Have a question. Tuesday I was delivered a harassment order with zero evidence by police. That Friday prior the same police filed charges against plaintiff for threat to hire a hitman to kill me. That incident was recorded and given to police and Worcester DA…I went to vacate the 10day order Tuesday morning as police told me to do. Judge on 3rd floor room 14 said NO. And also said no to a harassment order put on that individual…so what do I do. Just wait for the cops to knock on my door in the next few days cause the plaintiff makes something new up with zero evidence
It doesn't sound like there is anything to do at the moment. Hopefully there are no further developments.

While I understand the need for quality represtation. Mr. Dew was arrested recently for serious, and horrendous crimes, again. "A Mattapan man was ordered held without bail pending a dangerousness hearing Friday on charges he raped and beat a woman so badly police found her covered in blood and spitting up blood clots early Sunday morning, the Suffolk County District Attorney's office reports. Police responded to Evelyn Street around 2:15 a.m. on a report of a disturbance to find a screaming woman "with her jeans pulled down to her ankles and a T-shirt soaked in what appeared to officers to be blood, pulled up," the DA's office reports. Anthony Dew, 42, was arrested not long after, because while he fled the scene, as first responders were trying to help the woman, he returned and "and became verbally combative with officers," the DA's office reports, adding, "Officers observed several scratches to his hand and face. Based on the description given by the victim, Dew was placed under arrest." The DA's office continues that the woman told police that Dew had beaten and raped her in his apartment on Evelyn Street." Imagine being beaten so bad you spat blood clots while being raped and drifting in an out of consciousness. Are you going to make a video about this women's ordeal too?
This is directly on Everett Police Departments website what do you think about this (All of the following crimes will disqualify a person from immediately obtaining an FID. However, if it is not a crime of violence, the person will be entitled to receive the FID after five years from the date of conviction or release from prison, probation or parole (whichever is longer). If this is the case, the person may only possess non-large capacity weapons with the FID card. On the other hand, if a person has been convicted (or if he or she admitted to sufficient facts to warrant a finding of guilt - even if the case was continued without a finding) of any of these misdemeanors, it will act as an automatic disqualifier for life from obtaining a LTC. In other words, if a person has been convicted of OUI he or she can never be issued a LTC in the Commonwealth.)
They are saying a cwof is a disqualifier for life.
"On June 23, 2022, the United States Supreme Court issued its decision in New York State Rifle & Pistol Association v. Bruen. The case involved New York’s requirement that applicants demonstrate “proper cause” in order to obtain a permit to carry a firearm in most public places. The Court held that New York’s “proper cause” requirement violated the Second and Fourteenth Amendments. Although Bruen concerned a New York law, the Court specifically identified the “good reason” provision of a Massachusetts law, G.L. c. 140, § 131(d), as an analogue to New York’s “proper cause” requirement. Based on this decision, any restrictions appearing on any license holder’s License to Carry (“LTC”)-limiting the license holder to carrying a firearm only for such activities as hunting, target shooting, employment, or the like-are no longer enforceable. As a result, if your LTC has any such restrictions, those restrictions are no longer enforceable. If you would like a new license issued to you to reflect this change before your renewal, you may contact your licensing authority. Otherwise, when you reapply for an LTC in the future, you will be provided a new LTC without any such restrictions provided that the licensing authority does not deem you to be a “prohibited person” or “unsuitable” under the law. If you have any questions, please contact the firearms licensing officer at the police department or agency that issued your LTC. Mass.gov"

Excuse me sir. But can a defendant get time served if he has been in jail for a month and a half, before the court case?
If a person is held in jail pending the outcome of the case, that time will be counted toward any sentence imposed. Depending on the case, yes a person could get sentenced to "time served."
Can I use the 5th on ANY question I am asked in court...even if the answer is not incriminating? For example, "What is your name?"

Good video. I am a public Defender in Missouri and I really try to get my clients to email me with information or questions. Calls are simply not effective communication as i am often in court, and if i am in the office, a cold call is very challenging to answer, particularly when i am working on a different case at that time. Our office automatically mails out discovery to the defendant when received, and if they can not view media discovery, the client can set up an appointment to watch in the office.
Thank you. I agree - email communication is preferred, so that you can take your time to give thoughtful answers. Also, the communication is preserved so if the client doesn't recall what was said, they can go back and re-read the email response.
What do we need to bring to district court?
It depends on the case. Generally I have a memorandum of law, and sometimes exhibits or witnesses that are relevant to the allegations at issue.

@@quatchful File petition at the courthouse, pay filing fee, get a summons form, serve the police chief via constable or sheriff with the petition and summons form, return completed summons form to the courthouse, receive answer from police chief or town lawyer, then have the hearing.

@@panfergan not good. Is the lawyer on trial or on vacation? Sometimes lawyers are busy but if it’s happening more than just for a short period, I recommend first sending an email to the lawyer expressing your concerns; if that doesn’t help, you can terminate the relationship and should be entitled to a partial refund (see your fee agreement, which should address what happens).

It's still pending. The SJC sent it back to the trial courts and we recently filed a motion to dismiss. It's taking forever.
What about they have a sick family member who needs their care? The new job they start next week? Their girlfriend’s pregnant and needs them? They’ve enrolled in education and start next term etc? 🤣

This is why people are fleeing Massachusetts in droves. If two people have a dispute, they should be allowed to settle it in their own way. The law shouldn't interfere with that.

There is no time limit on a motion for new trial (aka rule 30 motion) in Massachusetts. It’s a bit different than an appeal.

what about a cwof on an assault with a deadly weapon?
You would not be prohibited. It would come down to the "suitability" issue explained in the video. Essentially, the police chief could try to deny you if they find credible information that suggests that you would be a risk to public safety. Then if you were denied, you could appeal to the district court within 90 days of the denial.

😊 is what's happening to my cousin right now. He's been locked up for 4 months still no probable cause hearing or ballistic evidence, and his lawyer is not speaking up in court for him regarding this matter. I told him to fire her she's working more in the prosecutor favor.

Hello sir i really enjoyed your video great information, i wanted to ask once you were able to vacate the plea deal you said he was now able to proceed to try to get his citizenship, but dont the padilla motion works only to remove the plea deal but you still have to continue and fight your case all over again or once is successful all the criminal charges drop?
Thanks for the comment. When a motion for new trial is allowed, the prosecution can still continue, and sometimes a person has to go to trial to fight the charges. In my experience, a lot of times the prosecution doesn’t bother, and the case just gets dismissed. Especially for older cases.
So can thier buddy buddy relationships with judge, prosecutor etc... Be circumvented if you dangle a potential feather in thier cap for future flex if you have a case with a real chance for winning. And do a solid and do the early work for them then they just have to study and execute after having thier early work done for.them?

Hello I’m from Massachusetts I was looking into getting my ltc but not sure if they would accept me I recorded a simple street fight that involved my girlfriend and an off duty officer. Since I was there and recorded I got charge with assault & battery and assault battery with a deadly weapon but all I did was record a simple street fight I went to court and we took a cwof finish my probation early and got my life together and now have a career but definitely looking for any advice or anything that would help to guide me in the right direction

What happened to facing your accusers in court. Highly disagree with zoom court. Keeps things fair. Child care is not courts concern how bad you want what your fighting for in court. It's lazy and shows little effort or care on courts part especially when your dealing with money and people's lives out of all things that should be in person voting and court are one of them,quality education access as well
