  • A good indicator that a business is being run professionally is if they issue employment contracts to employees.
    It takes a mature business to realize the value of an employment contract and use it to make its legal systems easier to run.
    But the employment contract leads to so many misconceptions, both on the employer's and the employee's side.
    One of the most common questions we get on our site is a variation of:
    "Attorney, my employer didn't issue me an employment contract. Can I immediately resign?"
    Or on the side of the employer, they ask: "Attorney, I want to terminate an employee. I didn't issue him an employment contract. Can I just remove him now?"

    Hi Atty/Sirs, what if the company hire an employee for one company, then this company advised employee to work with another company without any contract and payment for any salaries, can the employee file a case to DOLE as non-payment of salaries, wages and 13th month pay.

    Hello po sir. Isa po akong manggagawa sa isang kompanya, na hire po ako sa isang branch nila sa province then after 10 months na promote po at nagwowork na sa head office ng company sa Pasay kaya nabago po ang salary ko at naging 537, after 5 months nagkaroon ng pandemic kaya nagduty ulit ako sa isang branch nila sa province pero kung ano ang ginawgawa ko sa head office ay gayon din dun sa isang branch nila after almost 2 years na promote ako as store supervisor then ngayon po ay ibinaba ang rate ko sa 373 kasi dito na daw ako ngtratrabaho sa laguna tapos pinapagawa ako ng letter na inaaccept ko na 373 lang rate ko per day, na kung saan ang letter ay hindi ko ginawa, tanong ko lang po kung may magagawa po ba ako para maging manila rate pa din ako? Ano po bang labor code ang sumasang- ayon dito para mailaban ko po? Salamat po mga sir

    Good day po Atty!
    I am a government nurse involved in a team of contact tracers. We are working from 8am to 5pm, Mon to Friday.
    Minsan po, may mga cases pag Saturday and Sunday. Some of the bosses are requiring us (minsan sinusungitan pa) na magparticipate parin sa contact tracing activity na yun.
    May karapatan po ba kaming mga nasa baba na rumason na ang Sabado at Linggo ay kailangan din naman irespeto ng mga bosses bilang araw ng aming pamamahinga, time with the family, time with side hustle, other job/ business, etc..
    Or no choice po kami dahil nga kami ay government employee na kailangang magbigay serbisyo parin kahit sabado at linggo?

      Hi Blessed Prosperous. Since you're in Government, would advise going back to the terms of your contract. Reporting and rest days should be there. I am absolutely sure that there is a provision for rest days there. If you don't have access to your contract, you may opt to talk to your supervisors regarding this. It would be impossible to require employees to report continuously for 7 days a week. Hope your talk goes well and you get your well-deserved rest soon.

      Medyo tricky po ito. Nung nag sign ka kasi, nangako ka na sa employer mo na tutuloy ka. Kung lilipat ka bigla sa bago kasi mas maganda offer, essentially, di mo tutuparin ang pangako mo.
      Ang best way po, habang hindi pa nagsisimula, kausapin na lang po ng maayos ang employer at makiusap na hindi na po ituloy ang employement sa kanila. Para sa ganun, maka alis ka ng maayos at mapapakita mo na propesyonal kang kausap.
      Ang hindi recommended ay hindi ka na lang sisipot bigla after pumirma. Mag rereflect po ito na hindi kayo maayos na kausap. Malamang po, madudungisan ang inyong professional reputation kung ganito po ang pakikitungo sa mga employer. Hope this helps!

    Hi, tanong lang po. Ang COE po diba dapat may Original Sign ng Employer? Yung binigay po kase samin printed lang at hindi original ang sign. Dapat po diba original ang sign at may sealed dapat?

      Wala naman po specific rule na dapat original signature and sealed. As long as the company stands by the certification pag tinanong or nag verify yung new employer, I don't see any issue with this. Hope this helps!

      Be sure to watch the whole video kasi the same rules apply po. The subcontracting company has their own employees, so the comments in this video apply in that situation. Pero yung client, NO NEED magissue ng contract sa employees ng subcon kasi hindi naman nila employees yun. Employees ng Subcontracted company yun. Hope this helps!

    Good am po attorney. Ask ko lang po pano po kung contractual po may makukuha po ba na seperation pay? Contractual po kasi ako for 5 years. Every year po nagsisign po ako ng contract as a house hold employee. Yaw ko na sana mag renew ng contract. May makukuha po ba ako na seperation pay?

    Attorney isa akong private teacher halos 20 days palang akong pumapasok wala pa akong contract at hindi pa din ako sumahod sa isang cut off kasi nga wala pa ang contract. Natawagan po ako sa public kaya po nag file ako ng resignation 1 week nalang ang ipapasok ko dahil need na ako sa public ang kaso po di nila tinanggap ang resignation ko ano po ang mangyayari sakin?

    Attorneys Question po I hope matulungan niyo ko, I have no one to ask 😔
    I was promoted to Team Lead role last May. I've been waiting for a new contract or kausapin man lang ako ng HR kung regarding sa promotion pero they are giving a lot of TL Task already without any discussion kung may additional ba sa sahod ko from agent to TL, I ask them sabi lang mag hintay, but I am tired na sa puro antay nila. Can I take legal action on this? Sobrang pagod na po ako sa mga pinapagawa nila which I am not paid to do. 😔

      Hi MJ, I sympathize with your situation so here are a few things that may help.
      First off, promotion is discretionary on the part of the employer. Pwede ka i-promote, pwedeng hindi. This is totally up to them. In this case, they opted to promote you and that's great. Now, for the next part, you have to do this delicately. I suggest that you write a letter to HR instead of just following up verbally. The letter should give a detailed history of what's been happening: the fact that they said you were promoted in May, the extra tasks that you have been doing, how many times you have followed up. End it with a request for clarification as to your status and any changes to your salary.
      2 things may happen here: The company will then realize that it has been remiss in implementing changes due to your promotion and act on it asap. OR... they may continue to neglect to implement any changes that your policies require as a result of the promotion. In the second scenario, you may continue following up or resign if you can't take it anymore (This course would help then info.legalguide.ph/resignation )
