Why do cops even begin to phrase things as a question when it’s a demand? You can say “no” and they’re going to stand around all day anyway until they find a reason to force you to leave. Atrocious
Because that's a major portion of their training. Instead of being trained to respect rights, they are trained to circumvent them. Their legal training consists of forming demands as questions because then they can claim they were simply asking a question when in court and it's not a rights violation because they didn't demand anything and the citizen complied with a question and not a demand because the citizen believed that if they didn't, they would be refusing a "lawful order". People need to be more diligent with questioning what the state is asking them and the repercussions of refusing, so the cops will have no wiggle room in court.

It would be potential grounds for a lawsuit if they deprived him of his right to public records by lying-- he's legally gathering evidence, and happend upon another potential lawsuit. The cop keeps saying “I’m asking you to leave.” An ask is NOT a lawful command. After all, the cop could ask for $100, or ask for a quick Handie from anyone he encountered…but those requests would not be lawful commands that would require a pesky citizen to blindly obey.

Practice these lines ahead of time outloud and be comfortable saying them:

2.
I do not waive my 1st, 4th, and 5th amendment rights
3.
I am not resisting.
Say each multiple times at the appropriate time.
Take care. Have a security plan. Let someone know your plans.
Do not film on your primary phone. Phones and cameras are regularly seized and held for no reason other than to hassle the auditor. Any equipment seized by the popo may be infected with malware and tracking software.
Back up your videos off site.

I was born and raised in Alaska. As a current resident I feel the need to tell you that this was a good police interaction. It’s really bad here. It’s so bad I decided to protest While trying to do so lawfully ( time,place,matter)I find out our governor is in the process of outlawing that civil right. I wish I was lying. It gets worse tho and there is nothing they’ll let us do about it. Body worn cameras? Nope! 2 and a half years and a lawsuit later has anyone seen one? Wouldn’t matter. It costs almost 400 dollars for a copy of a 911 call and untimely in delivery. How much would video be?

You’re going to have to file a lawsuit about the cost of the records. This tactic has been used by multiple government agencies and it only takes one lawsuit to clear it up they cannot charge you that much money for public records.

If you're a big guy and it's after 5:00 and you're on public property apparently men with guns will come and threaten a man holding a camera with imprisonment. Both parties understood what was said and the threat is clear, now will the man who had his rights violated file any paperwork?
