The woman needs to come clean. If they really are married, I would think it's highly likely, however, that the husband of the woman has also committed concubinage (the male version of adultery in Philippine law) since they separated, so it may be worth looking into what he's been up to. If he has, the threat of a counter charge of concubinage might well make the husband back off. As it stands, he likely only wants some of Chuck's money, but going down that road will be a never-ending handout to keep him quiet. You really have to be careful when considering a Filipina for your gf. In coming to the Philippines, I recommend having a good all around plan which includes things like handling financial matters and dating. Dating a married woman in the Philippines can only bring about problems, even if they are separated. Vetting in online dating is a must. Get it clarified. About half the women I talked to were married, but separated. Once you find that out, wish them well and move on. There are plenty of nice single women.

Lost in translation, springs to mind. Check that you understand what that means in your chosen country. Separated means that you have been previously MARRIED in the Philippines, usually. So you have to dig and find the rock bottom bare truth. Obtain a CENOMAR, the official Philippine Govt document that specifies her official marital status. You will have to apply for that. If she has been previously married, bear in mind that there is no Divorce process available in the Philippine Court system. You can 'annul' the marriage through the Catholic Church of the Philippines.... apparently that is a money making racket for the church, and is expensive. And how legal the Church annulling the marriage is, and how that fit's into the Govt system of no divorces, I don't know. It is definitely for a local lawyer. Does her CENOMAR record get updated to 'single' after an annulment? Much quicker to not go there and do that. You can get arrested and charged with adultery, so don't forget that. And that's not just in the Philippines.... so check out the local laws where ever you travel.

I had done some research about the annulment process a while back. Many said no never just a waste of money and some said it took ten years but yes it finally came through. It seems from what I remember the bottom line is,, ""The only time they get approved is if the reason would have prevented the marriage approval in the first place"". Such as if one of them was already married and the marriage never would have been approved if they knew one of them was already married. Nothing to do with adultery or how long they were separated. That is my understanding. So if he's thinking about an annulment they might want to check the grounds for requesting it to see if it is a good enough reason

Some countries you are guilty (no defense or excuse) if charged with adultery, no matter what. You just take your punishment. You either did, or did not. That would be the only possible legal contest. It's called 'strict liability' in law. Not knowing this or that doesn't matter. Other more enlightened countries do have proper defenses for adultery, but you are still rolling the dice. Your 'knowledge' may have some bearing on the outcome. But not your stupidity. If traveling and thinking of getting into a relationship, figure out the local laws and risks. It is often not as simple as you think. All the legal ways, but he still refused to reply, so the judge immediately approved the annulment. About a year later we got married. Now, we are going on 6 years this month. A lady having children was already a no-no for me because there would be a father and perhaps a husband in the background. There are so many available ladies there that there is really no reason to get involved with a woman with children. Offcourse she could be lying about not having children too, so you need to thread carefully and find out as much as you can before you get in too deep. Offcourse for older gentlement looking for a widowed lady is probably the second best option. But again its hard to know whats the truth. The situation described in the video is horrible and he needs to extract himself somehow. Ending the relationship is a given as there is no "out" here with a good outcome. Food for thought. Most likely the husband left her for another woman, this is also adultery, and he committed it first. Have an agency renew your visa for you to see if there is an issue, or if this is just a warning. Then do some homework on him, find out his living situation and see if he has another woman. If he is also guilty, and this goes to a judge, he will be in the jail cell next to you for the same charges. I am not sure how the court determines if adultery has taken place, but the burden of proof should be the same for both parties. I suspect he is also guilty of this crime and thus has not filed any charges. There was not an issue until she found the "Golden Goose", and now he wants a few of the eggs. Adultery is a crime, extortion is a crime, it is best not to add a third crime of bribery to the basket. I would do this. Get her back home. Keep your distance from her until you can sort out the situation. Have her or some third party contact him and find out what he wants, or what his expectations are. Do some due diligence on his living arrangements and see if he is also guilty of adultery. If he is clean, then you have to walk. If he is dirty, then there is really nothing he can do unless he wants to join you in jail. Either way, you need to find out his situation or the emotional stress will kill you. Good luck. Not an ideal place to be in.
It could be a set-up. In the Phils, it is common for the husband to sue the foreigner for a large amount of money. Also, many separated wives work with their husbands to grab the cash for a big payday.

Well, in legal terms, separation means only one thing in the Philippines: that the spouses have filed a petition in court that has been approved and they are granted legal separation of assets and liabilities. Unfortunately, a sexual relationship outwith the spouse, even while legally separated is still regarded as adultery. The only way, in the Philippines, to end a marriage is through annulment, which takes a while and can be very expensive.
As regards Chuck's situation, he does have a legal defense to any case filed against him: but he would have to prove that he did not know the true status of the woman and that can be difficult, as it's a "he says - she says" situation, with no corroboration.Chuck needs to get to the bottom of whether or not they are legally married, in case the guy claiming to be the husband is trying it on. The woman needs to come clean.
If they really are married, I would think it's highly likely, however, that the husband of the woman has also committed concubinage (the male version of adultery in Philippine law) since they separated, so it may be worth looking into what he's been up to. If he has, the threat of a counter charge of concubinage might well make the husband back off. As it stands, he likely only wants some of Chuck's money, but going down that road will be a never-ending handout to keep him quiet.
You really have to be careful when considering a Filipina for your gf. Knowing her true legal status is important and, if she denies being married you really ought to surreptitiously record her saying so!

In coming to the Philippines, I recommend having a good all around plan which includes things like handling financial matters and dating. Dating a married woman in the Philippines can only bring about problems, even if they are separated. Vetting in online dating is a must. Get it clarified. About half the women I talked to were married, but separated. Once you find that out, wish them well and move on. There are plenty of nice single women.

Separated is STILL married. There is NO divorce in the Philippines. Only annulment. He could end up in jail. Leave her immediately. As a foreigner he has NO rights in the Philippines. Lost in translation, springs to mind. Check that you understand what that means in your chosen country.
Separated means that you have been previously MARRIED in the Philippines, usually. So you have to dig and find the rock bottom bare truth.
Obtain a CENOMAR, the official Philippine Govt document that specifies her official marital status. You will have to apply for that.
If she has been previously married, bear in mind that there is no Divorce process available in the Philippine Court system.
You can 'annul' the marriage through the Catholic Church of the Philippines.... apparently that is a money making racket for the church, and is expensive.
And how legal the Church annulling the marriage is, and how that fit's into the Govt system of no divorces, I don't know. It is definitely for a local lawyer. Does her CENOMAR record get updated to 'single' after an annulment?
Much quicker to not go there and do that. You can get arrested and charged with adultery, so don't forget that. And that's not just in the Philippines.... so check out the local laws where ever you travel.
My advice is for him to get out of the Philippines first. If charges aren't filled yet, it's not late.... then figure out without having to worry about being arrested .

There are several videos on The Philippina Pea's channel that detail this section of PH law. In one or more videos, Pea's guest is a local attorney there in Dumaguete. Although Chuck may not have the cash to pursue the annulment, the urgent issue is to get a criminal attorney to advise him. He may be well advised to hire Gracey (Pea's guest on the videos). At this point, this is a criminal matter, not immigration, although immigration may be the logical course, especially if his intent is to flee.

I had done some research about the annulment process a while back. Many said no never just a waste of money and some said it took ten years but yes it finally came through. It seems from what I remember the bottom line is,, ""The only time they get approved is if the reason would have prevented the marriage approval in the first place"". Some countries you are guilty (no defense or excuse) if charged with adultery, no matter what. You just take your punishment. You either did, or did not. That would be the only possible legal contest. It's called 'strict liability' in law. Not knowing this or that doesn't matter.
Other more enlightened countries do have proper defenses for adultery, but you are still rolling the dice. Your 'knowledge' may have some bearing on the outcome. But not your stupidity.
If traveling and thinking of getting into a relationship, figure out the local laws and risks. It is often not as simple as you think. You are in a different culture and it takes time to understand how things work.
Because you are from Great Britain, USA, Australia, or where ever, you must understand that your home laws and rights do not apply to you any more, while you are in a foreign country. You have to comply with their laws...... not your home countries laws and accepted practices.

The only thing is annulment. This is what my wife got. Her husband split from her and the two kids. Never to be found. The court tried contacting him several times. All the legal ways, but he still refused to reply, so the judge immediately approved the annulment. About a year later we got married. Now, we are going on 6 years this month. I am so blessed with my wife.

My wife, a Filipino, said that when a married couple separates in the Philippines they often go to the baragay and sign papers that they will live apart, and don’t care about each other anymore. A lady having children was already a no-no for me because there would be a father and perhaps a husband in the background. There are so many available ladies there that there is really no reason to get involved with a woman with children. Offcourse she could be lying about not having children too, so you need to thread carefully and find out as much as you can before you get in too deep. Offcourse for older gentlement looking for a widowed lady is probably the second best option. But again its hard to know whats the truth. Food for thought. Most likely the husband left her for another woman, this is also adultery, and he committed it first. Have an agency renew your visa for you to see if there is an issue, or if this is just a warning. Then do some homework on him, find out his living situation and see if he has another woman. If he is also guilty, and this goes to a judge, he will be in the jail cell next to you for the same charges. I am not sure how the court determines if adultery has taken place, but the burden of proof should be the same for both parties. I suspect he is also guilty of this crime and thus has not filed any charges. There was not an issue until she found the "Golden Goose", and now he wants a few of the eggs. Adultery is a crime, extortion is a crime, it is best not to add a third crime of bribery to the basket.
I would do this. Get her back home. Keep your distance from her until you can sort out the situation. Have her or some third party contact him and find out what he wants, or what his expectations are. Do some due diligence on his living arrangements and see if he is also guilty of adultery. If he is clean, then you have to walk. If he is dirty, then there is really nothing he can do unless he wants to join you in jail. Either way, you need to find out his situation or the emotional stress will kill you. Good luck. Not an ideal place to be in.

It could be a set-up. In the Phils, it is common for the husband to sue the foreigner for a large amount of money. Also, many separated wives work with their husbands to grab the cash for a big payday.

Simple Put her on the ferry too get back home Give her some money and say you good buy. Leave the place you guys were staying together and take ano ferry to another island. Let her go and don't look back, she lied got cauht by her husband. He didnt do his due dillegence. Shame on him. No he can blame but himself, there is no lose.
