    In Florida they garnished $345 from my paycheck. I don't have no idea who they are. I never saw a judge I was never served papers. I emailed HR and ask them who why and how this was allowed. And I want that money back they had no right to take it out

      You need to check the court record for that case number, because if they are garnishing, it means someone got a judgment against you, and if you were not actually serve, and improve that, you can get that judgment, set aside and the garnishment quashed.

    So the exemption begs the question...what processes do they use then? Is it basically just a judgment sitting on your CR?

      They wait until you're vulnerable and then try to take your money. Judgments last a long time.

    When filling the exemption, do you send copies of the notarized form prior to filing with the clerk or do you have to file with the clerk first before mailing copies to the plaintiff?

      In Florida, the form comes with detailed instructions about how to file everything and when-just follow those instructions. In other states, you might ask the clerk for instructions on what where and when you need to file everything.

    This company is about to ruin our family. They managed to get a garnishment judgment without my husband being notified! They used an address that we haven't lived at in over 10 years and in another county from where we are now. The company he works for failed to notify him until well after the time to dispute the case was well past. The original judgment was back in 2009 and yet they got the garnishment pushed through in June of this year. I don't even know what to do since they have run us so far broke, we can't even afford an attorney. I'm disabled and have been for years. what can we do now?

      Lack of notice is a huge problem because that’s a deprivation of due process. If you can prove you didn’t get notice of it, you should be able to get it reversed.
      And if the debt collector (judgment creditor) is sending notices to an address they know is bogus, you can sue them, possibly, for violations of federal law.
      Talk to your local legal aid attorneys. If you’re really destitute, you should qualify for help.

    WhT can I do if that judgment hS been satisfied and they are still garnishment? I talked to the attorney office and she said it was paid in full last week and today my paycheck reflects another garnishment.

      That's going to depend on the laws of your state. Contact a lawyer near you who handles garnishment.

    Hi! I have a question. I quit the job that they were going to use to garnish my wages. I then received a dismissal of garnishment without prejudice. I know this means that they can pursue me again, but my question is, will they have to go through the court process again? Or will they immediately contact my new job. I ignored the first court order like an idiot so I’m hoping I have a second shot at this 🤦🏼‍♀️

      Garnishment process depends on state law. In Florida they'd have to file some new papers with the court after they find out who your new employer is.

    If you don't make more than your. normal living expenses, can they still take 25% of your wages ?

      There are different limitations on garnishment, but none of them depend on your normal living expenses. The federal poverty line is one of the relevant factors, however.

    If a person receives SSDI or SSI via direct deposit,can a creditor seize your bank account if a judgement is entered . Thanks

      They can't garnish your benefits but you may have to prove the contents of the bank account came from SSD/SSI to protect the account. What state are you in?

      Every state has different garnishment laws, so it's hard to tell what you should do without knowing what state you're in. If you're not in Florida, I probably can't give you a good answer.
