  • After an earlier back-and-forth over a press conference where Minneapolis leaders again discussed a civil settlement in the death of George Floyd, Judge Cahill pushed back against the prosecution's request for formal filings from the defense to support future motions.

    Very impressed with this judge. He saw what the prosecution was trying to do and make it nearly impossible for the defense to do their job. That was dirty and underhanded I'm glad he stopped it in its tracks.

      The Judge appears to have a certain amount of disdain for the State attorneys. He doesn't want the State bullying him in his courtroom. He is allowing the defense to defend his client with a loose leash. He doesn't want a mistrial or appeal for catering to the State. In the end the Jury is in charge of the cops fate.

      Everything the defense is doing is standard practice. Making it nearly impossible for the defense to function isn't the same as discrediting someone who has biasese

      This judge let the MMA fighter be an expert witness on chokes causing death. Against the defenses protests , and the expert was referring to a kimura as a choke. FYI it is a arm bar or lock

      @@duelinthis Unfortunately the ones that aren't watching will be the first ones to riot. So far I've seen that the evidence shows he's not responsible.
      1. Mr Floyd has shown a habit of eating drugs to avoid arrest.
      2. Last time he ate drugs to avoid arrest he complied, unlike this time.
      3. The restraint the Officer used was exactly how he was trained. (I disagree with the training)
      4. Floyd was gonna die no matter what from the lethal dose of drugs he ingested.
      But the BLM and Antifa are gonna use it to further their terrorist agenda no matter what. Its truly sad.

      This entire debacle has spurred tens of billions in damages, tens of direct deaths, hundreds or perhaps thousands of lifelong injuries, the arisal of an emboldened, pervasive anti-police, pro-criminal culture with all the zealotry of bloody fledgling political uprisings of the past, perhaps hundreds or more in murders, rapes and robberies from opportunistic criminals, a collective nod of approval from many of our own Democratic leaders with personal subsidizing to boot, half a GB worth of harrowing, dystopic imagery and full-fledged cowardice from multiple governmental sectors, state and federal, the reverence and quasi-sainthood of a criminal who once threatened a pregnant woman at gunpoint... to the stomach, and much, much more. All in the midst of a pandemic.
      And this case on which all of the above hinges at the threat of more to come, even in its infancy, has received less major media scrutiny on TV than Joe Biden beating his granddaughter at Mario Kart. If that isn't like the complacency of a beaten housewife, I don't want to know what is.

      @@beasley598 Everybody get a defense. That's the law. The quality of the defense is what matters. This judge is just as impartial as they come. He sides with the defense because if the only lead lawyer that the defendant has needs to step out to file every time... The defendant does get a fair trial. The judge denied the defenses motion to change the venue of the trial. It's fair. Oj Simpson won his trial with a good defense so I don't want to hear about black people cases not being fair. You simply don't like him because he's white and accused of being responsible for a drug addicts death. The evidence will show what happened!!

      Prior arrests have nothing to do with how the office handled the situation incorrectly and the officer not following his training.
      Got to remember George F is not on trial here and neither is his character the actions committed by the officer is what this court is here to judge not who those actions were committed against.

      I really empathize with Nelson here. The amount of pressure he must be under is incredible. Not to mention being up against so many of his peers who are just as knowledgeable of law practice as he is. At the end of the day he is human and I hope he gets the respect he deserves for providing fair defense whether you think Chauvin is guilty or not. What an incredibly difficult role to fill..

      Problem is they keep changing tactics since it isn't working on the prosucution side. Fact almost all the credible witnesses they had changed testimony or got up on the stand and made a fool of themselves. Between the martial arts background blurting out passing out they get up and fight back when they wake up to only taking 3-5 second for someone to black out on blood flow.... I give big prontos to george's ex getting up on the stand to. Fact he previously od on same symptoms as he was on the day he died really hurt them. Either outcome this is surely public trial unlike Omar muhammad trial. And i would bet a paycheck they'll be riots either way

The final days of testimony are really going to be a blood bath for the prosecution when all the pieces come together. It's going to be extremely pivotal when the toxicology reports are gone over. Murder in the second degree? Very unlikely. I personally feel this case will end with a manslaughter conviction for Chauvin, and the other officers being found not guilty when they see trial.

    This judge has been 100% fair to both sides. Nelson is doing a pretty damn good job considering the fact that he's way outnumbered but the whinny state. I'm pretty certain however that there is about a ZERO % chance that Derek receives a fair trial. I mean, seriously. The announcement of the 27 M to the Floyd family during jury selection!!!! Whether you love him or hate him, no way Derek receives a fair trial and that's f**ked up. Too many simple minded and hate spewing fools have already made up their minds before knowing ALL of the FACTS.

      Derek Chauvin is guilty any body with eyes can see that. Should we believe Mr. Nelson or our own lying eyes when we see a man dying on the ground. Derek Chauvin is probably safer in jail.       @@Kazuzual90 beyond a reasonable doubt is the standard. murder shows intent to kill, he can point to the actual training handbook and show the exact position he was in. I would be willing to wager that he has used the restraint before without anyone dying. that makes murder a hard charge to stick if the trial is fair.
      manslaughter is closer, but once again, reasonable doubt. floyd had a lethal dose of fentanyl in his system as well as covid. i live in mn and would be I interested in the mental gymnastics of the state to say that covid which is deadly enough to shut down damn near the entire state as recently as december could not have made any difference here. So you have a guy who died with a lot of a very potent drug in him along with a disease that causes lung based symptoms at its core, and you want 12 people to agree beyond a reasonable doubt that it was the guy on top of him that 100% lead to his death.
      maybe jesus should come slap you for casting the first stone.

    This case should be transferred out of this district, can't get a fair trial when the council is handing out 27 million in settlement when there's been no judication of guilt...clearly there needs to be a change of venue ruling..

      He will get a fair trial, and then go to prison, as it should be. If you have watched the tape, the entire eight minutes plus of the tape, you can't see any other possible verdict.

      @@nickymatthews3491 Floyd died from a Fentanyl overdose, the autopsy/toxicology report showed that....I watched the whole tape, not the selected video the media narrative perpetuated that was false....His hyoid bone wasn't broke, so he didn't die from a knee on his neck, He said he couldn't breathe when they placed Floyd in the back of the cruiser, the police asked him if he has taken anything, they opened the window to get him some air, he then wanted to lay on the ground which police allowed and then he became non compliant, because he was dying from a fentanyl overdose which expands your lungs preventing you from breathing since his lungs expanded to twice their normal size...Should the officer had his knee on his neck and shoulder for that long, No, but he didn't die from that, he died from the Fentanyl overdose, whether the police were there or if he was in his own apartment, he would have died...

      So which one is it? is this an officer doing something he shouldn't which could have caused this mans death or is this an officer doing what he should and following his training to serve and protect Mr. Floyd? Last time I checked even if you accidently assist in the death of someone its still a crime punishable by prison.
      People go to prison all the time for accidental manslaughter so even if that is your excuse then you agree he should be put in prison.
      Also civil and criminal court are two totally unrelated things so no that settlement has nothing to do with this case.

      @@kirklynncentore8794 If any higher court finds the proceedings of this one to be unfair in any way, the attorneys can request a mistrial. This means the whole process re-starts and a new jury is selected. This is what Tim is referring to.

      How is it not a mistrial already with the city council awarding Floyd 27 million dollars before the trial even started? That literally never happens. It's so blatantly political to influence this trial. The mayor walks around town with a "I can't breathe" mask on. The whole thing is just looney tunes. The sad part is if he is acquitted these people they're trying so desperately to appease will just riot and destroy their own city again, it'll probably be worse.

If he was using enough force to stop his breathing, there would SOMETHING. Anything. Swelling, bruising, damage to neck (or hyoid bone), petechiae, hemorrhaging, popped blood vessels.

      he did not answer the question because the real answer is much larger then the public would accept. My money is its 10 "of record" they probably have 30-50 support staff. Basically they are treating this the same as they would a bernie madoff. And simply put you can throw as many lawyers at this as you can. The case is simply not going to work in minneapolis. And if you have "impartial jurors who are not fearful" then you will not get the conviction they want.

    This judge is really good. For all the live streams, he is very fair with his objections and sustains for both sides. Very impressed this wasn't a kangaroo court.

      This judge in this moment and many others takes decisions to help the defense , not based on fairness. I will give you the reason: Normally you should follow the formal proceedings and present them in writing, which the defense didn`t do. Not following this rule and leave the courtroom as a wild west that would favour the prosecution, in fact.
      The judge would never allow the prosecution to make those kinds of assertion, yet allow the defense. Meaning that he is not giving them the same opportunity or guns to fight with. The judges reason to allow the defense to make those assertion is partially because of his presumption that the defense doesn`t have the same level of support, which is inaccurate- number of lawyers. The association that funded Chauvin defense announced that Eric Nelson has about 10 lawyer behind the scene supporting him. Conclusion: they have the same level of support. In other words, the basis of this decision is inaccurate. He should have never presumed the level of defense between each side based solely on the number of attorney in court. If he was going to base his decision on that, he should have at least asked both sides to inform him about the support they have, not presumed it.
      Not to mention that he cut the prosecution when he was trying to explain the resources that both party has, not allowing it to present their reason in regard to the resources.
      Another example is to excuse a Hispanic juror because he had 1 or 2 months of martial arts experience, despite allowing a white woman who had a long time martial art experience as a kid. The 1 or 2 months would be inconsequential in this case, but he supported the defense on that merit.
      He might not want to treat them differently but he has done it.

      Mistrials aside, I presume Gregory is generally concerned about the abuses of the justice system... from bad cops to corrupt lawyers to politicization, officials angling for promotions and so forth.
      In that, the shoe may not be in the wrong foot, so much as you need to use two shoes to make it work ;). He may have a bias against Chauvin from that angle, in wanting to down a bad cop. Though that bias may be tempered by wondering why an incompetent cop was told to do a job he couldn't do... maybe that's someone else's fault.
      On the other hand, Chauvin is now also in the hands of that corrupt system, and that bias should work in his favor. If you don't like how innocents get jailed just so that a prosecutor can get his promotion, especially public cases like this warrant hesitation.
      But I don't know that. Perhaps he just overlooked that half of the equation. An awful lot of people seem to do that, certainly in this court case.

    The gov't should not have more support than a private citizen during a trial. It should ALWAYS be the exact opposite if anything. In theory, if the prosecution's staff has that many people, it's because they have a large workload from all the different cases that are tried in court. Not to be piled all into one trial. Since that's exactly what they're doing, I'd say their gov't taxes its citizens too much and thus has a number of prosecutors and paralegals that are surplus to requirements.

Police of the state get involved with a citizen and the citizen is killed. The state pays the citizen's family tens of millions of dollars.     Wow, I find it funny that the judge didn't know, nor did he allow the prosecution to state that the defense has 10 lawyers and a $1 million dollars backing him. He has resources too and to downplay that is simply wrong. Don't get me wrong I think the judge has been fair during the trial, but please compare apples to apples.

      @@ninjamoves1111 You could be right, but I don't know if you have been watching the trial, but he seems to be a dic% to both sides at times. I think he knows the world is watching so he can't favor one side over the other too much.
