Pl advise , whether total liability of contract is different than indemnity. If total liability is limited say 10 % of consulting agreement, can we get away from indemnity clause. Can we fix indemnity . It is related to engg consulting and not site construction.
Great video. Re; restricted covenant. You mention hairdressers/nails bars etc...Surely restricted covenants would be superseded by competition law in those cases (stopping a hairdresser from working down the road because they worked for you for a period seems anti-competitive practice whether agreed to or not in an employment contract). There is a balance to be struck between the right of the employer/business owner and the right of the employee to earn a living. Reasonableness is an important consideration.
