  • Boston criminal defense attorney Joseph Simons explains the self-defense claim, according to Massachusetts Law.
    In short, the law allows you do reasonably defend yourself or others against imminent threats to your safety. You have a duty to retreat, if you can do so safely. If retreat is not possible, your response must be reasonable in relation to the threat that you face. For example, you probably can't kill someone if they are simply trying to slap you in the case and then claim self-defense. You also can't claim self-defense if your actions are in retaliation for an earlier attack.

    0:53 RE: Duty to Retreat (in home): The intruder/other person also has a duty to retreat. Therefore, if we are in my home, the who has more of a duty to retreat? I know my answer.

    Glad I left this blue state after graduating Fitchburg High in 1986. Now happy in a free, red state in the south that upholds the 2A.

    I wish blue states would allow you to defend yourselves. I’m blue all the way for everything, except for gun laws and self defense laws.
