs waiting to do it on behalf of the kids.

There is a photo of the girl's arm in the evidence that was released. It's just as skeletal as the boy's and is covered in scars.

We saw her in the closet she ate 2 pizzas was very thin with shaved hair looked like a boy and refused to speak or move for 4 hours with police. She was more severely mentally affected than R & much younger.

If I told my husband he needed to move out and not contact the kids in order to save our marriage, he would not agree to that! I think Kevin even blocked the kid's phone numbers. He may have some type of mental health issues/psychological problems to just go along with Jodi's indoctrination. But regardless, he deserted his duty as a dad and should not benefit from this lawsuit. The money should go to the victims. Period.

Listen to the phone call between Ruby and Kevin, one major concern was the money left at Jodie's house. It was also his concern in one of the police interviews. Add that he never conditioned Ruby for what she did and what she said about children. He deserves nothing.

So lets do a little math, less than 80k, we don’t know how much, was the wages from at least 4 kids that were still in the house, for 6 years that the channel lasted. That is probably not even minimal wage. They were living of those kids. I’m sure the oldest ones didn’t get enough when they left neither, specially because they left estranged. The state/family court would have made Kevin agree to cut ties with Ruby in order to have visitation. That is why he quickly filed but I guarantee it will remain a separation and it sounds like he's setting up Ruby as another victim of Jodi. My family member does specialized foster care and the main reason kids end back w/her is because the parent tries convincing the kid their abuser is sorry and didn't mean it. Kevin is a text book of not putting the kids best interests first.

We didn’t get a criminal trial, but I have a feeling we’re gonna end up with a civil one. His wife will eventually be brought in on a third-party complaint, and the judge will eventually put them both into the defendants bucket. He absolutely has no right to sue on behalf of his kids, that he does not have custody of. Moreover, he’s going to have a tough time, convincing a jury that he’s owed anything when he didn’t speak to his kids voluntarily for over a year. Also, that stupid channel started in 2015 Jodi didn’t come into their lives until 2019. There is four years of documented emotional abuse already online. Not to mention, he gave an interview where he admitted to performing an exorcism on Jodi, and then he let her babysit his kids. I can understand why he’s going after her money because basically, his career and reputation is done. But he ain’t gonna get much. In fact, his reputation is going to take an even bigger hit.

Because a good civil attorney could make an argument to dismiss this case based on Mr. Frankie‘s own behavior. So that’s why I think this one has a shot of going further than people think.
This is not about righteous anger or wishing bad things on a negligent father. The facts are the facts. He knew the mother was using food against the children. He knew she had taken the bed off the eldest son. Some of the cruelty against the children was done while he was living with the family. Even now he wanted to press charges against his older daughter for entering the family home. How does that make sense? He had a duty of care to his kids and did nothing. How does he deserve a penny? Every penny should go to the children. He is not the victim, his only concern was keeping his marriage together, not the children. During the first interview he barely showed concern when the police told him his kids were in hospital.
The abuse/parenting he did pre Jodi was absolutely legal in utah. He was and is a bad dad but he isn't a criminal
Peter, when CPS/the state takes custody after one month the parents are required to pay child support and medical costs based on income. Kevin's suing Jodi for what he's been ordered to pay himself! Please let me know you opinion and if family court will hold this against him?
Also in order to have visitation Kevin would have had to separate from Ruby and cut contact but he mentioned her as an additional victim of Jodi in the filing?!?
My family member does specialized foster care for kids who've experienced trauma. A frequent reason kids are returned to her care goes like this; Chid is abused. Parent leaves abuser n files for divorce. Parent does what is ordered and gets kids back. Parent talks to abuser on phone or in person and down plays events, tries convincing kids abuser is sorry and tells them to forgive the person, and kid ends up back in care after first or second therapy appt.

@@ellaella5537 What part is sick? There are many improvements that need to be made in Child Protection Services across the US. That being said there are many hard working people who truly put the child's best interests first. A lot of people can complain about how bad it is and again this is a system where simple mistakes can have devastating consequences. More ppl need to advocate for kids in the system. More ppl need to get involved and participate in programs like CASA. We need more ppl to contact their state representatives and advocate for funding to kids who are aging out, no questions asked housing/ebt/college/tech school until age 25. Donate NEW not used clothing for kids 12 n older to county services. Lastly if you're able become a foster parent who understands the main goal is always reunionification.

CPS in EVERY STATE, not just Utah, is Ovwrworked, FAR UNDERFUNDED and Workers 9/10 aren’t properly trained. End of Story. It was that way in the early 90’s when I got my SW Degree, and it’s probably 1000 times worse now. (Obviously, given this case) Which is why I changed careers a LONG TIME ago!
I think even less of Kevin Franke after this than I did before. For him to be sueing Jodi BEFORE his children get a chance to than there's more money there for him to grab for himself. And that's just wrong. Once again Kevin shows that he doesn't really give two flying f*cks about his kids when push comes to shove. Any money he wins from Jodi''s estate is money HIS kids - who are Jodi's real victims - can't collect on. Speaking of the kids Chad Franke is now considered an adult and it was as HIS counsellor that Jodi was brought into their lives. If Kevin loved his kids half as much as he says he does he'd have included Chad's name on this lawsuit or had his lawyer draft one for Chad to file. But that's not what happened. I really hope cps decides that the 4 minor children would be best off under her guardianship than returned to Kevin.

I don't know how I feel about this either.... he is an adult man who allowed two delusional women to come in between him and his responsibilities to his kids, which is a very weak excuse imo. All three are culpable in some way so this is an odd situation.

I have personal experience watching a close friend get referred to Jodi and almost the exact same things happened with her and her ex-husband and kids, luckily the kids were old enough that they got out of the house before being tortured.

Ok now! I do agree with your take. It’s understandable to sue for the way Hildebrandt destroyed his marriage and income from their RUclips channel. However, the kids have a legitimate complaint of abandonment by their father. It was his duty to protect them.

That was not recently. Her name had been removed from the list of recommended therapists for counseling when her license had been taken away. Recently most of her clients came by word of mouth or by her connexions classes.

I can appreciate your sympathies for Kevin. Truly. MY POV is that if my spouse inflicted harsh punishment on my children in my presence, I would have intervened. If my spouse "invited me to leave" because a third person said so, I would NOT have left and I CERTAINLY would not have left without my children.

He LEFT and, admittedly, had no contact with HIS CHILDREN for a YEAR (give or take). I would have been raising HOLY HELL by the time we got to "invitation to leave". He abdicated his responsibility to protect his children BEFORE Jodi was in the picture. He completely absented himself from their lives afterwards.

the prosecutor already fell under her spell. I mean with all the evidence they had on Ruby, why offer her that plea deal? And part of the deal is the prosecutor will not go in front of the parole board to try to keep her in , but he will when it's Jodi's turn.
That’s only 13 years! I think she absolutely deserves to be in prison for more than that!
He CHOSE to abandon his kids. He doesn’t get to claim pain and suffering now. As the adult child of a parent who walked out, I have zero sympathy for anyone who abandons their responsibilities as a parent. Every cent from any lawsuit should go to those kids so that they can finish out their childhoods in a safe home, and obtain the care they need for their physical and emotional wounds.

When all the kids are 18 they should all sue both their parents for abuse and for exploitation as children for Eight Passengers. Also for exploitation without pay. And for the type of abuse that is being proven. Since Kevin Franke has no custody it's outrageous for him to be suing Jodi. The kids should get all the money.
Seeing the bigger picture is important for all victims involved. Kevin will have his work cut out for them if he gets custody of the children. The kids lives will never be the same!

I wish many of these men, who had their wives turned against them, and now adult kids (like her niece) who was sent to her for “therapy” could/would feasibly file a lawsuit against The Mormon/LDS Church for still “recommending” (despite she had once had her license suspended and other allegations). There is no way they didn’t know at least *some* of her actions or “methods.” (Especially after she started Connexions).
And apparently they were still suggesting her after she voluntarily stopped using her certifications so that she wasn’t under oversight any longer.
Seems he may have been. complacent in the abuse. Surely he knew some of what was going on! 🤷🏻♀️

I actually think that he needs some very good counseling at his own expense. IMO, it will help him to learn and understand the best ways for him to interact with his children. I DO Not think he is near ready to receive custody. It is my hope that he learns so much, for these children.
The thing I hate the most is that Jodi will have reason to use some of her money to defend this. Leaving less money for the kids, even if he gets awards little to nothing.

Kevin Franke is not an innocent person in this case. I agree with Peter that he chose not to see his family the whole time. Plus, there are videos out there of his activity in the sadistic parenting of his children with Ruby. One could argue he sent his son to an abusive wilderness camp, restricted food, took away Christmas, made his son sleep on a beanbag for 7 months. There is proof of this in the 8 passengers videos when Kevin was an active parent and living in the home. Though I desperately want these children to heal, I do not feel they are entirely safe with Kevin.

I empathize with and feel similar to many of the commenters' reactions to this case given what has happened to those children. Even so, I just want to say to you, Peter, that you are clearly a consummate attorney and person. I so appreciate your encouragement of your audience to try to see the best in others despite our rage for what happened to these children and each person's level of culpability. I am sure you have found that many times, in your work AND in life, things are a "yes AND" situation. I appreciate your reminder of that and challenge of us to perspective take even if our valid bias makes it hard. So, thank you hecause you may not hear thanks often enough.
On this suit, I too saw how Kevin could have a case here and agreed with all of facts you suggested could be considered for this case. One thing I don't think was mentioned-- I am surprised Kevin didn't sue for the bag of money (was it $80k+) that was seized in JH's home that was originally money from the Franke Bank account (I believe to buy land in Arizona).. I wonder if there's a reason why that fact didn't come up?

This is a hard one because while Jodi Hildebrant did cause Kevin a lot of damage, but I feel like he had plenty of warning that her therapy was bad news and he consented to doing it. His children did not. I think Kevin is doing this because Ruby over time gave all of the family’s money to Jodi in one way or another, but he didn’t step up and put a stop to it. I feel like I’ve heard her say that she was practicing outside of her license ( why she called it life coaching) in Connexions. I do question if consequences from Jodi’s therapy are what caused him to not be employed at BYU. Ruby was the therapist who recommended taking Chads bed away and making Eve go without lunch.
I do feel that liability of the LDS church should be investigated. If it is true that the Mormon bishop who gave Jodi the daily blessings recommended that the Frankes take Jodi Hildebrant into their home with their children knowing she was so mentally ill instead of getting inpatient mental health treatment, he contributed to the danger.
I also question if Jodi even has much money or does she just have a ton of debt.
I’ve been watching a lot of the Mormon Stories (it’s a podcast, Jessi Hildebrandt did two episodes along with other people who were victims of Jodi) episodes and upon watching them came to the conclusion… there’s no way in hell Kevin Franke WASN’T a victim of Jodi. I think he’s guilty of being a terrible parent but no… I don’t think he’s lying or was “in on it”. This family has a lot of healing to do I’m not going to wish bad on the one parent these children have left.
I hate that Peter BEGGED everyone to understand that and not be insane in the comments yet 99% don't understand ANY type of interpersonal relationship. I am VERY familiar with what Jodi does, she destroyed a close friend of mine and her family, the church sent her to Jodi and she was under her "care" for 7 years and her situation is nearly identical (kids were old enought to escape before Jodi fully got the hooks in).

This raises so many questions for me! Have Jodi's assets been frozen? If not, could this be an attempt to "preserve" them before she disposes of them? Is that something that could have been requested in the lawsuit? Do the minor children have a guardian ad litem? If so, could they bring a civil suit on behalf of the children?
Yes, the minor children will have GALs, they are all being protected in the custody of the state

Peter, I keep missing lives but I've been wanting to ask you this question for a while now. Could a bunch of Jodi's victims get together to file a civil lawsuit against the Morman church? It was the church that sent these families seeking help to Jodie for YEARS! Even after her suspension for ethical violation the church leaders kept prppiing her up as their go to therapist. I know they can't be charged criminally but I'm curious what the rules are in civil litigation. I do believe the church holds lots of the blame in what happened to those kids. There are so many victims that suffered horribly under Jodi''s "therapy" that it would be nice to see those at the top of the food chain have to pay some good money.

I wouldn't give Kevin Franke a dime until the children or someone on thier behalf could file suit. I would also ask that all assets be frozen for both Jodi and Ruby until the children do file. Kevin deserves nothing IMO.

Ruby and Kevin were dedicated to their church. The church endorsed Jody, so R & K thought she was legit. When Ruby agreed that K should leave, he likely figured since the church endorsed it, it was the only way to get family back eventually. Sadly, they didn’t have friends or family to speak sense to them and get them to wake up.
Yep and she got her hooks in SO slowly and deliberately that they didn't realize what happened until it was too late. I have ZERO doubt that Kevin was unaware of what was going on. Jodi has done this to so many families, including a very close friend of mine. Seeing all the comments accusing Kevin of being a part of it hurts me
Also, we know from Kevin’s second police interview, that he and Ruby gave Jodi a leather portfolio for the “PEN PAPERS.” Kevin thinks those papers are important. He thinks these papers will become religious documents about “miracles” performed by Ruby and Jodi. The “PEN PAPERS” and the leather portfolio were Christmas gifts FOR JODI!!!! Dig it: while KEVIN AND RUBY were depriving the littlest Franke children of Christmas presents, KEVIN AND RUBY were solemnly presenting Jodi Hildebrandt with a very special Christmas gift. Unbelievable!!! Unbelievable!!! Kevin better hope that this will be tried before a judge because a jury will see right through Kevin’s blatant grab for cash.

The thing with the son and beanbag was after they engaged Jodi as a therapist. The reason they lost the RUclips was because of the punishments that Jodi was teaching ruby before she became known to the world- once they lost the RUclips money because of the punishments Jodi had been encouraging them to do, she then had to make money by partnering with Jodi to make a new one.
So I think the loss of income for the Channel can be attributed to her conduct like you suggested.
Why doesn't Chad and Shari sue her on behalf of themselves and their siblings? Can they? For pain and suffering? Also Chad was forced to be counselled for $900 a month. He had to work 2 jobs and pay himself at one point. Idk.
