In Florida my wife's check is being garnished without any notifications, letters, emailed. From a dept company. Apparently they filed on March 20th 2023. They are taking 25% of her pay every other week. They took out $345.00 from her check. They are going to take 25% again. Florida is very expensive. & for this dept company, I believe its LLVC to wingle around her back AGAIN to take $345 again, plus taxes & other deductions that are obviously a requirement for insurance and so forth. Every 2 weeks her check is approximately between $1300 to $1700.00. (So lets go with an exact number $1550). After the dept company takes out $345.00, then taxes, insurance, IRA, $300.00. Plus these scum also took out $5.00 for a processing fee. So $1550 every 2 weeks. Minus $345 plus $300.00 & now her check went from $1550.00 to $905.00. That's over $600 being taken from her check. Rent for a 1-1 in Coconut creek is $2015.00 a month. Plus FP&L, car insurance, car payment, food & so much more. & we cut back on TV, FP&L. WE are cutting corners just to live . I feel this was illegal and how and what should we do from this point forward?? I would hire an attorney but she can't file for bankruptcy Chapter 7 cause she doesn't owe money or behind on Bill's. BUT NOW paying rent is going to be so hard. We even got rid of 1 car just to lower our insurance. There is no more corners for us to cut back on what should we do about this company that is taking out 25% of my wife's pay thank you so much I enjoy video. keep up the good work on the show. great explanation / answer on how and what she should do. Write a letter to the Judge? Who I guess signed off on this because we did not show up because of no notifications. and also write to the debt collecting company stating she is not aware of this? Hey Sir! I believe there is no minimum debt amount to file for chapter 7 or chapter 13. You should be able to file for bankruptcy without meeting a minimum. She could try negotiating with the creditor directly to see if they would take a lump sum or structured settlement but we tend to see a low success rate on that since the company has around gotten a garnishment. @AscendFinance my wife Doesn't want to fight back because she is scared. Even though they broke the settlement garnishment offer that was Settled in front of a Judge. The agreement was signed off by the Judge to only garnish $50.00 every two weeks. This dept was from 1999. So the agreement was in place, and then they just started taking out 25% from her paycheck every two weeks and it was so bad Because they were taken out so much money. Now, you have to pay your taxes, your premium for insurance & ect. But then add on the 25% Garnishment she had to quit her job I find another one because it was so bad. If I hire you To handle this case U will destroy them. Because they broke them all
